REGULAR MEETING
ROLL CALL 7:00 P.M. Present: Councilmen Perry, Harberson, Bond, Balshaw,
Cavanagh, Vice-Mayor Battaglia
Absent: Mayor Mattei
INVOCATION The prayer was led by Reverend Brad Dack.
PLEDGE OF ALLEGIANCE The Pledge of A1legiance was led by Councilman Harberson.

MINUTES The D~ecember 15 minutes were amended as follows:
Page 3, under Petaluma Marsh Estuarine Study, add,
Principal.Planner, Warr.en Salmons, was directed to
convey the following Council consensus to the B.C.D.C.
representatives at tonights meeting, "Any area shown
in the City of Petaluma General Plan map as ultimate
urban development should be excluded from the proposed
sanctuary."
CONSENT CALENDAR The follo,wing items from the Consent Calendar were
approved by the adoption of a single motion. Introduced
by Councilman Cavanagh, seconded by Gouncilman Perry.

CLAIMS & BILLS Resolution No. 9038 N.C.S. approving Claims and Bills
RESO ~~ 9038 NCS audited by the City Auditor and approved by the City
Manager.
LAFFERTY RANCH LEASE Resolution No. 9039 N.C.S. authorizing an execution of
RESO 4~ 9039 NCS a lease on the Lafferty Ranch with Alfred Bettman, for
a term of four years and eleven months for a total
rent of $11,800.
TRANSEER AGREEMENT ,,
Resolution No. 9040,N.C.S. authorizing execution of an
TRANSIT OPERATORS agreement entitled, "Transfer Agreement Between Transit
RESO ~~ 9040 NCS Operators within Sonoma County" (This agreement was
developed to enable passengers to transfer easily from
one bus operation to another bus operation within the
county).
COMPLETION IRRIGATION Resolution No. 9041 N.C.S. accepting completion of
McNEAR PARK installation of automatic irrigation system in McNear
RESO ~'~ 904:1 NCS Park (Harborth Excavating).
PURCHASE POLICE Resolution No. 9,0.42 N.C.S. awarding bid for seven
VEHICLES police vehicles to PetaLuma Chrysler Plymouth for
RESO 4F 904,2 NCS $56,486.

PERMIT PARKING AREA Adopt Ordinance No. 1452 N.C.S. adding Section 11.44.130
ORD. 4~1452 NCS to the Munic"ipal Code to.regulate parking in off-
street parking lots operated by the City of Petaluma.

1979 FIRE CODE AND Council continued 'consideration of adoption of' this
AMENDMENTS ordinance to Janu'ary 19. Mayor Mattei will appoint a
ORD. ~~1451 NCS committee to meet with interested businessmen and
~ representatives of the Chamber of Commerce prior to
that time. Council heard from Mat.t Hudson,.representating the Ghamber of
Commerce as well as Redwood Oil Company, and from Peter Van ELliott, owner of
Redwood 0i1 Company. Mr. Hudson requested Council alter the ordinanee to
allow the use of (24 hour unat.tended) card lock gas stations. ~
REQUEST FOR OUTSIDE City Manager Meyer reviewed .the request received from
WATER CONNECTION Emil Mogel. There being no representative of this
2300 "D" STREET application iri the audience, Council continued-the
mat:ter until later in the evening. -
UPHOLD USE PERMIT Resolution No. 90'43 N.,C.S. upholding Planning Commission
APP.ROVAL - BURGER KING approvaT of use permit.for Burger King restaurant in
RESO 4~ 90'4"3 NCS Plaza North Shopping Center. Council heard from
Plann'ing Director Freitas who reviewed the application.
He noted there was no drive-through window planned for the project and that
there'was adequate parking 'in `the shop;ping'.center for this fast food use..
Council heard opposition to the use permit fr,om Lisa Heitman, an attorney
repxesenting neighbors and the local McDonalds business. Mr. Dick Meyer, a
partner of J.D. Drockman Associates identified himself as a transpor.t'ation
planner and interpreted an earlier.traffic study to support Ms..Heitman"and
Mr. Meyer. Mr. Bill Sup.inski of. Burger King advised the Council approXimately
2600 square feet of the proposed building.would be an $6 seat sit down restaurant
and Burger King agreed with the proposed-conditions to conduct a d'aily litter
collection program within 3OO feet of the building and to accept cond'ifions of
design appr.oval, Resolution.to deny the appeal and to uphold the Planning
Commission approyal of the use permit was introduced by Councilman Balshaw,
seconded by Councilman Perry.

purchase of a replacement vehicle for the Building
Inspection Department at a cost not to exceed $5,302.12,

City Attorney Klose advised the Council he had reviewed the transaction and
found it acceptable.
FREIGHT OPERATIONS Introduce Ordinance No. 1453 N.C.S. amending Article 13
IN C-H AND M-L ZONES of Ordinance 1072 N.C.S. (The Zoning Ordinance) to add
ORD. ~~1453 NCS Section 13-414 to permit wholesale sales with related
' freight operations, trucking yards, and motor freight
stations, and amending Article 14 of said ordinance by repealing sections with
duplicate numbers, and re-enacting certain sections with correct numeration,
and by adding Section 14-410 to permit wholesale sales with related freight
operations, trucking yards, and motor freight stations. Introduced by Councilman
Perry, seconded by Councilman Harb.erson.

Superintendent of Public Works, Roy Kelly, advised the Council that post and
rable fencing is being constructed to protect the soccer field.
PETALUMA MARSH It was Council consensus to endorse the findings of
ESTUARINE SANCTUARY the Study Committee and to go along with the three
items in Warren Salmons memo.
SETTLEMENT LAWSUIT Resolution No. 9047 N.C.S. authorizing the Mayor or
FRANKfLA POINTE, Ci,ty Manager to execute a,deed for certain parcel of
V. KAISER-AETNA ET AL real.property in settlement of a certain law suit upon
RESO ~~ 9047 NCS compliance of specified conditions (Receipt of the sum
of $15,000). Introduced by Councilman Perry, seconded
by Councilman Bond.

HIGH SCHOOL FIELD discussions regarding development of seven or eight
soccer.fields on vacant school district lands between
Crinella Drive Subdivision and Casa Grande High.School,buildings: Neither the
Board of Direetors of the Petaluma Youth Soccer League nor the School Board
has discussed this formally. It was requested.that a.status reporf~be giveri ~
January 19.
OUTSIDE WATER Council considered the request from Emil Mogel on
CONNECTION REQUEST behalf of Mer.ton Smi.th for an outside water connection
' at 2300 "D" Street. There being no representative{for+ _
this application in the audience, the -Gouncil±-continued
the matter to January 19.
