BY :ADDING SECT.ION, T8,.5 THERETO .TO ESTABI,ISH A PB=C COMBINING DISTRICT '(_PRESERUA- T.ION QF PUBLIC.BUILDINGS). BE IT ORDAINED BY THE COUNGI-L OF THE CTT,Y OF.:PETALUMA.AS FOLLOWS: Sectiori l: Sect~ion'18.5 is hereby added to Zoninq Ordinance No. 1072 N.C.S. to re'ad as follows: 18-500., Purpose/Deseription. The "PB=C" di5~tr~ict and;~regulation5 are:_.established to protect; enhance, and perpetuate former pubiic bu~ildings, public structures, and, public sites_ within the Ci,ty which have'architectural:and cultural value; to preserve.and protect public funds which have been invesfed in such facilities~; to reduce the adverse environmental impacts.associated with th_e loss,of ir-replaceable assets in the,City; and to promote conservation and beneficial use of~these areas and their assoeiated structure;s._ The~City Council finds that, with controls, through eonditional use permits, many of these sites may be utilized.in_ a,manner~iah-ich i.s desigried to proteet.the publie health, safety arid welfare and•at the same time prevent the needless destr,uct'ion arid,to encourage'an eco,nomic use of these•s~tructures and sites. The pu"rpose of tfiis artiele is to promote the~health, safety and gerieral welfare o~f the:•public through: 18-501. The identification of former public buildsngs and public facilities which sYiould be preserved i~n; aecordance; witYi the purposes o"f' this Article as enumerated iri 18-.500.. . 1 ~ ;,;, ~ Q rd~, 1508 1 of 5 18-50,2... The de~elopment and~mainten'anc'e of `appropr-ia:te uses of former pubTic buildings and public facilities,. 18-5Q4, The enhancemerit of~property values., stabilization of the neighborhood and areas within the City, arid the' incr-ease in economic and financial benefits to the City and,its inhabitants through the appropriate uses of these struetu~res. 18-5`05. Effec,t of,Zone - 3n areas zoned Public Buildings-Combining Dis.trict (PB-C), the regulations of the `underlying zoning district shall be combined with and appl-y in addition_~to the prov-isions of this Article. Where any conflict may exist between the requirements of this ordinance and other zon.ing di;stricts, the"pro~;isions of this article shall apply. 18-600. Tfie Planning Commission shall transmit to the Ci€y, Council, a'fter public hearing, its reeommendations concerning the designation of Public Building-Combinin,g Districts. . • 18-700, Ma-nner of D'e,s:ignation,. T-he,City Couricil may, by ordinance, designate one or more individual strue;tur:es or other features, havirig a special character, special archi,tecfiiral or special economic, architecture or aesthetic in'terest or value, as a designation which may be appropr-iately zoned under this Article;, 18-701, Standards:for Designation. The City Couric'il may place a "PB-C" designation upon any site containing~a structure which contains a former public buildirig 'and where a.f=inding has'been made by the City 2 ~J~rd~; 150$ 2 of :5 Council that~such designation is necessary to achieve the.pur-poses of preser•vation as set forth in 18-5'00 of this ArticTe. 18-702. Permitted:Use,s. It:.is intended th`at the City shall utilize the use pe:rmit proeedure ,set forth in the pro~isions of Ar•ticle 21-300 and 26~-5'00 of the'Zonirig Ordinance No_. 1072~N.-•C..S. to regulate the allow,able uses of property containing a.~°:PB'"``designation. Any uses permitted which are deemed appropriate.by, the: City in accordance with satisfying tYie procedure' for obta'ining a us,e :permit pur"suant to the provisions of Artic1e,21-300 and 26-500 of th%s Zoning Ordinance; _provided that any approved' use sh`all be.designed to preserve the former . pubiic facility as a unique asset in the:~.community:;. Destruetio_n of Pub;lic Facilities~. If at any time, the former public.facility improveinents which are,sub.ject to these regirlations 'are destroyed by ,fire', earthqizake:, or~ a:ny otlier disaster or , calamity, al'l:conditional uses.under this A~rticle shall become null arid void, Upon the,destruetion of.the former pub~li:c facility, the City ,Council sha`11 proceed`as~soon as practie"a}~le to rezone the subj:ect . . ~property in accordance.with standards set for,th.i:n the Petaluma..General Plan/Envirqnmental D`e:sign 'Plari ~and` as' is, necessary to protect the :pub'l,ic hea°ltfi,, •safe:ty and :welfare.' , _ , . ~ ~ ~ ~ ~ ~- ~ ~ O~rd.;_ I508 3 ~o~f~ ~5 3 18-800. Development;Standards. No exist'ing buildings shall be required to be modified from its size or shape a•t~the time that it was abandoned by its publie owner,. exeept in a case where the public health, safety or welfare is served,by such modification of the structure or structures or of some portion of it.. A'fter the dat'e of abandonment by its public owner, no~structure shal-1 be altered, remodeled or added to except in confbrmity with' the following requirements;: (a) No principal building shall be altered to exceed either 3~ stories or 30'feet in height and no accessory building shall be altered to exceed either 2 stories`or 25 feet in height except as provided iri ,24-100. (b) The requirements for 1ot area, lot width, yard requirements, s`ite area per dw,el'ling,, area o'f usable open space and area of usable private balcony shall:be provided in 8-600 through 8-604. Section 2. The City Council finds and declares that the Planning Commission ha5 recommended the issuance of. a Ne.gative Deelaration pursuant to•the California..Environmental Quality Aet (CEQA). The City Council has considered ariy comments and`"p"roposed mitigating measures received pertaining to the issuance of said.Negative Deelaration, and ' ` finds the respons'es thereto to be adequate.. The Council further finds ' that no significant adverse environmental e£fects wilT,result from this action as proposed. • Section 3.
