Representatives of the real estate industry and title companies suggested that Couneil not place the burden of liability on them for policing the ordinance. Council referred the matter back to staff.for further revisions and continued the matter to the Apri1.21 Council meeting. MARINA REPORT Council-heard from Bob McLaughlin and A1 Alys. It was suggested Council not retain Morgan Nobel for a feasibility study until the question of whether or not funding for the channel dredging ' wiTl be available from the Federal,government. ENGTNEER WASTEWATER FACILITY IMPROVEMENTS RESO ~~8829 NCS Wastewater Facilities seconded by Councilma Resolution No. 8`829 N.C.S. authorizing the Mayor or Gity Manager to execute an agreement with Metcalf & Eddy, Inc., for design work in connection with Step II Design Work for the Eastern Marin/Southern Sonoma Plan - Petaluma Portion. Council consensus was to consider this at some later time. PUBLIC HEARING VILLAGE EAST REZONING Adopt Ordinance No. 1409 N.C.S. amending Ordinance No. ORD. ~~1409 NCS 1072 N.C.S., the Zoning Ordinance, by rezoning property on Ely Blvd. South near Juliet from Planned Community Development to Planned Unit Development. (Introduced by Councilman Perry, seconded by Councilman Balshaw on March 3, 1980.) The public hearing was opened. Director of Community Development Freitas and Mike Gallagher of Casa Grande Company addressed the Council.' There being no further testimony the hearing was closed. The City Engineer advised the Council this would increase most construction costs dramatically. Staff was directed to bring a resolution back at the next Council meeting urging the Board of Supervisors not to adopt that plan. CALTRANS PARK/RIDE Resolution No: 8833 N.C.S. authorizing the Mayor or AREA City Manager to execute an agreement with CALTRANS to RESO 4~8833 NCS provide.for a park and ride area to be constructed on State highway lands at U.S. Route ~~101 and State Route ~~116 interchange, in the City of Petaluma. Council eonsensus was to look favorably on a revised ordinance that they asked b,e prepared for consid;eration af the next Council meeting. CounciT also asked for a separate ordinance increasing the fees. MLS'DEVELOEMENT Council considered.a letter from MLS Development Corp- CORPORATION oration, requesting the City reconsider its bonding, requirements for subdivisions. There was no repre- sentative of the development corporation at the Council meeting. Council consider,ed, the City Attorney's opinion against waiving bonds as they are required by the~St°ate Subdivision Map Act. No action was taken. ~ JONAS SOUSA TENTATIVE This item'was con.tinued to April 21, at the request of SUBDIVISION MAP Jonas Sousa, and his attorney, who had a scheduling~ conflict and could not attend the meeting.
