REGULAR MEETING ROLL CALL Present: Councilmen Perry, Harberson*, Bond, Balshaw, Battaglia, Vice-Mayor Cavanagh, Mayor Mattei Absent: None *Councilman Harberson arrived at 7:15 p.m. INVOCATION Councilman Bond led the group in prayer. PLEDGE OF ALLEGIANCE Vice-Mayor Jack Cavanagh, Jr. led the Pledge of Allegiance. REPORT ON FLOOD City Manager Scharer reported the offices that had been set up in the Veterans Memorial building to assist victims from the flood will be closing this week. The Petaluma Refuse Company caused debris boxes to be placed in the neighborhoods. They will be available for deposit of throwaways until Sunday. The January 11 minutes were approved as submitted. CONSENT CALENDAR Council approved the following items by the adoption of a single motion, introduced by Vice-Mayor Cavanagh; seconded by Councilman Perry. JANUARY 18, 1982 ORD. #1502 NCS REZONE NORTHSTAR SUBDIVISION Adopt Ordinance No. 1502 N.C.S. amending Zoning Ordinance 1072 by rezoning A.P. #'s 136-110-01, 136-110-23 and 137-060-20, located at the intersection of Ely Blvd. North and Capri Creek in Petaluma, from Study Zone and Flood Plain Combining District to Planned Unit Development and Flood Plain Combining District, Northstar Subdivision (Introduced by Vice-Mayor Cavanagh, seconded by Councilman Perry on January 11). RESO #9356 NCS DEVELOPMENT PLAN - NORTHSTAR SUBDIVISION Adopt Resolution No. 9356 N.C.S. approving the development plan for the Northstar Subdivision, located at Ely Blvd. North and Capri Creek (A.P. #'s 136-110-01, 136-110-23 and 137-060-20). ORD. #1504 NCS BUSINESS LICENSE PRORATION PROVISIONS Adopt Ordinance No. 1504 N.C.S. amending Section 6.04.191 of the Municipal Code relating to business license proration provisions. Introduced by Councilman Harberson; seconded by Councilman Battaglia on January 11. RESO #9357 NCS DECLARING CANVASS OF RETURNS AND RESULTS OF THE SPECIAL MUNICIPAL ELECTION HELD ON JANUARY 12, 1.982 WHEREAS, on October 19, 1981, the Petaluma City Council adopted Resolution 9291 N.C.S. declining to repeal Resolution 9265 N.C.S., and thereby ordering an election on January 12, 1982, in accordance with the provisions set forth under Division 4, Chapter 3, Article 2 of the Elections Code of the State of California. WHEREAS, the Special Municipal Election was held in the City of Petaluma (City) on January 12, 1982; and, WHEREAS, said Special Municipal Election was held on said date in accordance with law, the votes thereat were -received and canvassed, and the returns thereof were ascertained, determined and declared in all respects as required by law; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Petaluma as follows: ~ (1) The City Clerk is hereby instructed to enter this Resolution on the minutes of this meeting as a statement of the result of said election; ~~ 2 ~ JANUARY 18, 1982 (2) The,total number of ballots cast in the City at said Special Municipal Election was as follows: Inside City ...................8510 (3) The total number of Registered Voters is: Inside City .................16,444 Shall Resolution No. 9265 N.C.S. passed by the Petaluma City Council on August 24, 1981, making an amendment to the General Plan and its Environmental Design Plan Element for certain property located in the vicinity of Frates Road and Lakeville Highway, be adopted? RESO #9359 NCS STIP* PROJECT LIST Resolution No. 9359 N.C.S. recommending that the Sonoma County Board of Supervisors approve a resolution recommending major non-interstate projects in Sonoma County for incTusion in the preliminary State Transportation Tmprovement Program, 1982-83. Introduced by Councilman Battaglia; seconded by Councilman Perry. AYES: PERRY/HARBERSON/BOND/BALSHAW/BATTAGLIA/CAVANAGH/MAYOR MATTEI 3 ~1 JANUARY 18, 1982 SWEED SCHOOL REPORT City Manager Scharer advised that the City proposes to create a Public Building Overlay District. There would be no change to the underlying zone; permitted uses w ould be granted by a conditional use permit, and, if the building were destroyed, the overlay zoning provisions would require that the previous underlying zoning would prevail. There was no objection to this proposal. ORD. #1505 NCS REVENUE BONDS - MULTI-FAMILY HOUSING City Manager Scharer, developer Alan Baldwin, Phil Greenley from First Interstate Mortgage Company, Doug Smith from Newman Associates Investment banking firm and Margaret Heiser from the Bond Counsel firm of Orrick, Herrington, Sutcliffe, all spoke and answered questions regarding the proposed revenue bond ordinance. After considerable discussion, the ordinance was introduced by Councilman Harberson; seconded by Councilman Perry. Ordinance No. 1505 N.C.S. providing for the City of Petaluma Multi-Family Residential Mortgage Revenue Bond Law, including general provisions and definitions, powers and procedures to issue revenue bonds, and to make and purchase construction loans or mortgage loans, both directly and indirectly through loans to lenders or the purchase of participation interests for specified purposes and certain other supplemental provisions. AYES: PERRY/HARBERSON/BOND/BALSHAW/BATTAGLIA/CAVANAGH/MAYOR MATTEI RECESS Council recessed from 8:00 to 8:10 p.m. RESO #9361 NCS PERMIT FEES - FLOOD DAMAGE RECONSTRUCTION Resolution No. 9361 N.C.S. authorizing waiver of permit fees for repairing dwellings which received flood damage in connection with the January 4, 1982 rain storm. Introduced by Councilman Battaglia; seconded by Councilman Bond. Council heard from Michael Davis, Pat Carlone, Stuart Hirsch, and Wayne Williams, representatives of the Stop Frates Development Committee, who made recommendations for citizen involvement in the "Citizens Review Board".
