Perry, Jr. Roland Bond AN ORDINANCE ADDING CHAPTER .10.,60 TO, TITLE 10 OF THE PETALUMA MUNICIPAL CODE TO PREVENT - LOITERING ON PRIVATE COMMERCIAL PROPERTY AND DECLARING THE URGENCY THEREOF TO TAKE EFFECT IMMEDIATELY BE IT ORDAINED BY THE CITY COUNCIL OF PETALUMA AS FOLLOWS: Section 1. There is hereby added to the Municipal Code of the City of Petaluma, Chapter 10.,,60 which is to read as follows: "CHAPTER 10.60 LOITERING Sections 10.60,01D Loitering - Unlawful. 10.60.020 Violation Section 10.60.010 Loitering - Unlawful. It shall be unlawful for any person to loiter on or about any private commercial property during non - business hours without the express or implied permission of the owner of such property or person in lawful control of the bsisiness maintained thereon. This ordinance shall be enforced after the City of Petaluma has received written request from affected property owners or persons in lawful control of businesses maintained thereon. Section 10.60.02,0 Violation. Any violation of this chapter shall be ,an infraction. if Section 2. If ,any section, subsection, sentence, clause, or phrase of this ordinance is for any reason held to be unconstitutional, such decision shall not .affect the remaining portions of this ordinance. The City Council declares that it would have passed this ordinance and each section, 0 Ord. 1537 N.C.:S. Page 1 of 2 subsection, sentence,, clause and phrase thereof irrespective of the fact 'that any one or more of such provisions be declared unconstitutional. Section 3. This ordinance is hereby declared to be necessary for the immediate preservation of the public peace, health and safety of the City of Petaluma, and shall take effect and be in force from. and after its final passage by a unanimous vote of the members of the City Council present at. the time of its adoption. The reason for the, urgency is the necessity to preserve and protect private commercial property of the citizens within the City of Petaluma. Section 4,. The City Clerk is hereby directed to post/publish this ordinance for the period and in the manner required by the City Charter.
