Mayor Mattei read a proclamation naming February 3-9 Boy Scout Week. Mayor called attention to the Boy Scout City Council meeting that will occur on Wednesday afternoon in honor of Boy Scout Week. Members of local Boy Scout troops will sit at a brief,.afternoon Council meeting as.Councilmen and Boy Scout "staff inembers" will be•their advisors. PLEDGE OF ALLEGIANCE ~ Scout'Kenny McCoy led the Pledge of Allegiance. MINUTES The January 21 ininutes were amended by Vice-Mayor Bond _ to include the following notation"~on page 4, at the bottom of the page and page 5'top of page, an asterisk after Councilman Bond.',s name on the'"No" .yotes, then add, "*Vice-Mayor Bond.'s "no" votes reflected his objection to the projected street patterns of the P.U.D.". JThe January 28 minutes were approved as submitted. CONSENT CALENDAR The following items from the Consent Calendar were enacted by one motion which was introduced by Councilman Perry, seconded by Councilman Balshaw. MAINTENANCE STATE Resolution No. 8779 N.C.S. authorizing execution of HIGHWAYS agreement for maintenance of State highways in the City RESO ~~8779 NCS of Petaluma. OUTSIDE WATER Resolution No. 8780 N.C.S. authorizing execution of an CONNECTION agreement with Lewis L. and Carla L. Johnson, relative 210D 'D' STREET to outside private water service at 2100 'D' Street RESO 4~8780 NCS Extension. Introduced by Vice-Mayor Bond, seconded by Councilman Perry. City Clerk Bernard read letters of application from Ed Mannion and Don Bennett for this position. The result of Council vote on selection was: Ed Mannion - Bond, Cavanagh, Perry, Mayor Mattei; Don Bennett - Balshaw. The vacancy occurred as a result of the following events: the President of the Historic Library Museum Committee resigned (Stanley Della Maggiora). The Council-appointed Historic Library Museum Committee member, Lewis Baer, was elected President to replace Stanley Della Maggiora, thereby assuming the Presidential membership seat on that ~ Committee and leaving the Council appointee opening. RESO ~~8784 NCS. Introduced by Councilman Balshaw, seconded by Councilman ' Perry. Planning Director,Freitas described.the proposed lot split which is located in fhe Thompson Creek Drainage Basin. The proposed lot split would conform to the City's General Plan Land Use Designation of 2 units per acre. Staff has offered no adverse comments to the proposal, with the exception of the moratorium on building permits in the Thompson Creek. Drainage Basin, upstream from Sunnyslope Avenue, until such time as construction _- is commenced upon the improvements planned by the Sonoma County Water Agency F1ood.Control Zone 2A. Council.consensus.was to allow the application to = proceed as soon as construction;has,commenced on the.,Flood Control project and the standard conditions of curb and gutter be included in the resolution. Resolution No. 8785,N.C.S. approving a revised approved STREET TREE LIST tree list as recommended by,the Recreation, Music and RESO ~~8785 NCS Pa•rks_Commission. Rublie Works Superintendent Kelly addressed the.Council regarding a Group III Classifica- tion of acceptable trees for planting, in tlie Central Business District. There was some change from the suggesteditree list as proposed by the Project Area Committee of the Petaluma Community.Development Commission; however, Public Works Superintendent Kelly se~lected trees for this third grouping on the basis of the maintenance that would'be required in the near and distant fnture on these.trees. This was continued to~a future'meeting. P.G. & E,. HIGH VOLTAGE Pacific Gas and Eleetric proposed high tension line. LINE - LAKEVILLE ' Planriirig Dir.ector Freitas reviewed the proposal by SOBRANES P.G. & E. that it exiend a second high-tension line~ ' + from the Frates/Adobe Sutistation south to Highway'~~37. Council consensuS was, if af all possible, the route for the new high-tension lines should stay away from the s'cenic corridors and be as hidden as possible. NOTICE, HEARINGS & City Manager Meyer, along with City Attorney Klose PUBLIGATION REQUIRE- reviewed Mr, Klose's letter to the Manager outlining MENTS ' present noticirig practiees and suggesting alternative ~ me:thods~of noticing in future actions. Counril reached ' the following consenses: Notifi'catiorn on'Rezoning: 'to have the hearing at tlie Planning Commission level with mail notification going to property owners witliin 3'00 feet of t_he borders of~the property subjeet of the reioning, plus,publicat'ion of the intent .to rezone. City Council would act on Planning Gommission's record when:adop:ting rezonings. ~These procedures will be followed for rezoning particular properties. General Pian Amendments: the General Plan and rezoning chariges will be fieard at the~same meefing hereafter. Amendmeni's'to Elemenfs of the General Plan, such as Housing and Seismic Elements would be noticed in the paper only. Tentative`Maps and Parcel Maps: the hearing will be held at the Planning Commissiori and the~matter wi11' be considered on'the record before the.City Council. For fhe Planning'Commission hearing, mail notice will be sent to' property owners~within 300 feet of the properfy in question. Use Permits: These will continue to be heard by t:he Planning Commission and Variancesc mail notice will be sent to property owners within 3'00'feet of the property. Zoning Ordinance Amendments: The City Council shall be able to p:rouide for an amendment to zoning proposaTs witfiout referring same back to the P`lanning Commission. ~ -3- FEBRUARY 4, 1980 W PUBLIC HEARINGS - 8:35 p.m. ~ FLOODWAY ORDINANCE Ordinance No. 1402 N.C.S. amending Ordinance No. 1072 ORD. ~~1402 NCS N.C.S.; the Zoning Ordinance, by repealing and re- enacting Article 16 thereof and by adding Section 26- 303.5 thereto to regulate the use of the Petaluma River Floodway and Flood Plain and enacting conforming amendments to Section 1-200 and 26-407 thereof and declaring its urgency to take effect immediately. Introduced by Councilman Balshaw, seconded by Vice-Mayor Bond. The hearing~was opened. Council went over recommended changes to the ordinance, accep'ted some and asked staff to come back with a report on the others at the first meeting in April. The hearing was closed. AMENDMENT Planning Director Freitas reviewed the amount of C-0 NORTH McDOWELL zoning available in the City. The hearing was opened. RESO ~~8786 NCS Lucy Webb, representing Mr. Gray, owner, voiced no objection. The tiearing:was-closed. Resolution No. 8786 N.C.S. adopting an amendment to the Environmental Design Plan Element (EDP) of the General Plan on property located on the west side of North McDowell Blvd., across from Park Place Subdivision and Petaluma Valley Hospital (switch- ing existing Commercial Office from northerly half to southerly half and placing the northerly half into Speeial Study Area-3). Introduced by Councilman Perry, seconded by Vice-Mayor Bond. , AYES: BALSHAW/BOND/CAVANAGH/PERRY/MAYOR.MATTEI ABSENT; BATTAGLIA/HARBERSON Staff advised Council there will be an ordinance coming before the Council shortly to rezone this property to conform to this EDP amendment. REZONING LAKEVILLE Ordinance No. 1399 N.C.S. amending Zoning Ordinance No. AND "D" STREET 1072 N.C.S. reclassifying and rezoning Assessor Parcels ORD. 4~1399 NCS 007-153-06, 08, 09, 10, and 13, from Light Industrial to Highway Commercial (located at southwest corner of East "D" and Lakeville.Streets). The hearing was opened. Planning Director Freitas and City Engineer Hargis addressed the Council. The hearing was closed.
