END OF CONSENT CALENDAR * * * * * * * * * * * * * * * ORD 1505 NCS MULTI-FAMILY RESIDENTIAL MORTGAGE REVENUE BOND LAW Council heard from Alan Baldwin, developer of the project called Valley Orchards, which is planned to be an elderly housing community at Ely Blvd. and E. Washington Street. After a considerable discussion with Mr. Baldwin, Couneil acted to adopt the ordinance, providing for the City of Petaluma Multi-Family Residential Mortgage Revenue Bond Law, including general provisions and definitions, powers and procedures to issue revenue bonds and to make and purchase construction loans and mortgage loans, both directly and indirectly through loans to lenders or the purchase of • ~ \ FEBRUARY 1, 1982 participation interests for specified purposes and eertain•other supplemental provisions. The hearing was opened at 8:17 p.m. Council heard from Joe Nizibian, proponent; A.J. Weddle, 1319 Canyon Drive, who did not express opposition to the development, but requested the Council make Canyon Drive a cul-de-sac. He handed a 45 signatiire petition to the Council regarding the requested cul-de-sac. He also showed photographs of some slides in the area uphill from Canyon Drive. Council also heard requests for cul-de-sac end on Canyon Drive f"rom Kenneth Godfrey, 1322 Canyon Drive, James Seabrook, 1550 Mountain View Avenue, and David McCauley, 1320 Mountain View Avenue. Mr. Ed Avilla, 1320 Mountain View Avenue, expressed unconditional sup.port for the project. The hear.ing was closed 'at 9:00 p,m. After considerable discussion among Councilmen, tfie following actions were taken. RESO 9365 NCS , • ISSUANCE OF MITIGATED NEGATIVE DECLARATION - WINDMILL,SUBDIV,TSION ~ Adopt Resolution No. 9365 N.C.S. appr-oving the issuance of a mitigated negative declaration to the Califormia Environmental Quality Act•for Nizibian (Windmill Subdivision) located at the end of Canyon Drive off Mountain View Avenue. Introduced by Councilman Perry; seconded by Councilman Battaglia. AYES: PERRY/HARBERSON/BOND/BALSHAW/BATTAGLIA/CAVANAGH/MAYOR MATTEI ~- i 2 FEBRUARY l, 1982 RESO 9366 NGS GENERAL PLAN AMENDMENT - WINDMILL SUBDIVISION - Adopt Resolution No. 9366 N.C.S. adopting an amendment to the General Plan and its Environmental Design Plan Element to change the designation of property located at the end of Canyon Drive, off Mountain View Avenue, A.P. #'s 19-232-06, 16, 19 and 20, from Suburban Low Density Residential (2.0 units per acre) to Urban Low Density Residential (4.5 units per acre), for Nizibian's Windmill Subdivision. Introduced by Vice-Mayor Cavanagh; seconded by Councilman Harberson. AYES: PERRY/HARBERSON/BOND/BALSHAW/BATTAGLIA/CAVANAGH/MAYOR MATTEI APPEAL FROM PLANNING COMMISSION ACTION - WINDMILL SUBDIVISION On January 12, four of the seven memY~er Planning Commission sat in regular session. In considering the Nizibian rezoning, on a vote of 3 Ayes, 1 No, the Planning Commission failed to recommend favorably on the rezoning (Planning Commission rules require a favorable vote of at least 4 persons when less than a full Commission is in attendance). Tony Nizibian appealed that action. Deputy City Attorney Keene advised the Council if they wished to uphold the appeal, the appropriate Council action would be to introduce the ordinance to rezone the property at this meeting., and to adopt it at the next Council meeting. That would constitute sufficient response to the appeal. ORD 1506 NCS REZONING WINDMILL SUBDIVISION Introduce Ordinance No. 1506 N.C.S. amending the Zoning Ordinance by rezoning A.P. #'s 19-232-06, 16, 19 and 20 in the vicinity of Canyon Drive off~Mountain View Avenue from R-1-20,000 (Single Family Residential) to Planned Unit Development. Introduced by Councilman Perry; seconded by Councilman Bond to introduce the ordinance and direct the City Clerk to post the ordinance as required by the City Char°ter. AYES: PERRY/HARBERSON/BOND/BALSHAW/BATTAGLIA/CAVANAGH/MAYOR MATTEI RECESS Council recessed from 9:20 to 9:25 p.m. PUBLIC HEARING ACORN TERRACE GENERAL PLAN CHANGE Planning Director Freitas reviewed the project for the Council. The public hearing was opened. The Mayor noted receipt of a letter from Robert Parvin opposing the rezoning. There being no other comments, the hearing was closed. ~ 3 ~~ FEBRUARY l, 1982 RESO 9367 NCS MITIGATED NEGATIVE DECLARATION - ACORN TERRACE Resolution No. 9367 N.C.S. approving the issuance of a mitigated negative declaration pursuant to the California Environmental Quality Act for Acorn Terrace condominium project, located at Sycamore Lane and Acorn Drive. Introduced by Councilman Bond; seconded by Councilman Perry. Mr. Stuart Hirsch, Mr. Michael Davis, Mr. Wayne Williams and Mr. Pat Carlone addressed the Council. RESO 9370 NCS ALLOTMENT QUOTAS Adopt Resolution No. 9370 N.C.S. establishing quotas "for the Residential Development Allotment System of the City of Petaluma for the 1982 construction year, and establishing areas for allocation pursuant to said quotas may be awarded. AYES: PERRY/HARBERSON/BOND/BALSHAW/BATTAGLIA/CAUANAGH/MAYOR MATTEI Council asked staff for a concise report on the number of allotments outstanding on the east side of Highway 101 and.the number of allotments outstanding on the west side of Highway 101. LUCHESSI PARK SENIOR CENTER USE POLICY City Manager Scharer recommended the proposed policy (which was developed by the ad hoc Senior Citizen Committee), for use of Luchessi Park Senior Citizen Center to be referred to the Recreation Commission. PARKS AND PUBLIC IMPROVEMENTS NAMING COMMITTEE Mayor Mattei will name a committee to.make recommendations for the name of the Senior Center at Luchessi Park and the Zake at Luchessi Park. RESO 9371 NCS LAKEVILLE HIGHWAY PLAN LINE PI20POSALS City Engineer Hargis reviewed the proposals. Resolution 9371 N.C.S. to retain Oberkamper and Associates at a cost not to exceed $26,000. The work will include aerial photography at a de:tailed scale for engineering, and at a larger scale for presentation at public hearings, investigation of alternatives for Lakeville alignment and geometrics, including ramp configuration analysis at U.S. Highway 101, and to employ the consulf'ing firm of tjkm for traffic analysis. AYES: PERRY/HARBERSON/BOND/BALSHAW/BATTAGLIA/CAVANAGH/MAYOR MATTEI ANNEXATION REPORT Principal Pl.anner Warren Salmons presented the Council with the proposals from Bill Lawrence and Isolena Maestretti for annexation of parcels between Denman Road, on the westerly side, O1d Redwood Highway on the easterly side, the City limits on the southerly side,.and Ely Blud. North.on the northerly side, equaling 51.96 acres. He also discussed properties located on Ely Blvd. North 6 FEBRUARY 1, 1982 between the present City limits northwest of Alderwood Subdivision, going westerly to Cader Farms (184.05 acres). Provision of City services (water and sewer) would be something of a problem. Couneil expressed some concern and a need to study the drainage from the upper reaches of the Petaluma River and any downstream effects of development in the Denman flats area (Lawrence- . Maestretti annexation request). Leonard Jay asked the Council to give him a feeling as to whether or not they would look favorably upon any development and annexation requests for the Ely Blvd. parcels sometime in the next couple of years. Mr. Truman Horton, representing the Church of Christ, requested some more definite information on their two year old request for annexation or outside sewer connections for one of the parcels on Ely Blvd.: North. It was noted that the property currently owned by Mr. Olsen is the site of indian artifacts, and any development in that area would be referred for studies of the historical and cultural information that might be available there. The Council consensus was that they recognize that eventually there will be development in this area and that the developer might wish to begin the Planning processes for the Ely Blvd. North area. RESO 9372 NCS CLETS (CALIFORNIA LAW ENFORCEMENT TELETYPE SYSTEM) Adopt Resolution No. 9372 N.C.S. recommending the agreement with Sonoma County for the CLETS system to remain as it is. Introduced by Councilman Harberson; seconded by Councilman Balshaw. AYES: PERRY/HARBERSON/BOND/BALSHAW/BATTAGLIA/CAVANAGH/MAYOR MATTEI BOY SCOUT IN GOVERNMENT DAY - FEBRUARY 16, 1982 Council was advised the first half hour of the Tuesday, February 16 Council meeting would be the time when the local Boy Scout troops will have their representatives sit in a mock Council meeting as they do each year. • JANUARY 4th FLOOD City Engineer Hargis reported the water at the Payran Street bridge was 2 feet higher than the 100 year flood, and he has learned that the height has exceeded the 300 year record. ~ ~ 7 ~ ~"~ FEBRUARY 1 , 1982 ADJOURNMENT The mee.ting was adjourned at 12:07 a.m. to a joint meeting with the Planning Commission to consider the proposed changes to the Housing Element of the General Plan on Monday, February 8 at 7s°00 p.m. ~ Attes • May . . i y Clerk 8
