Resolution No. 9,083 N.C.S. summarily vacating and abandoning a portion of 6th Street (New Town) in the City of Petaluma, wliich portion has been superceded by relocation and authorizing the City Manager to negotiate sale or exchange of same to the adjacent property owners and the Gity Clerk to execute the necessary conveyance. This action is being taken in connection with the Casa del Oro Subdivision. Resolution No. 9084.N.C.S. approving the application for 1980 State Grant monies for Lucchesi Park. Resolution No. 9086 N.C.S. authorizing execution of an SERVICES - WASTE agreement for engineering services between the City WATER=PROJECT and Brown and Caldwell for subsequent envifonmental BROWN`& CALDWELL impact report for Petaluma Wastewater project. The RESO ~~ 9086 NCS State Water Resources Control Board has recommended the City prepare this "subsequent environmental impact report" in order to address the ,site specific issues of wastewater reclamation as well as the health aspects ofothe proposed golf course use of wastewater. The scope of services is estimated to be $22,579. The antieipated time.table is: the draft EIR to be completed by Apr-il 23, 1-981, the'45 day circulation period for comments would then end June 8, 1981; the EIR would go to the Planning Commission on June 16, 1981; and the EIR would then go to the City Council on July 20, 1981. ABSENT: BOND ILLEGALLY POSTED Ordinance No. 1458 N.C.S. introduced by Councilman SIGNS - RESPONSIBILITY Bond and seconded by Councilman Perry on February 17 - ORD 4~T`458 NCS an ordinance adding Section 18.04.070 to the Municipal Code to mak.e sponsors of events or owners or lessees of places mentioned in illegally :posted or distributed advertising ma.,tter subject to prosecution for such illegal distribution or posting;, Council heard from Police Ghief Murphy who indicated sgonsors of events in theatres and yard sales are not assuming sufficient responsibility•for greventing the posting of materials on utility poTes and light standards. Current State law requires the police must witness the posting in order to prosecute such persons who place signs illegally. This ordinance was~prepared to remove the requirement to witness the po.sting. BAY PARK environmental documentation had not been completed. PERRY LANE ABANDONMENT This matter was continued from the February 17, 1981 Gouncil meeting, at which time Couneil asked the City Attorney if the City could place conditions on the abandonment of the stree:t. City Attorney Klose advised the Council this is not a recommended procedure. He advised further, the Couneil`s action on the 17th to authorize issuance an encroachment permit to the two proper.ty owners gives everyone more flexibility. Council concurred, and took no further aetion. OUTSIDE SEWER xEQUEST Mr. Matthew Hudson, attorney for Mr. Crowley, requested DENNIS CROWLEY' this be continued fox two weeks. The Council complied with his request, subject to a request from the applicant. -3- 4~~ MARCH 9, 1981 MUNICIPAL SWIMMING POOL Council heard a presentation from staff regarding the ' possibility of building a solar heating sys:tem at the Municipal Swimming Pool. Council asked staff to communicate with the City of Santa Rosa regarding their project, to communicate with the City of Davis and other large communities who have successfully constructed solar heating facilities and to report back. Council consensus was to proceed with the project. JONAS SOUSA SUBDTVISION Staff asked Council for additional direction on this subdivision which is located on Magnolia near Paula Lane. Planning Director Freitas reviewed the,design of the original subdivision which had received fifteen allocations, a tentative map was approved and expired, and when the same map wa5 submitted for renewal it was denied by the City Council':~ Developer Jonas Sousa had a new proposal before the Gouncil to determine whether or not the revisions were what the City wished to have on this location. Cou~cil consensus was to accept the develop.er's application for 15 units for processing through the normal channels. RAINIER OVERCROSSING City Manager Meyer ad~ised the Council that CALTRANS has given conceptual approval to the proposed Rainier ° Interchange. DOWNTQWN PARKING Councilman Cavanagh expressed concern about the__status~~ FEASABILITY STUDY of the Downtown Parking Feasibility Study and expressed ° the desire that there be an opportunity for input from members of the public as well as from the Council prior to the development of any plans for parking improvement. ADDITIONAL COUNCIL Council agreed to meet at 4:00 p.m., March 30, 1981, MEETING for a Work Session. ZONE IIA - T-HOMPSON The City Council heard from the Water Agency staff CREEK/KELLY CREEK representative, Bill Stillman, who advised there is.a hold-up in_acquisition of right-of-way. The project cannot go out to bid until this problem has been resolved. The City Council~ was further ad~ised that this delay is the result of a property owner who wouTd not negotiate transfer of the necessary right-of-way. The Gity Attorney advised that~condemnation could be instituted and possession obtained within approximately 60 days. Moved/Seconded - Vice Mayor Battaglia/Cavanagh, to direct the City Clerk to inform the Board of Supervisors (Aoting as the Water Agency) of this City's desire to expedite•the.project.and the City Couneil's desire that the Board institute proceedirigs for condemnafiion and early possession as soon as possible. AYES: HARBERSON/BALSHAW/CAVANAGH/BATTAGLIA/ MAYOR MATTEI ABSENT: BOND -4- 4~~ ; ~ i ,i _~ MARCH 9, 1981 Mr. Joe White, representative of Valley Oaks Subdivision, also addressed the Council requesting they seek an early settlement of the construction question since a large portion of their subdivision cannot be built until the Thompson Creek flood control project is begun.
