HomeMy WebLinkAboutHistoric-Cultural Preservation Resolution 2010-02 08/25/2010 RESOLUTION NO. 2010-02 CITY OF PETALUMA HISTORIC AND CULTURAL PRESERVATION COMMITTEE APPROVING AN ELEVATED FOUNDATION PURSUANT TO THE DEMOLITION POLICY AND IMPLEMENTING ZONING ORDINANCE FOR 230 EDITH STREET ASSESSOR'S PARCEL NO. 007-061-016 File No. 10-SPC-0263 WHEREAS, Charles Hildebrand, property owner, has submitted a request for Historic and Cultural Preservation Committee approval to allow a single family house to be raised approximately 32 inches in order to create habitable space consistent with Building Code requirements on the ground floor, (the "project") on real property located at 230 Edith Street, Assessor's Parcel No. 007-061-016 (the "subject property"); and, WHEREAS, the existing house located at 230 Edith Street was constructed circa 1890; and, WHEREAS, the scope of the project falls within the definition of demolition found within the Implementing Zoning Ordinance and within adopted City Council Resolution 2005-198 N.C.S. (Demolition Policy); and, WHEREAS, the Historic Resources Report prepared by Diana Painter of Painter Preservation and Planning on May 6, 2008 indicates that the house at 230 Edith Street is a significant historic resource under Criteria 1 in that it embodies the evolution of housing styles for East Petaluma's workers and Criteria 3 in that it is an unusual example of a house that grew with the family and adapted to the architectural styles popular at the time. Ms. Painter further maintains that the building retains integrity of location, design, materials, workmanship, feeling, and association: and, WHEREAS, the project was reviewed pursuant to CEQA guidelines and determined to be categorically exempt pursuant to Sections 15303 (New Construction and Conversion of Small Structures) and 15331 (Historic Resources Rehabilitation); and, WHEREAS, Site Plan and Architectural Review (Demolition) of the Project was conducted by the Historic and Cultural Preservation Committee at a duly noticed public hearing on August HCPC Resolution No.2010-02 Page 1 24, 2010 in accordance with the City of Petaluma Implementing Zoning Ordinance, Section 24.010, NOW THEREFORE, BE IT RESOLVED that the Historic and Cultural Preservation Committee hereby approves the Site Plan and Architectural Review (Demolition) for the project and authorizes raising the existing building approximately 32 inches as shown in the plans date stamped June 16, 2010, based on the findings made below and subject to conditions of approval attached as Exhibit A hereto and incorporated herein by reference: 1. The existing building is found to be a significant historic resource under Criteria 1 in that it embodies the evolution of housing styles for East Petaluma's workers and Criteria 3 in that it is an unusual example of a house that grew with the family and adapted to the architectural styles popular at the time. The building retains integrity of location, design, materials, workmanship, feeling, and association and contributes architectural, visual, and cultural features that are important in preserving the character of the existing neighborhood. 2, The proposed project is consistent with the Secretary of the Interior's Standards in that it maintains the historic residential use of the house, the historic character of the house is maintained and its relationship to the site and larger neighborhood are preserved, distinct details, materials, and features are preserved, and the exterior alterations are compatible with the existing character of the resource, 3, The required findings for approval of a demolition application pursuant to the Council policy do not differentiate between destruction and removal of a building and raising the building, or between raising a building to add a full story and slightly modifying an existing understory. 4, In this case; raising the building meets the Secretary of the Interior's Standards and does not threaten the integrity of the building, destroy character defining features of the building, or negatively impact the historic resource. 5. In this case, approval of the project application consistent with the plans date stamped June 16, 2010, subject to the Conditions of Approval herein, is not a type of "demolition" which will be detrimental to the aesthetic or economic vitality of the community. Edith Street APN 007-061-016 C'ity File Number: 10-SPC-0263 1. Approval is granted by the Historic and Cultural Preservation Committee to raise the single- family residence located at 230 Edith Street and constructed circa 1890 in order to provide habitable space on the gound floor consistent with the requirements of the Building Code. 2. This approval allows the residence to be raised in order to allow the ground floor to be converted to an accessory dwelling unit as described in the project description submitted to the Planning Division and date stamped June 16, 2010, and contingent upon satisfaction of all standards for accessory dwellings contained in Section 7.030 of the Implementing Zoning Ordinance. 3. Any deviation from the project plans described in Condition 4 hereof and approved by the Historic and Cultural Preservation Committee shall require further Historic and Cultural Preservation Committee review and approval. This approval shall not include destruction or removal of the existing building. 4. The plans submitted for building permit review shall be in substantial compliance with the plans date stamped June 16, 2010, with the following revisions: a. New windows on the lower level shall be sized to match width of existing doubie hung windows on the building; b. Minimize the introduction of new doors on the lower level; and c. Encourage the use of wood windows. 5. Plans submitted for building permit shall comply with all applicable Zoning Ordinance requirements, including requirements for establishment of accessory dwelling units. 6. Construction hours are limited to 8:00 a.m. to 5:00 p.m. Monday through Friday and Saturday from 9:00 a.m. to 5:00 p.m. Construction is prohibited on Sundays and all holidays observed by the City of Petaluma. 7. Plans submitted for building permit shall include these conditions of approval as notes on the first sheet of the building permit plans. HCPC Resolufion No. 2010-02 Page 4 8. The applicant shall defend, indemnify, and hold harmless the City or any of its boards, commissions, agents, officers, and employees from any claim, action or proceeding against the City, its boards, commission, agents, officers, or employees to attack, set aside, void, or annul, the approval of the project when such claim or action is brought within the time period provided for in applicable State and/or local statutes. The City shall promptly notify the applicants of any such claim, action, or proceeding. The City shall coordinate in the defense. Nothing contained in this condition shall prohibit the City from participating in a defense of any claim, action, or proceeding if the City bears its own attorney's fees and costs, and the City defends the action in good faith. 9. The project shall be subject to payrnent of all applicable development impact fees and water and wastewater capacity fees. Said fees are due at time of issuance of certificate of occupancy, or at such other time as specified in the City legislation and/or regulations pertaining to each said fee or charge. At the time of issuance of building permits, pertinent fees other than development impact fees and/or water and wastewater capacity fees may be applicable to the proposed project pursuant to City ordinance or regulation and will be required and payable to the extent they are applicable.
