Present: Councilmen Perry, Bond, Balshaw, Vice-Mayor Cavanagh Absent: Councilmen Harberson, Battaglia, Mayor Mattei INVOCATION , Rev. Stephen Philo of the Penngrove Community Church led the prayer. PLEDGE OF ALLEGIANCE Councilman Balshaw led the Pledge of Allegiance. MINUTES ~ J The September 28 and October 5 minutes were approved as submitted. CONSENT CALENDAR Council took the following action by the adoption of a single motion which was introduced by Councilman Perry; seconded by Councilman Bond. SUBDIVISION REGULATIONS - ORD. ~~1487 NCS Adopt Ordinance No. 1487 N.C.S. amending Chapter 20.16, Section 20.16.010, 20.16.430, 20.16.440 and repealing Section 20.16.445 of the Municipal Code to provide for filing of tentative maps of subdivision and the processing thereof. RECREATION BROCHURE PUBLICATION - RESO ~~ 9288 NCS Adopt Resolution No. 9288 N..C.S. establishing a policy for the publication of the City of Petaluma Recreation brochures. CAPITAL IMPROVEMENT PROJECT LIST - RESO ~~ 9289 NCS Adopt Resolution No. 9289 N.C.S. approving and adopting a Capital Improvement Project List for the fiscal year July 1, 1981 to and including June 30, 1982. 9PPROPRIATION~- ORD. ~~1488 NCS Introduce and adopt Ordinance No. 1488 N.C.S. appropriating certain available revenues not included in the 1981-82 budget, and declaring the urgency thereof to take effect immediately (This covers the Capital Improvement List adopted by Resolution No. 9289). VEHICLES: WATER & PUBLIC WORKS - RESO 4~ 9290 NCS Adopt Resolution No. 9290 N.C.S, awarding bid for one 1982 Ford van for the Street Department ($6,944.59), and for one 1982 pick-up truck for the Water Department ($6,991.20). JAMES PROJECT REPORT Mr. Robert Hirsch, of Goldrich, Kest and Associates spoke to the Council regarding a proposed agreement between the neighbors of the proposed St. James housing development and his firm. He stated the pending lawsuit and appeal would be dropped as soon as the parties have resolved the details of the agreement wherein Goldrich, Kest and Associates have agreed not to build low and moderate income family housing, but rather would build housing for the elderly and approximately 26 condominium units. He stated the~HUD funds would not be available at'the close of the next three months. Council consensus was to support this pending agreement between the neighbors and Goldrich - Kest, and the ultimate withdrawal of the matter from the courts. ~ FRATES PETITION City Clerk Patricia Bernard certified that the Stop Frates Development Petition which was filed in her office on September 22, 1981 has been verified. The petition consisted of 220 sections (pages) containing 2,735 signatures; the petition was signed by 1,876 qualified electors of this City, and 859 signatures were not sufficient. Signatures of'ten percent of the 16,233 registered voters were required to sign the petition.' CALL ELECTION - RESO 4~ 929i NCS Resolution No. 9291 N.C.S, declining to repeal Resolution No. 9265 N.C.S. and thereby ordering an election in accordance with provisions set forth under Division 4, Chapter 3, Article 2 of the Elections Code of the State of California. Introduced by Councilman Balshaw; seconded by Councilman Bond. AYES: PERRY/BOND/BALSHAW/VICE-MAYOR CAVANAGH ABSENT: HARBERSON/BATTAGLIA/MAYOR MATTEI It was announced that the City Clerk had established Monday,~ November 2, as the last day to submit arguments to be included in the sample ballot. The City Council was asked if it wished to have an argument prepared on its behalf for insertion in the sample ballot. City Council declined to do that and indicated there were many citizens in town who might wish to submit an argument which would be in favor of the measure. Council heard from Lynn Woolsey, representing the Stop Frates Development Group and from Bill White, representing the developers of Frates Ranch. RECESS Council recessed from 8:00 to 8:10 p.m. LUCCHESI PARK - RESO 4~ 9293 NCS Resolution No. 9293 N.C.S. accepting completion of park improvements for Lucchesi Park, Project LWCF 06 00857. AYES: PERRY/BOND/HARBERSON/VTCE-MAYOR CAVANAGH ABSENT: HARBERSON/BATTAGLIA/MAYOR MATTEI 1981.STREET RESURFACING PROGRAM City Engineer Hargis advised there are unexpended and unused contingency funds left from fhe overlay program as it was approved liy the Gity Council. The Council initially considered resurfacing a portion~of Hawthorne, Royal or Grant Avenue wliich were ineluded in the original proposal.. Council consensus was to approve the Engineer's recommendation to resurface as much of Grant Avenue between "I" Street and Mountain View as the remaining approximately $15,000 will cover. 119 HOWARD STREET HISTORICAL LANDMARK - ORD. ~~1490 NCS Planning Director Freitas reviewed the history of the building at 119 Howard Street. In the Historical Resources Iriventor:y this house was identified as a Greek re~ival, constructed approximately 1870. The public hearing was opened. The owner~, Jeff DaTe, expressed his agreement with the proposed Council action. There being no other comments offered, the hearing was closed. Ordinance I~Io. 1490 N.C.S. designating 119 Howard,Street as an historical landmark (A.P. 4~6-394-06). Introduced by Councilman Perry; seconded by Councilman Balshaw.
