City':Manager Meyer, City Attorney Klose, and Elanning D'i'rector Freitas addressed the Counail regarding the,proposed fee c~hanges wtiich reflect costs to the City for various planning develqpment applicatioris. A fee.fo:r use permit notification has been added to the fee schedule to include the costs incurr.ed by the application for~a use permit including legal notices and mailings to property owriers with_in 300 feet of the .subject.proposed use. The rest of fihe addifional fees relate the the computer-assisted Environmental Impact Re~iewing system. There was discussion regarding sending cer'tified mail to property owners within 300 feet on zoning ehanges, use permi:ts„ and variances. It was Council consensus that these ma~il:ings go out with a return receipt requested. Introduced by Gouncilman,'Perry, seconded by Councilman Balshaw. City Manager Meyer exp'lained the State proposal £or signali- zation at that intersection. The State will bear the cost of road.work, signing, -2- 259: JANUARY 21, 1980 striping, and traffic control costs. The electrical work for the signals will be shared equally based on the four legs of the intersection (City - Lakeville Street; private parties - businesses at 1010 Lakeville Street; State - 2 legs covering Highway 116. The estimated total cost for the project is about $115,000.00. This resolution establishes the City's intent to fund the private _ portion of the signalization upon receipt of a valid agreement with the affected property owners to reimburse the City for the private share of the project. (7:53 p.m.) AMENDMENT 4~4 TO RUSSIAN RIVER - COTATI INTERTIE WATER PROJECT RESO ~~8771 NCS Resolution No. 8771 N.C.S. approving amendment 4~4 to the agreement for water supply and construction of the Russian River-Co:tati Intertie project and authorizing the Mayor or City Manager to execute the amendment. Introduced by Councilman Battaglia, seconded by Councilman Cavanagh. City Manager Meyer noted the next_step in the nrocedure ~*ould~be for the applicant to apply for annexation and to file the proposed outline for zoning and use with the Planning Commission. The applicant was no't in the audience at the time this was discussed. Staff was directed to have another conversation with the applicants outlining the problems facing them with their proposed development and advising them that any further discussion with the City would be at their additional request; and_ the applicant was asked to be present should this be scheduled for consideration by the Council again. This resolution is a follow-up of Resolution No. 8758 N.C.S. adopted January 7, 1980, and relates to the portion of the pr-oject funded locally. It specifically refers to Rainier overcrossing and widening of Lakeville between Caulfield and Frates Road. I.t was noted the City`s application.for.f;unds had,been rejeeted,.in the past because Sonoma County did not have a five-year improvement plan for ayiation.projects. This is the first step towards obtaining Federal and State funds for airport improvement. Mr. Lieb, noted his cli,ents' pref.erenee is not. to have a connection of this parallel street to their property. It was the.intent o-f th'e Cit-y Counc"il tliat'it will give very strong consideration for'the para11e1 road to eontinue into the C-0 zone area (MeDowell Medical Properties) when the planning p:rocess continues on this property after its annexa'tion. After a great deal of discus"sion regard'ing cireulation within these pr'operties, the hearing was closed and` a vote'was taken to adopt both ordinances. Intro- duced by Councilman Battaglia, seconded by Councilman Balshaw. AYES: BALSHAW/BATTAGLIA/CAVANAGH/HARBERSON/PERRY/ MAYOR MATTEI N0: BOND 10:30 p.m, to 10:35 p.m. Co.uncilman Harberson left during the recess. MARINA Mr. A1 Alys, Chairman of the Harbor Advisory Committee, presented the Committee's report to the C'ity Council. It was the Committee's recommendation that the City apply to the State Boating and Waterways Department.for a planning loan for the Marina. Assistant City Manager Scharer noted the Army Corps of Engineers will be meeting with H.K.S., fheir consultants for the Marina feasibility study, on January 23 and Mr. Scharer has scheduled a meeting with the Army Corps of Engineers at City Hall at 9:30 a.m. on January 24. Council was advised that this is the time to,make additions or revisions to the H.K.S. draft of the feasibility study. If the Marina project is to continue, it was,suggested that Mr. Morgan Nobel, from Dames & Moore, be retained as outside staff support,for,this additional study to proceed. He reported that it appears the maximum expenditure on the part of the City would be $82,000.00, plus s;taff and consultant time. The steps the City would take at this time in order to continue working towards the Marina would be for the City Council to make a commitment that it would be willing to ~~ give up some of Schollenberger Park_area for the project. City Gouncil should; authorize staff to proceed to apply for a planning loan from the State Boating ~ and Waterways Department. The City should address its concern to the Army Corps of Engineers and ask them to p:roceed with.this alternative. Staff was asked to report back to the.Gouneil on the costs of proceeding with the committee's recommendations.
