AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1072 N.C.S BY
RECLASSIFYING AND REZONING A PORTION OF .ASSESSOR'S PARCEL NO.
19-010-02 FROM 'R1-6'500 (SINGLE FAMILY RESIDENTIAL)
& F.?X,. (FLOOD PLAIN COMBINING) TO P.U.D. (PLANNED UNIT
DEVELOPMENT) AND F.P.C. (FLOODS P%ATN COMBINING) - (OAK
CREEK APARTMENTS),
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS
FOLLOWS:
Section 1. The City Council finds that the Planning Commission
filed with the City Council on June 21, 1982', its report as set forth in
its minutes of December 22., 1981, (Item No, 3.273), recommending the
adoption of an amendment to'Zoning Ordinance No.. 1072 N.C.S., by
reclassifying and rezoning certain lands being more particularly
described on the attached Exhibit A, from.Rl.-65'00 (Single Family
Residential) and F.,P.C. (Flood Plain Combining) to P.U.D. (Planned Unit
Development) and F.P.C. (Flood Plain Combining.):
Section 2. The City Council further finds that said Planning Com-
mission held a publichearing on said proposed amendment to Zoning
Ordinance No. 1072 N.C.S., as amended, on December 22, 1981, after
giving notice of said hearing in the manner, for the period and in the
form required by said Ordinance No. 1072 N.C.S, as amended.
Section.3,,. Pursuant to the provisions of,Zoning Ordinance No. 1072
N.C.S., as -amended .the City Council finds that .the proposed amendment is
in general conformity with the Petaluma General Plan and its Environ-
Ord. 1523 N;.C.S. Page 1 of 2
mental Design Plan Element, and further, that the public interest,
convenience and general welfare will be furthered by the proposed amend-
ment.
Section 4. Pursuant to the provisions .of Zoning Ordinance No. 1072
N.C.S., as amended, and based upon the evidence it has received and in
accordance with the findings made, the City Council hereby adopts an
amendment to said Zoning Ordinance No. 1.072 N,.C.S.,; as amended, so as to
reclassify and rezone said property hereinbefore referred to, in
accordance with the recommendation of the Pl;anting'.Comrission.
Section 5. The City Council finds that the requirements of
California Envirorrmntal Quality Act Guidelines Section 15083 have been
satisfied and hereby incorporates by reference the Negative Declaration
adopted by Council Resolution No. 9483 N.C.S. on June 21 , 1982.
Section 6. The City Clerk is hereby directed to post/oibil0i this
ordinance for the period and in the manner required by the City Charter.
