Inc. RECOMMENDATION It is recommended that the City Council adopt the attached resolution approving the project budget and authorizing award of contract for the East Washington Street Pedestrian Crossing Project. BACKGROUND The East Washington Street Pedestrian Crossing Project will close a gap in the Petaluma Ring Trail (near Sky Ranch Road), where users of the trail system have had to traverse three lanes of 40 mile per hour traffic in order to cross East Washington Street. The project will install a high visibility overhead warning system, new signs, a pedestrian corral and street lighting; all of which are designed to work together to increase the safety of pedestrians and bicyclists. By design,.these improvements will also encourage others to walk and bike to school, shopping, work, and recreational activities. In 2008, the City of Petaluma was awarded $509,310 of Cycle 2 Federal Highway Safety Improvement Program (HSIP) grant funding for the East Washington Street Pedestrian Crossing Project. A consultant prepared the bid documents, and on July 8, 2010, the City received federal authorization to advertise the project for bids. A Notice Inviting Bids was issued on July 22, 2p l 0, and three bids were received on August 18,2010, as follows: . Name of Bidder Business Location Total Bid Ghilotti Bros., Inc. This contractor has satisfactorily performed similar projects for other municipal agencies. Staff verified that Ghilotti Agenda,Review, _ .: ~ ~. City Attorney. Finance Director City Manager Bros., Inc. possesses a valid Class A contractor's license No. 132128, which qualifies them to perform the work. The engineer's estimate for construction was $322,500. DISCUSSION Staff recommends City Council authorize the City Manager to enter into contract with the low bidder, Ghilotti Bros., Inc. to provide the-East Washington Street Pedestrian Crossing Project. Construction is tentatively scheduled to begin in October -2010, and is expected to last approximately forty days, weather permitting. FINANCIAL IMPACTS On January 5, 2009, City Council authorized a project budget of $594,195, which consists of the HSIP grant and $84,885 of Traffic Mitigation Impact Fees. The estimated project costs shown below (third column) have been reduced due to the low bid. The Highway ,Safety Improvement Program will fund 90% of design, environmental, construction, and construction management for eligible projects up to the approved grant amount of $SD9,310.~ The budgeted $84,885 is more than the currently estimated $60,2.1.8 ($23,406 + $36,812) needed to meet the required 10% match, plus pay the City's overhead. All unused City funds. will be returned to the originating fund. Since the grant funding is only for this specific project; unused grant obligation cannot be used for any other purpose. Exemption- pursuant to the California Environmental Quality :Act ("CEQA".) pursuant. to ArCicle 19, Section.15301, of Title 14 of the California Code of Regulations ("CEQA Guidelines"). NOW, TI-IEREFOR~E, BE IT RCS®LVED'that the'City .Council of the City hereby: 1. Approves the Project Budget in the amount of `$198,767. 4 2. In accordance with the City of Petaluma Charter and Municipal Code, California Public Contract .Code Section 2Q.1,62 and .other applicable law, waives any and .all. non- conformance in the bid of Ghilotti Bros.; Inc. for the East Washington Street Pedestrian Crossing Project, and finds the bid of $198,767 to be the lowest responsive bid, and further finds that Ghlotti.Bros., Inc. is the lowest responsible bidder. 3. Awards the contract for the East Washington Street Pedestrian Crossing Project to Ghilotti Bros., Inc., in-the amount of $198,767, the amount of the lowest responsive bid, conditioned on Caltrans' concurrence of the award and Ghilotti Bros., Inc. timely executing the project contract and submitting all required. documents, including but not limited to, executed bonds, certificates of insurance,.. and. endorsements, in accordance with the project bid documents. 4. Directs staff to issue a~ notice of award to Ghilotti: Bros., Inc. 5. Authorizes and directs the City Manager to execute ,the project contract on behalf of the City of Petaluma upon timely submission by Ghilotti Bros.,.
