REGULAR MEETING MINUTES OF MEETING ~ OF CITY COUNGIL PETALUMA, CALIFORNIA JULY 20, 1981 ~ b ~P~ ROLL CALL 7:00 P.M. Present: Councilmen Perry, Harberson, Bond, Bal.shaw, Cavanagh, Mayor Mattei Absent: Gouncilman Battaglia PLEDGE OF ALLEGIANCE Mayor Mattei ed the Ple of A1]_egiance. MINUTES The June 8.a June 30 minutes were approved as submitted. The July b inutes were clarified for the item on Industrial Avenue Extension EIR on page 3. Strike the beginning of the last sentence "The resolution was adopted with the understanding..." The statement should say, "There will be no change in the existing river channel." CONSENT CALENDAR Council took the following action by the adoption of a single motion. Introduced by Councilman Balshaw; seconded by Councilman,Harberson. AYES: PERRY/HARBERSON/BOND/BALSHAW/CAVANAGH/MAYOR MATTEI ABSENT: BATTAGLIA CLAIMS & BILLS ~ Adopt Resolution No. 9235 N.C.S. approving Claims and RESO ~~ 9235 NCS Bills. RECREATION PROGRAM Adopt Resolution 9236 N.C.S. establishing the classification, COORDINATOR title specit'ications, and salary range for the position RESO ~~ 9236 NCS of Recreation Program Coord~inator, and assigning said position to Unit 3 (Technical). End of Consent Calendar ~ * ~ ~ ~ ~e * ~ * ~ ~ * EIR ROBERT'BENSON/ Resolution No. 9237 N.C.S. certifying the Environmental STONY POINT ROAD Impact Report for Robert Benson, General Plan Amendment RESO ~~ 9237 NCS and Auto Center Development project. Mr. Jackson Menze addressed the Council as the representative of Del Davis and Associates who prepared the EIR. He called the Council's attention to the fact the proposed.development is in the flood plain area, possible problems with the adequacy~of the proposed holding ponds and noted some discrepencies in the topographical references between those submitted by the developer and that which was available through the City Engineer's office. Bob Benson addressed the Council and expressed some concern over conflicting directions he had~received: fr•om,staffxduring;,the_~lastr>four:yearst~'_Acting City Manager Scharer offered to meet with Mr. Benson regarding the administrative problems he had experienced. ANIMAL'CONTROL Resolution No. 9238 N.C.S. approving an animal shelter SERVICES/COTATI services agreement be-tween the City of Cotati and the RESO ~~ 9238 NCS Gity of Petaluma. ABSENT: BATTAGLIA Acting City Manager John Schaier noted this contract renewal would ref_lect an increase in their budget of approximately 9 percent. DAVID D. YOUNG REZONE Interim Cit.y Attorney Joe Forrest noted the condition added to Ordinanee No. 1474 N.C.S. adopted 'July 6 could not be enforced by the City of Petaluma. The condition that there be a covenant running with the land executed between a developer and the City of Petaluma to ensure restriction of occupancy of the dwellings to persons 62 years of age and older is not legally permissible under the State Government Code. His recommendation was to leave the ordinance stand as long as the Council was aware that this condition eould not be enforced. He noted, in lieu of that condition, the developer offered to state his intention of restricting the age of residents to persons 62 years of age or older in a letter addressed to the City of Petaluma. STR,EET RESURFACING Gity Engineer Hargis reviewed the alternatives for the PROGRAM 1981 Street Resurfacing Program. It was moved by Councilman Harberson; seconded by Councilman Perry ;~o~ substitute English Street resurfacing for Hawthorne Court, Bantam Way, Grant Avenue, Royal Road and a portion of engineering fabric from No. McDowell. ACTING CITY MANAGER REPO RTS CITY COUNCIL REPORTS ADJOURNMENT Acting City Manager John Scharer noted Redwood Empire Di~ision of the League of California Cities meeting in August will be held in Crescent City. Mayor rtattei noted several members of the Council and Acting Ci.ty Manager John Scharer attended a League of California Cities meeting in Monterey last week.
