Due to the location of the pipe, under Adobe Creek, a decision to replace the,pipe immediately under an emergency contract was determined to be,the most environmentally sound.action. Reduction of flow in the creek. or the below surface groundwater could have resulted `iri a flow of untreated wastewater out of the corroded pipe. On August 2, 2010 City Council adopted Resolution No. 2010-143 N.C.S. ratifying the contract with Team Ghilotti, Inc. (TGI) for the Adobe Creek Emergency Sewer Repair project, . authorizing the inclusion ofthe necessarybudget adjustment in the 1st Quarterly Budget ' Adjustment Ordinance and approving the project budget. ~„ TGI commenced work to, replace`the existing sewer main using apipe-bursting operation as this was the least intrusive option, not involving in-creek work. T,he pipe bursting technique was not successful because the, existing 6"pipe was encased in concrete, with mechanical. joints. that withstood the~bursting; equipment's force. TGI's crews then installed the new 6" main by conuenfonal methods. This option required diverting creek flows with a temporary dam structure°and pipe. to allow excavation and replacement. During all phases of construction, City staff communicated the progress and issues with the RWQCB, DF&G and SCWA. Revegetation of the area affected by the work will be done in October 2010 per direction of SWCA and DF&G permit conditions. Prior to construction, City staff notified the neighborhood of the emergency sewer work. A second letter was sent at completion of the project informing the neighborhood that the heavy construction was complete and that revegetation would occur in October under the direction of the various jurisdictional agencies. Construction was successfizlly completed on August 3, 2010. I)ISCiTSSI®N Following the acceptance of the project, the City Clerk. will file a Notice of Completion with the Sonoma County Recorder and the Finance Department will release the retention money to the contractor within 60 days of completion of the work in accordance with applicable law. FINANCIAI. IMPACTS The Adobe Creek Emergency Sewer.Main Repair Project Number 066401105 was approved with a budget of $155,000. A budget adjustment to transfer funds from the Pond Influent Pump Station Grinder Acquisition and Installation Project (0664011.02) will be included in the 1St Quarter Budget Adjustment Ordinance. The final.. contract cost is $125,584.38. The current account balance in Grinder Project (066401102) is $843,000. ATTACHMENTS Resolution 2. Location Map 2 ~, Attachment 1 ~~ i'~ ~,~ ;,,~., y E CREEK E1VIE P'I'IN,G COIVIPI:ETION OJF THE „~ ~ ~~ ,~ ~~ R~ ,, AI)O RGENCY SEWER.MAIN REPAIR ~' ~~ °.~~~~' ~~ ~~' :' ~ ~ ~ ~ PROJECT N><T1VI~ER 066401105 WHEREAS, Article X, .Section. 6.8 of the City of Petaluma Charter provides that repair of all public buildings and works requiring. expenditures specified in the section must be awarded to the lowest responsible bidder pursuant to procedures established by ordinance adopted by the City Council; and WHEREAS, a 6-inch sewer main running from Rancho Bonito Drive and Casa Verde Circle, beneath Adobe Creek had. experienced severe groundwater infiltration that posed a clear and imminent danger, requiring immediate action to prevent or mitigate the loss or impairment of an essential public service, and qualifies as an "Emergency" under Section 1102 of the Public Contract Code; and WHEREAS, Section 4:04.050 of the Petaluma Municipal Code provides that the bidding procedures set forth in Sections 4.04.080 through 4.01.100 ofthe Code in accordance with the City charter maybe dispensed with when an emergency requires that an order be placed with the nearest .available source of Supply; and WHEREAS, City staff negotiated. a time and materials contract with Team Ghilotti, Inc., of Petaluma, CA to replace the sewer main under Adobe Creek; 'and WHEREAS, by Resolution No. 2010-143 N.C.S. adopted August 2, 2010, the City Council of the City of Petaluma authorized the City Manager and/or his designee to execute on behalf of the City of Petaluma a time and materials construction agreement. with Team Ghilotti, Inc. for the Adobe Creek Emergency Sewer Main Repair for a not to exceed amount of $155,000 for the performance of the emergency repair of the Adobe Creek Sewer Main; and WHEREAS, Daily Extra Work Reports for time and materials to complete the project were submitted by Team Ghilotti, Inc: and reviewed and approved by City staff; and WHEREAS, the fmal contract amount is $125,584.38; and WHEREAS, City staff.has inspected the Project and determined that it has been completed in accordance with the contract requirements subject to the Contractor's continuing warranty and other obligations pursuant to the contract; and WHEREAS, based on the foregoing, staff recommends acceptance of the Project on behalf of the .City; ~~ ~ ~ '~ q a ii a .. ~ I, ~ .. ` ~ , . ~ ~ y y ~ ~ fthe City of Petaluma' as , ~ ,,,a ,' , ~ ~, , ~N®W; ~T>EI>EREF®R>En BE :IT itESOLyEi- ;b the Ct Council. o follows. 1.
