S . 3 of the City of Peta uma, a 1 ornia 4 5 INTENTION TO ORDER THE LEVY AND 6 COLLECTION OF ASSESSMENTS PURSUANT TO THE 7 LANDSCAPING AND LIGHTING ACT OF 1972 FOR 8 LANDSCAPE ASSESSIVIENT DISTRICTS 9 1o FISCAL YEAR 2001-2002 11 12 WHEREAS, pursuant to that certain Resolution, Describing Improvements and Directing 13 Preparation of Engineer's Report for fiscal year 2001-2002. Landscape Assessment Districts, 14 adopted by the City Council of Petaluma, pursuant to the Landscaping and Lighting Act of 1972, 15 the Engineer of Work of said City has prepared and filed with the City Clerk of this City the 16 written report for the Districts, listed in Exhibit A of the Engineer's report on file, called for 17 under said Act and by that certain Resolution, which said report has been submitted and 18 preliminarily approved by this Council in accordance with said Act: 19 , 20 NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED AND 21 ORDERED, as follows: 22 23 1. In its opinion the public interest. and convenience require and it is the intention of this 24 Council to order the levy and collection of assessments for fiscal year 2001-2002 pursuant to the 25 provisions of the Landscaping and Lighting Act of 1972, Part 2, Division 15 of the Streets and 26 Highways Code of the State of California, for the construction or installation of the 27 improvements, if any, including the maintenance, more particularly described for each and every 28 District in Exhibit B of the Engineer's report on file: 29 30 2. The cost and expenses of said improvements, if any, for each Assessment District, 31 including the maintenance, are to be made chargeable upon the said assessment district the 32 exterior boundaries of which district. are the composite and consolidated area as more particularly 33 described on a map thereof on file in the office of the City Clerk, to which reference is hereby 34 made for further particulars. Said map indicates by a boundary line the extent of the territory 35 include in each of the districts and of any zone thereof and the general location of said districts. 36 37 3. Said Engineer's Report for the Districts prepared by the Engineer of Work of said City, 38 preliminarily approved by this Council, and on file with the City Clerk is hereby referred to for a Reso. 2001-111]F~ NCS Page 1 1 full and detailed description of the improvements, the boundaries of the assessment district and 2 any zones therein, and the proposed assessments upon assessable lots and parcels of land within 3 the districts. 4 5 4. Notice is hereby given that Monday, July 2, 2001 at the hour of 7:00 PM, in the 6 regular meeting place of said Council, Council Chambers, City Hall, l l English Street, Petaluma, 7 California, be and the same are hereby appointed and fixed as the time and place for a hearing by 8 this Council on the question of the levy and collection of the proposed assessments for each 9 District for the construction or installation of said improvements, if any, including the 1o maintenance, and when and where it will consider all statements and all written protests made or 11 filed by any interested person at or before the conclusion of said hearing, against said 12 improvements, the boundaries of each assessment district and any zone therein, the proposed 13 diagram or the proposed assessments, to the Engineer's estimate of the cost thereof, and when 14 and where it will consider and finally act upon the Engineer's Report for the Districts. 15 16 5. The City Clerk is hereby directed to give notice of said hearing by causing a copy of 17 this resolution to be published once in a newspaper of general circulation circulated in said City, 18 and by conspicuously posting a copy thereof upon the official bulletin board customarily used by 19 the Council for the posting of notices, said posting and publication to be had and completed at 20 least ten (10) days prior to the date of hearing specified herein. 21 22 6. The Director of Parks and Recreation and/or the Director of Finance said City is 23 hereby designated as the person to answer inquiries regarding any protest proceedings 24 to be had herein, and maybe contacted during regular office hours at the Petaluma 25 City Hall, 11 English Street, Petaluma, CA 94952, or by calling 707-778-4380. 26 27 Under the power and authority conferred upon this Council by the Charter of said City. 28 REFERENCE: I hereby certify the foregoing Resolution was introduced and adopted by the Approved as to 29 Council of the City of Petaluma at a Regular meeting on June 4, 2001, 30 by the following vote: 31 City Attorney 32 AYES: O'Brien, Healy, Torliatt, Maguire, Moynihan, Vice Mayor Cader-Thompson, Mayor Thompson 33 NOES: None 34 ABSENT: None 35 36 ATTEST: 37 Mayon Reso12001-111F NCS Page 2
