INVOCATION PLEDGE OF ALLEGIANCE CLOSED SESSION CONSENT CALENDAR CLAIMS & BILLS RESO ~~ 9090 NCS CONSENT TO COMMON USE AGREEMENT RESO ~~ 9091 NCS MINUTES OF MEETING OF CITY COUNCIL ~ PETALUMA, CALIFORNIA ~ MARCH 16, 1981 ~ Present: Councilmen Perry, harberson, Bond, Battaglia, Balshaw, Cavanagh, Mayor Mattei Rev. Marvin Barbee led the group in prayer. Vice-Mayor Battaglia led the Pledge of Allegiance. Council excused themselves for a closed session. Council returned at 7:10 p.m. Introduced by Councilman Harberson; seconded by Councilman Cavanagh to adopt the following resolutions. AYES: PERRY/HARBERSON/BOND/BATTAGLIA/BALSHAW/CAVANAGH/ MAYOR MATTEI Resolution No. 9090 N.C.S. approving Claims & Bills audited by the City Auditor and approved for payment by the City Manager. Resolution No. 9091 N.G.S. consenting to common use of certain lands owned by the Pacific Gas and Electric Company for installation of a 6" City of Petaluma water main in connection with Petaluma Industrial Park No, 4, Clegg Street and North McDowell Boulevard. End of Consent Calendar * * ~ * ~ * ~ * * * ~ CASA DEL ORO FINAL MAP This matter was continued until such time as the developer has submitted bonding for this subdivision. NECESSITY TO CONDEMN Resolution No. 9092 N.C.S. of necessity to condemn 612 LAUREL STREET certain real property located at 612 Laurel Street RESO 4~ 9092 NCS (A.P. 4~06-71-54). This is the City's legal response to Wentz vs. City of Petaluma (Water Damage Claim). Introduced by Councilman Balshaw; seconded by Councilman Harberson. AYES: PERRY/HARBERSON/BATT9GLIA/BALSHAW/MAYOR MATTEI NOES: BOND/CAVANAGH SENIORS PETITION TO USE Council acknowledged receipt of the Senior Coalition FIRE STATION 2 petition containing approximately 1,000 signatures requesting the use of Fire Station No. 2 for seniors. Council advised the gr.oup that this matter will be considered when Station 2 is no longer needed by the Fire Department. ~ PETAL-UMA NAVY--- Mayor Ma.ttei read-the following guidelines for issuing commissions in the Petaluma Navy: ~ 42~ MARCH 16, 1981 "FLEET ADMIRAL An individual will be eligible to be commissioned by the Ma.yor of the City of Petaluma as "Fleet Admiral" of the City of Petaluma's Navy who has given unselfishly of his time and energy in the support and advancement of the Petaluma River as a viable resource for'the City of Petaluma. An individual who will continue this same devotion in the future when called upon by the Mayor of Petaluma to perform assignments in the development of the river to its proper role in the life of the community. The Fleet Admiral will also carry out other assignments of the Mayor in regards to the Petaluma Navy. This commission will expire upon the appointment of a new Fleet Admiral by the Mayor of Petaluma. "VICE-ADMIRAL . The President of the Petaluma Yacht Club will be commissioned by the Mayor as the "Vice-Admiral" of the Petaluma Navy. This Commission will coincide with his or her terin as President of the Yacht Club. The Vice-Admiral will be the Mayor's official greeter to the visiting Yacht Clubs and will present to the Presidents of these clubs on behalf of the Mayor,, commissions as Rear Admiral in the Petaluma Navy on those occasions where the Mayor has made such appointments, and is unable to personally attend the presentation. "REAR ADMIRAL Persons eligible to be commissioned "Rear Admirals" in the Petaluma Navy by the Mayor of Petaluma will be the following: Individuals who have built commercial developments on the river, thereby enhancirig the River's importance to Petaluma; local citizens who have given support to the River's betterment in one way or another; special visitors to tlie City; and special dign'itaries. The Mayor of the City of Petaluma will have great flexibility in the naming of persons to this position. Attendance by all'Rear Admirals whenever possible, at an Annual Rear Admiral Dinner, if called by the Mayor', is an obligation of this position. The appointment of Rear Admiral is a lifetime honor and there is no set number of Rear Admirals established'for the Petaluma Navy. "Note: There will be: only one Fleet Admiral position in the Petaluma Navy Commissioned Program. ' The purpose of having an annual~dinner meeting will be to review the progress of attaining the goals established for the development of the Petaluma River by the City Council and for the purpose of good fellowship." Robert MacLaughlin was appoin'ted Fleet Admiral, Doug Robinson was appointed Vice-Admiral, and A1 Alys was appointed R'ear Admiral. " The Mayor presented each officer with an appropxiate certificate. PETALUMA RIVER Status report was schedul'ed for discussion March 30th. APPEAL - PETALUMA INN Council considered a letter from Herold Mahoney appealing RESO 4~ 9093 NCS the Planning Commission denial of a variance request to reduce the.Petaluma Inn side yard from the required twenty feet to fi~e feet in order to const'ruct a laundry facility for exclusive use by the motel. Mayos Mattei announced he was an investor in the motel and he would abstain from this discussion. He then 'left the Council table and Vice-Mayor Battaglia chaired this portion of the meeting. Planning Director Freitas reviewed the Planning Commission action and architect Dick Lieb represented the applicant ~in the appeal. Mr. Lieb advised the laundry exhaust vent would be pointed' towards the freeway. Herold Mahoney advised the construction of the laundry room would be such that there would be no noise problem on or,off site. Resolution 9093 N.C.S. uphold'ing the appeal of Herold Mahoney and approving issuance of the variance for the reduced side yard setback. DTSCUSS.ION,PqLICY - Council discussed policy regarding water and sewer ANNEXATION, extension into unineorporated areas with and without ~ ~ annexation. Council consensus was to reaff,irm their position of.Resolution No. 8955 N.G.S, of September, 1980, outlining annexation policy. ~ ~ Council asked staff to schedule a discussion of West Petaluma Study, done by the County, on March 30th. ,.. , , RECESS Counail recessed from 8:30 to 8:40 p.m. GRAY ANNEXATION Resolution No. 9094 N.C.S. making application to the RESO ~~ 9094 NCS Sonoma Loca1 Agency Formaiion Commission requesting _ initiation of annexation proceedings for a reorganization pursuant to fhe District Reorganization Act of 1965. Planning Director Freitas noticed this proposal.was described in a notice sent to property owners in the area and 300 feet outside of the area. Tlie,proposed annexation-(147 acres) ' contains 19 dwellings and 22 registered voters. The proposed Rainier Avenue overcrossing from the east side of the freeway would go through this ar-ea to connect to Petaluma Blvd. North. Planning Director Freitas pointed out where the flood plain crosses this area. Mayor Mattei noted receipt of letters of o:pposition from Mary Bucchanan, Mildred Johnson, James and Francis;Anderson. Schuyler Jeffries, a Santa Rosa architect, .spoke on behalf of~~the applicant. ~ Mr. Winton Baker, a property owner from the area said he preferred no zoning change. Robert Parr, of 21 Payran Street, asked if the annexation would cause additional traffic on Payran Street. Martin Gavriloff noted there is a difference betw.een the current county zoni.ng and the City's General Plan proposed zoning f or this area.. The resolution was introduced by Vice-Mayor Battaglia and seconded by Councilman Perry. AYES: PERRY/HARBERSON/BOND/BATTAGLIAfBALSHAW/CAVANAGH/ MAYOR MATTEI ORDINANCE RELATING TO Ordinance No. 1459 N.C.S. amending Ordinance No. 1373 MIJLTIPL& DWELLINGS/ N.C.S, to provide that certain multiple dwe,llings ALLOTMENT SYS,TEM DATES exempted from the Residential Developmenf Control ORD. ~~1459 NCS System shall have obtained administrative ap.proval of final maps and obtained all permits by September 30, 1981. Introduced by Councilman Bond; seconded by Vice-Mayor Battagl'ia. Assistant City Manager J.ohn Scharer addressed the Gouncil regarding,extending the final date for approvals for these exempt units to September 30th, Council consensus appeared to be this was the last date they would ac.cept final maps for these exempt units for approval. Council heard from Dick Lieb, who requested Council concur with this ordinance. AYES: PERRY/HARBERSON/BOND/BATTAGLIA/BALSHAW/CAVANAGH/ MAYOR MATTEI RECESS The Council recessed from 10:10 to 10:20 p.m.- RESOLUTION AMENDING Resolution No. 9095 N.C,S. amending all residential RESIDENT.IAL DEU,ELOPMENT development control systems in ef,fect pr-ior to the CONTROL SYSTEMS adop.tion of Ordinance No. 1321 to provide c,ondifions' RESO ~~ 909;5 NCS and expiration dates for certain residential allotments issued but not constructed as of the date hereof, and repealing Resolution No. 8879. Introduced by Councilman Harb.erson; seconded by Councilman Bond. This resolution would de£er final Council action to September 30th to coincide with the date established in Ordinance No. 1459. -3- 423 MARCH 16, 1981 CASA GRANDE SOFTBALL Resolution No. 9096 N.C.S. extending time for completion FIELD of contract for Casa Grande Softball Field. Council RESO ~~ 9096 NCS heard from Recreation Director Raymond, William Cohen, Vice President of'Va11ey Crest Landscape, Robert Ruano, architect for the School District, and Steve Goodman, Valley Crest landscape Horticulturist. After a considerable discussion, Council approved the recommendation of the City Attorney that a change order be granted for nine calendar weeks to commence upon an on site determination by_.the_architect that the ground is dry enough to permit work. All claims of further delay because of weather should be left to the evaluation by the architect. It should be made clear to the contractor that further unauthorized delay will be subject to liquidated damages, and may cause the City to declare a breach and call upon the surety to complete. May'or Mattei asked the Council if they wished to reconsider this ordinance. It was moved by Vice-Mayor Battaglia; seconded by Councilman Bond to reconsi'd'er' Ordinance No. 1458 the next time there was a full Council.
