HomeMy WebLinkAboutResolution 2015-024 N.C.S. 03/02/2015Resolution No. 2015-024 N.C.S. of the City of Petaluma, California AUTHORIZING THE CITY MANAGER TO IMPLEMENT AN ENVIRONMENTALLY PREFERABLE PURCHASING PROGRAM WHEREAS, in May, 2008, the City Council adopted the Implementation Plan and Mitigation Monitoring Program for the City of Petaluma General Plan 2025, and item #4-P-32 of the plan called for the City Council to develop and implement a Municipal Environmentally Preferable Purchasing Program within the first five years; and WHEREAS, the City of Petaluma desires to institute practices that reduce waste by increasing product efficiency and effectiveness; and WHEREAS, the City of Petaluma desires to purchase products that minimize environmental impacts, toxics, pollution, and hazards to workers and community safety; and WHEREAS, the City of Petaluma desires to purchase products that reduce greenhouse gas emissions in their production, shipping, use and discard: and WHEREAS, the City of Petaluma desires to purchase products that include recycled content, are durable and long-lasting, conserve energy and water, use agricultural fibers and residues, use unbleached or chlorine free manufacturing processes, are lead-free and mercury - free, and use wood from sustainably harvested forests and; WHEREAS, Section 15308 of title 14 of the California Code of Regulations (part of the California Enviromuental Quality Act or CEQA Guidelines) provides that actions taken by regulatory agencies as authorized by state or local ordinance to assure the maintenance restoration, enhancement, or protection of the environment where the regulatory process involves procedures for protection of the environment are exempt from CEQA requirements; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Petaluma, as follows: Resolution No. 2015-024 N.C.S. Page I 1. The City of Petaluma recognizes the significance of establishing an Environmentally Preferable Purchasing Program to protect human health and environmental well-being by reducing the procurement of goods and services that result in larger volumes of waste and pollutants. 2. Adoption and implementation of an Environmentally Preferable Purchasing Program by the City of Petaluma is an action authorized by state or local ordinance to assure protection of the environment and is therefore exempt from CEQA requirements in accordance with Section 15308 of title 14 of the CEQA Guidelines. 3. Adoption and implementation of an Environmentally Preferable Purchasing Program is prescribed by item 44-P-32 of the Implementation Plan and Mitigation Monitoring Program for the City of Petaluma General Plan 3025. 4. Subject to applicable requirements of the Petaluma City Charter and the City's purchasing ordinance codified in Chapter 4.04 of the Petaluma Municipal Code, and other applicable law, the City Council hereby adopts and the City Manager is authorized and directed to implement an Environmentally Preferable Purchasing Program in accordance with Exhibit A. attached, entitled "City of Petaluma Environmentally Preferred Purchasing Program." 5. Pertinent provisions of the attached Environmentally Preferred Purchasing Program and/or appropriate successor provisions shall be incorporated in future updates to the Purchasing chapter in the Petaluma Municipal Code.
