INTRODUCED BY COUNCILMAN SECONDED BY COUNCILMAN Albert Battaglia William Perr AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1072 N.C.S. BY AMENDING SECTION 16-300 (DEFINITION OF "SUBSTANTIAL IMPROVEMENT") IN THE FLOODWAY AND FLOOD PLAIN ZONES BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS: Section l. Section 16-300 of the Zoning Ordinance No. 1072 N.C.S., the definition of 'substantial improvement'~ is hereby amended to read as follows: "Substantial Improvement" means any repair, reconstruction, or improvement of a structure, the cost of which equals or exceeds 50 percent of the market value of the structure either: (1) before the improvement or repair is started, or, (2) if the structure has been damaged and is being restored, before the damage occurred. For the purposes of this definition "substantial improvement" is considered to occur when the first alteration of any wall, ceiling, floor, or other structural part of the building commences, whether or not that alteration affects the external dimensions of the structure. Ord. 1517 N.C.S. Page 1 of 3 The term does not include: (1) any project for improvement of a structure to comply with existing state or local health, sanitary, or safety code specifications which are solely necessary to assure safe living conditions, or, (2) any alteration of a structure listed on the National Register of Historic Places or a State or City Inventory of Historic Places." Section 2. The City Council hereby finds the proposed amendment is in general conformity with the Petaluma General Plan and the Environmental Design Plan. Section 3. That the public necessity, convenience and general welfare clearly require the adoption of the proposed amendment. Section 4. The City Council finds that this action is by definition not subject to the requirements of the California Environmental Quality Act guidelines. Section 5. The City Clerk is hereby directed to post/~~~~~~~ this ordinance for the period and in the manner required by the City Charter. Ord. 1517 N.C.S.
