Introduced by Councilman Roland Bond 1568 N.C.S Seconded by Councilman John Balshaw AN ORDINANCE AMENDING TITLE 2 OF THE PETALUMA MUNICIPAL CODE - ADMINIST,RATION - BY ADDING CHAPTER 2'.50 - SITE PLAN AND ARCHITECTURAL REVIEW COMMITTEE BE IT ORDAINED BY THE COUNCIL OF THE City of Petaluma as follows: Section 1. Chapter 2.50 is hereby added to the Petaluma Municipal Code to read as follows: Chapter 2.50 Site Plan and Architectural Review Committee Sections: 2.50.010 Established. 2.5.0.020 Membership -Qualifications and appointment. 2.50.030 Terms of Office 2.50.040 Declaration of Vacancy 2.50.050 Duties 2.50.060 Rules and Regulations. 2.50.010 Established. A Site Plan and Architectural Review Committee consisting of five members is established for the City of Petaluma. 2.50.020 Membership -Qualifications and appointments. One of the members of the Site Plan and Architectural Committee shall be a member of, and selected by the City Planning Commission. The Planning Commission may also ap- point an alternate to the regular appointee, to serve in the event of absence or conflict of interest of the regular member. The alternate shall serve for the same term as the principal appointee. The remaining four members of the committee shall be appointed from the community At large by the City Council, and must have resided 'in the City not less than one year prior to their appointment. Ord. No. 1568 N.C.S. 2.50.030 Terms of Office. The member of the Site Plan and Architectural Review Committee selected from the City Planning Commission shall serve until the thirtieth day of. June, after his/her appoint- ment and until his/her successor is appointed and qualifies, or until he ceases to be a member of the City Planning Commission, whichever occurs first. Terms of office for each of the other members of the committee hereafter appointed shall be two-year overlapping terms and they shall serve until the 30th of June or until his/her successor is appointed. 2.50.040 Declaration of Vacancy. Upon ,the -death, resignation; or disability to perform the duties -I of, a member of the Site Plan Architectural Review Committee_, permanent departure from the City, or upon the failure 'to attend any meetings of the committee for five consecutive meetings, the Council shall declare the office of such member vacant and thereupon appoint some qualified person to 'fill such vacancy for the unexpired term of the member. 2.50.050 Duties. The S'te' Plan Architectural Review Committee shall perform ;the duties prescribed in the zoning ordinance of the City or other ordinance, statute, rule or regulation of the state, county or this City pertaining to securing of, compliance with' the zoning ordinance and to promoting orderly and harmonious development within the City. The committee shall perform the duties hereafter- .designated and delegated .by the City Council and/or Planning Commission in respect to site design and architectural review matters. 2.50.060 Rules and Regulations. The Site Plan and Architectural Review Committee shall have the right and duty to adopt such rules and regulations, standards and policies as it shall deter- mine for the holding and conducting of its meetings and hearings, the selection of its officers, and for the performance of any of its functions and responsibilities. The committee shall not have the right to employ any person or incur any expenses or obligations against the City, except as provided by and for which appropriations are made by the City Council pursuant to and in accord- ance with budgets adopted by the City Council.
