Introduced by Councilman Roland Bond s Seconded by Chbhid "Vn Mayor Fred Mattei AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1072 N.C.S BY RECLASSIFYING AND REZONING ASSESSOR'S PARCELS NOS. (located generally between D Street and Western Avenue) 8-321-42, 8-480-05, 8-490-04, 06, 09 and 10, 19-120-15 and 16, FROM R1-6500, R1--20,000 AND AGRICULTURE TO P.U.D. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS: Section 1. The City Council finds that the Planning Commission filed, its report as set forth .in .its minutes of January 24, 1984 (Item No. 3.304) with the City Council on February 21, 1984, recommending the adoption of an amendment to Zoning Ordinance No. 1072 N..C.,S., by reclassifying and rezoning certain lands located within the City of Petaluma, generally between D Street and Western Avenue and particularly described as Sonoma County Assessors Parcels # A.P. 8-321-42, 8-480-05, 8-490-04, 06, 09 and 10, 19-120-15 and 16 from R1-6500, R1-20,000 (,Single Family Residential) and Agriculture to P.U.D. (Planned Unit Development). Section 2. The City Council further finds that said Planning Commission held a public hearing on said - proposed amendment to Zoning Ordinance No. 1072 N.C.S., on January 24, 1.984, after giving notice of said hearing in 'the manner, for the period and in' the form required by said Ordinance No. 1072 N.C.S. Section 3. Pursuant to the provisions of Zoning Ordinance No. 1072 N.C.S., the City Council finds that the proposed amendment, including on site transfer of density permitted in thearea of the site shown as "DCA" , Development Constraint Area on the General'.Plan, i.e., 19 dwelling units,; is in general conformity with the Petaluma General Plan and its Environmental Design Plan Element, and further, that the public interest, convenience and general welfare will be furthered by the proposed amendment. r Section 4. The City Council finds that the requirements of California Environmental Quality Act Guidelines have been satisfied and as recommended by the City Planning Commission as set down in its minutes of September 27, 1983, hereby incorporates by reference the Environmental Impact Report previously certified by •.this City Council and the addenda thereto as incorporated by . Resolution No. 84-29 N.C.S. Section 5. Pursuant to the provisions Zoning Ordinance No. 1072 N . C . S . , and based upon the evidence it has received and in accordance with the findings made, the. City Council , hereby 'adopts an amendment to said Zoning Ordinance No. 1072 N.C.S., so as to reclassify and rezone said property as described herein to P.U.D, (Planned Unit ;Development). Section 6. The City Clerk is' hereby' directed to Obf /publish this ordinance for the period and in the manner .required by the City Charter.
