REGULAR MEETING
ROLL CALL 7 P.M.
Present: Councilmen Balshaw, Battaglia, Vice-Mayor Bond,
Cavanagh, Harberson*, Perry, Mayor Mattei
* Councilman Harberson arrived at 8:40 p.m.
INVOCATION The prayer was led by Rev. Godfrey Hartzell.
PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Councilman Perry.
MINUTES The February 11 Minutes were approved as submitted.
The February 19 Minutes were corrected on page 3, at
the end of Ordinance No. 1393 N.C.S., indicate the
vote was on adoption of ttie ordinance. After the
vote, add the sentence, "Gouncil consensus was they
would look with favor at two dwelling units being
constructed on the 620 Baker Street lot."

APPEAL - BY G. CORT City Attorney Klose summarized his March 3 recommendation
VARIANCE ISSUED to the City Council wherein he concluded that because
FOR 826 "D" STREET of a failure to give notice as required by the United
States Constitution as it affects the property rights
of others, the Use Permit as presently issued.is invalid and should be re-
heard by the P'lanning Commission: He recommended action be suspended on the
matter of the appeal from the ~arianee until such time as the Use Permi"t
matter is finally heard and determined at the Elanning Co.mmission level.
Legal counsel for Mrs. Cort, the appellant, expressed his understanding of the
City Attorney's'recommendation. Mr. Kosewic, whose project is subjecfi of the
appeal, also expressed his understanding that this ma`tter will be referred to
the Planning Commission for corisideration of the Use Permit and then returned
to the Council for a determination on the variance appeal. Councilman Balshaw
asked the City Attorney about.the validity of the Use Eermits that have been
issued since the Supreme Court ruling Ju1y, 1979, that aff ects the notification
to property owners on Use Eermit issuanees.. It was understood that no fees
would be charged for re-consideration of the Use Permit.

TRAFFIC SIGNAL Resolution No. 8808 N.C.S. indicating willingness of
E. WASHINGTON/ the City of.Pexaluma to participate in State Highway
HIGHWAY 4~101 SOUTH Signalization project - East Washington St,reet and
RESO'~~8'808 NCS U.S. Highway ~~101 South. City Manager Meyer brought
the Council,up to date on the history of the driveway
exit from Kenilworth Junior High School, noting the road in front of the swim
center was built by, the School~ District~for the pu'r.pose"of correcting the
problem of left turn movements from Kenilworth onto East Washington Street.
It was noted that this will be closed, and entry to the Junior High School
will be at a point opposite E11is Street. Concern was expressed by the Council
about the lack of protected automobile turning space for parents delivering
their children to school by way of the Ellis entrance.
~' - City Engineer Hargis reviewed sites in the City places
where signals are warranted and Council has app"roued expenditures of the
required sum. He said Ellis and East Washington S'treet do not warrant signals
according to State of.California guidel_ines. They, ther-efore, would not ..
participate with this City in the cost of their installation.
Council inserted a condifiion in the resolution which
would cause the parficipation agreement to lapse if the proposed signals are
not built in the 1980/81 budget year. The resolution was introduced by Councilman
Battaglia, seconded by Councilman Perry.

STATUS REPORT Couneilman Harberson arrived at 8.:40 p.m. Gity Manager
MULTI=FAMILY UNITS/ Meyer-re~iewed the pr.ojected_condominium and single-
CONDOMINIUM family unit count prepared by the Planning:staff. I:t
APPLICATIONS . appears fhat we can anticipate.406 condominium deve,lop-
. ments construeted in 1980, as well as 383 single-
family units construct.ed in the same year. Af-ter`reviewing the projected
units to be constructed in the next couple of years, City Manag~er Meyer asked
the Gouncil if they would advise staff at the March 17 meeting whether or not
they wish to continue with the Residential D'e~elopment Control Syst:em as it
now exists wi_th applications for allotments being received until a May 1
deadlirie, or if Council wishes to make modifications~to the regulations for
the ensuing construction year.
Councilman Battaglia asked staf.f when the flow chart
on projects going through the Residential Development Control System would be
ready for Council to see.

NATIONAL FIRE City Manager Meyer noted that Fire Chief~Robert Sharps
ACADEMY was selected as the~only Chief in northern California
to attend the second National Fire Academy, near
Baltimore, Maryland.
AIRPORT COMMITTEE Council reviewed a letter directed to the Metropolitan
REPORT Tr•ansportation Commission regarding preliminary regional
Transportation Improvement Projects, recommendations
for aeronautics element for the 1980-81 fiscal year. Council approved the
report and noted staff and Vice-Mayor Bond will be attending an M.T.C. meeting
on this on March 5.
SMOKE ALARMS ~Council requested that staff prepare an ordinance
requiring that smoke alarms be installed in all
residences that are re-sold in the City of Petaluma.
ZONE 2A REPORT ~- Gouncilman Cavanagh reported a meeting was held by
Zone 2A, and Thompson Creek drainage correction has
been scheduled,for late summer, 1980. It was noted the City of Petaluma had
offered to participate in the engineering of some of the local projects in
order to relieve County staff and to implement construction at an early time.
