TNV(1C'AT TC1N The Rev. Councilman Roland Bond led the prayer. PLEDGE OF ALLEGIANCE Vice-Mayor Cavanagh led the Pledge of Allegiance. MINUTES The November 16 minutes were approved as submitted. The December 7 minutes were approved as amended. Page 3, last line of Ridesharing Program paragraph, replace the word consensus with approval. Page 5, National League of Cities, delete the name Battaglia and insert the name Vice-Mayor Cavanagh. The third lirie of the same paragraph, delete "during the end of November" and insert "from November 29 to December 2." ORD. #'1497 NCS MAGNOLIA HILLS SUBDIVISION Adopt Ordinance No. 1497 N.C.S. amending Zoning Ordinance 1072 by rezoning A.P. #'s 6-450-04, 13; 6-460-01, 06 located in the vicinity of Magnolia Avenue and Petaluma Blvd. North (Magnolia Hills Subdivision). RESO #9338 NCS MAGNOLIA HILLS DEVELOPMENT PLAN Adopt Resolution No. 9338 N.C..S. approving the development plan for Magnolia Hills Subdivision, located in the vicinity of Magnolia Avenue and Petaluma Blvd. North. END OF CONSENT GALENDAR * * * * * * * * * * * * * * * P.G. & E. HYDROELECTRIC PROJECT RELICENSING (Councilman Balshaw arrived) Mr. Mike Warren from Pacific Gas and Electric Company addressed the Council requesting Council support in the utility's effort to obtain approval from the Federal Energy Regulatory Commission for relicensing the Rock Creek - Cresta Power Plants on the Feather River and the Mokelumne River Power Plants. Mike Warren advised that the City of Santa Clara is seeking control of the Mokelumne River project, and the Northern California Power Agency member cities (Palo Alto, Alameda, Biggs, Gr.idley, Lompoc, Redding,. Roseville, Ukiah and the Plumas-Sierra Rural Electric Cooperative, and the five southern California cities of Anaheim, Azusa,: Banning, Colton and Riverside) are seeking c.ontrol of the Roek Creek - Cresta project on the Feather River. P.G. & E_ is urging cities to adopt resolutions supporting the continued licensing of these hydroe'lectric power plants to the Pacific Gas and Electric Company. It is estimated the cost to consumers of denying the license to P.G. & E. would be an additional cent a day for the average residential customer. It was moved by Councilman Bat"tagl-ia; seconded by Councilman Perry that staff prepare a resolution stating the City Council urges the Federal Energy Regulatory Commission to protect the utility users in the City of Petaluma from any rate increases. AYES: PERRY/HARBERSON/BOND/.BALSHAW/BATTAGLIA/CAUANAGH/MAYOR MATTEI 2 DECEMBER 21, 1981 RESO #9339 NCS DUFFEL SUBDIVISION Resolution No. 9339 N.C.S. approving the issuance of a mitigated negative declaration pursuant to the California Environmental Quality Act and the prior adoption of the City-wide Master Environmental Impact report for Duffel Residential Subdivision, 1_ocated at Frates Road and Ely Blvd. South extension. Introduced by Vice-Mayor Cavanagh; seconded by Councilma:n Perry. AYES: PERRY/HARBERSON/BOND/BALSHAW/BATTAGLIA/CAVANAGH/MAYOR MATTEI ORD. #1499 NCS REZONE DUFFEL SUBDIVISION Introduce Ordinance No. 1499 N.C.S. amending Zoning Ordinance 1072 as amended by reclassifying and rezoning A.P. #17-040-12 in the vicinity of Ely Blvd. South extension and Frates Road (Duffel). DUFFEL DEVELOPMENT PLAN Planning Director Freitas reviewed the conditions of the " development plan and Council continued consideration of the development plan to the next meeting when the rezoning ordinance is scheduled for adoption. HARDBOARD BUILDING SIDING APPEAL BY McBAIL COMPANY McBail Company appealed the Site Plan and Architectural Review Committee's condition that proposed exterior hardboard building siding shall be substituted with plywood and natural wood materials. The City Council had considered this same matter in May of 1981. Mr. Larry Tencer, Planning Commissioner and Site Plan and Architectural Review Committee member,, expressed his concern about the use of hardboard siding because of its alleged potential for buckling and expansion if not treated properly during the construction phase of the buildings. Michael Gallagher spoke on behalf of McBail Company and noted there is a manufacturer'.s warranty on this material and a three year warranty per State law on the part of the builder. After a considerable amount of discussion, a resolution to uphold McBail's appeal and allow the use of hardboard building siding was introduced by Councilman Balshaw; seconded by Councilman Bond. AYES: PERRY/BOND/BATTAGLIA/CAVANAGH/MAYOR MATTEI NOES: HARBERSON/BALSHAW COUNCILMAN PERRY CERTIFICATE Mayor Mattei gave Councilman Perry his ten year certificate of service and ten year pin. 2~- 3 ~ ~ DECEMBER 21, 1981 RECESS Council recessed from 8:30 to 8:40 p.m. SWEED SCHOOL USE APPEAL BY MATT HUDSON On behalf of Mssrs. Lyon and Mastrangelo, Matt Hudson, attorney, requested the Council approve conversion of the school located at 331 Keller Street to professional, executive and administrati~e offices which would be open only during daytime hours. Parking would be provided in the old playground which has access from Liberty Str•eet. Robert Koenitzer of 311 Keller Street indicated the neighbors' support of professional, exeeutive and administrative uses for the building. After a considerable amount of discussion, Council continued the appeal to January 18 for consideration of the appropriate documentation which would permit this change of use. Mr. Hudson presented a petition with 68 signatures supporting the conversion of the old Sweed School to professional and administrative offices. PETALUMA TIRE AND BRAKE GARAGE DOOR COLOR On November 23, the Site Plan and Architectural Review Committee d'enied Petaluma Tire and Brake's request that their thre'e garage doors on the west side of the building be colored off-white rather than the previous requirement to use medium brown. Council heard from Petaluma Tire and Bra•ke owners, Bern Bergstrom and Keith Jones, who stated the off-white color was ordered in error and requested Council allow them to keep the off-white finish on the garage doors. Council defeated the following 'resolution, thus upholding the appeal: Resolution denying the appeal of Petaluma Tire and Brake, introduced by Councilman Balshaw; seconded by Councilman Bond. AYES: HARBERSON/BOND/BALSHAW NOES: PERRY/BATTAGLIA/CAVANAGH/MAYOR MATTEI ORD. #1500 NCS SIDEWALK SP;LES REGULATIONS Introduce.Ordinance No. 1500~N.C.S..amending Chagter 13.04 of the Municipal Code by amending Sectibn 13.04.040 governing sidewalk sales and related obstructions to public ways. Introduced by Councilman Balshaw; seconded by Councilman Harberson. AYES: PERRY/HARBERSON/BOND/BALSHAW/BATTAGLIA/CAVANAGH/MAYOR MATTEI (This eliminates the two day limitation for sidewalk sales.) 4 DECEMBER 21, 1981 2 ~ ORD. #1501 NCS FINAL MAP TIME LIMITS Introduce Ordinance No. 1501 N.C.S. amending Chapter 20.24 (Subdivisions) Section 20.24.O1Q of the Municipal Code to provide for the expiration of approved tentative maps and extension of time limits for filing final subdivision maps. This action increases the number of,months (from 12 months to 24 months ) from the date of approval of the tentative map to the deadline for filing the final map and allows the Planning Commission to approve yet another extension of 12 months for filing the final map (current regulations allow the Planning Commission to grant only a six month time extension). RESO #9342 NCS 1981 RESURFACING COMPLETION Resolution No. 9342 N.C.S. accepting completion of the 1981 Street Resurfacing project, No. 5003-5540 (Ghilotti Brothers). Introduced by Councilman Battaglia; seconded by Councilman Balshaw. RESO #9343 NCS PURCHASE USED BUS Adopt Resolution No. 9343 N.C.S. authorizing the acquisition of a 1978 Mercedes Benz 309D bus from Sonoma County to provide fully accessible paratransit service with wheelchair lift and two wheelchair tie-downs. The acquisition cost is not to exceed $15,100. Introduced by Councilman Bond; seconded by Councilman Harberson. AYES: PERRY/HARBERSON/BOND/BALSHAW/BATTAGLIA/CAVANAGH/MAYOR MATTEI RESO #93'46 NCS COMMUNITY DEVELOPMENT BLOCK GRANTS COMMITTEE Adopt Resolution No. 9346 N.,C.S. appointing City Manager John Scharer as the City's represen€ative to the Advisory Committee on Community Development B1ock Grants which Committee was authorized by the Joint Powers Agreement approved by Resolution 9191 N.C.S. on June l, 1981, and appointing Planning Director Gregory Freitas as alternate City representative on that Committee. AYES: PERRY/HARBERSON/BOND/BALSHAW/BATTAGLIA/CAVANAGH/MAYOR MATTEI CAPITAL EQUIPMENT BUDGET ITEM - WOOD SIGN MAKING MACHINE City Manager Scharer requested authorization for Council approval to•purchase a"starred" item'from the 1981-82 Capital Equipment approved budget, Item No. 80 Wood Sign Making Machine (router with two, three and six inch letter templates for approximately $2,200) subject to finding a place in the City facilities to house the machinery. Call items the Council wishes to review again prior to purchase are marked "*" in the budget document. Motion was introduced by Councilman Bond; seconded by Councilman Balshaw. AYES: PERRY/HARBERSON/BOND/BALSHAW/BATTAGLIA/CAVANAGH/MAYOR MATTEI LIAISON WITH THE CITY OF NOVATO 5usan Stompe, Mayor of the City of Novato, suggested that a permanent liaison from each of the Councils be designated to meet regularly to provide a continuing understanding of what each City is doing. It was the consensus of the Petaluma City Council that the two cities have joint meetings two times a year or as required. MARINA COMMITTEE Councilman Bond reported the Marina Committee met with representatives of the commercial fishermen. The eommereial fishermen will appoint an advisory member to meet with the Marina Committee on a continuing basis. ASSEMBLYMAN REQUEST TO MEET COUNCIL William Filante, Assemblyman for the 9th District representing Marin and Sonoma Counties, has advised the staff that he would be available to meet with the City Council to discuss the C'ity's special needs and desires regarding State funding. The Council 6 DECEMBER 21, 1981 aqreed to a suggestion that a breakfast meeting be scheduled on a Monday morning. ~ T1."fllTiRTTMFTIT At 9:45 p.m. the Council jointly wished the listeners of the radio audience and persons in attendance at the Council meeting a Happy Holiday Season. ~ Mayor ~ ~~ 7
