Perry AN ORDINANCE AMENDING SECTION 6.36.,400 OF CHAPTER 6.36 OF THE PETALUMA MUNICIPAL CODE RELATING TO PEDDLERS (MISCELLANEOUS" BUSINESSES AND PROFESSIONS) BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS: Section 1. Section 6.36.400 of Chapter 6.36 of the Petaluma Municipal Code is hereby amended to read as follows: 116.36.400 Peddlers Every peddler shall pay a license fee of One Hundred Dollars ($100.00) per year for himself and the same amount for each assistant. For purposes of this section, the word "Peddler" shall mean any person engaged in the business of peddling, offering for sale, goods., wares or merchandise, either by going from place to place with such property for the purpose of selling or offering the same for sale in or along any street, upon or along any sidewalk or parkway, or in any doorway or entrance way of any building, or upon any unenclosed lot or parcel of land. Peddler .shall also mean any person who intends to stand on any street, or park any lunch wagon, eating cart or vehicle, or pushcart, from which tamales, peanuts, popcorn, candy, ice cream, or other articles of food are sold or offered for .sale.. Such ;a peddler shall obtain a written permit from the City Finance Director which shall designate the specific location from which such wagon, eating cart, or vehicle shall stand. The Finance Director may consult with the City Traffic Engineer to determine safe locations in which such lunch wagon, eating cart, vehicle or pushcart may be parked, or in which, peddlers may stand. The word "peddler" shall not include nonresident Ordinance 1566 NCS Page 1 of 2 veterans who satisfy the requirements of Business and Professions; Code„ Section 16001, or apply to the persons described in. and ,who comply with Section 6.36.280. No license' shall be issued to any peddler until the applicant, shall have procured a permit as required by Chapter 6. 32,' . The license fee required under this article for peddlers shall be ,in addition to any license fee payable for any other business conducted by the applicant for the license." Section 2. Severability. . The City Council hereby declares that it would have passed this ordinance sentence by sentence, paragraph by paragraph, and section by section. If for any reason any sentence, paragraph, or section of this ordinance shall be held invalid or unconstitutional, such decision shall not affect the validity of the remaining parts of this ordinance.
