Councilman Balshaw noted that it would be the duty of the Recreation Gommission as the coordinator of such a project and that changes would have to be made.on.the Environmental-Design Plan and General Plan to indicate .where such sites might be so that the City may begin planning for futu~re land acquisition using portions of park development fees that are currently being coLlected on new subdivisions. The "' City Attorney advised the Couneil that legal counsel for Mrs. Cort had agreed to this continuance. REZONE BLOCK BOUNDED Ordinance No. 1393 N.C.S. amending Zoning Ordinance No. ' BY TUNZI, UPHAM, 1072 N.C.S. by reclassifying and rezoning Assessor's B9KER AND BODEGA Parcels Nos. 006-320-06, 07, 12, 13, 16, 17, 19, 20, ORD. ~~1393 NCS 22, 24, 25, 27, 28, 29, 30, 31, 34 and 35 (portion of block bounded by Bodega Avenue, Tunzi Parkway, Upham and Baker Streets) from R-C, Compact Residential, to R-1-6,500, Si•ngle Family Residential. Continued from January 7, 1980, meeting. Planning Director Freitas reviewed the-mat.ter for the~Council and reported it is possible to create two lots if the R-1-6,500 zoning request is approved. The following variances would be .required: below minimum square footage, below minimum lot depth, below minimum lot width of the lot fron:ting on Baker Street, below minimum width of access drive to the very rear lot, and a possible need for setback variances becaus:e the lots would be substantially undersized. The Council continued the hearing. Mr. Warren White, eo-owner of the property, addressed the Council. He noted that rezoning this block to R-1-6,500 would make nearly the entire block one of substandard lots. The City Clerk read a letter from William J. Fannin, who has an option on property at 519 Upham Street, which parcel is con,tiguous to the 620 Baker Street parcel. He expressed support of the Single Family Residential zoning. Prior to taking the vote, Councilmen Harberson and' Balshaw asked legal opinion if they could~ partic.ipate in the decision since they had been absent at the meeting when the matter was first discussed. City Attorney Klose advised Council that there had been sufficient review of the matter at this meeting that would allow these Councilmen to vote on the ordinance... Councilmari.Perry asked,~legal; advice whether or not he had a conflict of interest..in voting.on this,matter since he owns property across the street from the sub.ject rezoning. Legal counsel advised Councilman Perry's property would not be af'fected any more than any other property in town and he would, therefore, be able to vote on the ordinance. City Manager suggested the Gi,ty could contract for a survey of the area prior to annexation with that cost being shared equally by the property owners. Resolution No. 8794 N.C.S. denying the application of James R. and Patricia C. Gilmore for one outside water service and one outside sewer service connection at 725 Paula Lane without prejudice. Council noted receipt o:f a Tetter from the Chamber of Commerce.urging suppor.t of _the feasibility study. The City Manager advi`sed the Council that if ~the.feasibility study is positive, there will be some financial.requirements to look at some time down the line. ISI will continue to provide the grant writing service until $190,000 in revenue or grants in at least ten times the amount of the fee are approved, with the exception of any wastewater treatment grants or California Park Bond grants. This study is now in the environmental review phase. The County has been requested to furnish copies of the study for the Petaluma City Council. AMBULANCE RATES Resolution No. 8800 N.C.S. establishing a special RESO ~~8800 NCS ambulance rate for movement of patients from Hillcrest 1980. This trip, fee. As an alternative, he suggested sending mail with a Certificate of Mailing fee of $.15 per piece of mail.
