Introduced by Councilman B attaglia Seconded by Councilman Balshaw, AN ORDINANCE AMENDING SECTION 17.030..020 OF THE PETALUMA, MUNICIPAL 'CODE 'REGARD;ING THE REQUIREMENT FOR PAYMENT OF STORM DRAINAGE IMPACT FEES AS A CONDITION'.O.F 'EX.TENSION OF A 1TEN7ATIVE SUBDIVISION MAP AND DECLARINGTHE URGENCY THEREOF., BE IT ORDAINED BY THE' COUNCIL OF THE CITY OF PETALUMA as f ollows : Section 1. Section 17.:30.020 of the Petaluma Municipal Code is hereby amended by adding subsection (c) to read as follows: "Section 17.30.0,20 Payment of Fees Required- (c) Extension of Tentative Subdivision Maps. The terms herein shall apply to any residential, commercial or industrial project which drains into the Petaluma River above the Washington Street Bridge :and which received tentative subdivision map approval prior to August 16, 198.2 and there- fore was not subject to the payment of storm drainage impact fees or the construction of off=site detention. facilities. As a condition of approval of an application for a time extension of a tentative subdivision map for any such project', payment of a storm drainage impact fee will be required:. For residential projects, regardless of the amount of additional runoff, the fee shall be $15, 000 per acre foot of additional runoff as 'calculated in Section 17.30.030. For industrial and commercial projects, regardless of the amount of additional runoff, the fee shall be $30,000 Ord.: 1547 'N.:CS Page 1 of 2 per acre foot of additional runoff as calculated in Section 17.30.030. Said fees shall be paid prior to approval and recordation of the final (or parcel) subdivision map. Section 2. This ordinance ;is hereby declared to be necessary for the immediate preservation of the public peace, health, and safety of the City of Petaluma, and shall take effect and be in force from and after its final passage by a unanimous vote of the members of the City Council present at the time of its adoption,. The reason for urgency is there are presently pending before the City applications for extension of time for previously approved tentative subdivision maps which were not subject to requirements for storm drainage impact fees for the construction of on or off -site detention facilities. Section 3. The City Clerk is hereby directed to post/publish this ordinance for the period and. in the manner required by the City Charter.
