develogment, pursuant to Ordinance~No. 1474 NCS, adop;ted by
your Council
on July 6, 1981, The c`ondit~ion ,that there be a
covenan~ r.unning with t'he la<nd exe`cut'ed; b;etween. the develope•r
and tI`ie City of' Petaluma to ensure "restriction of o:ecupaney
of the c~wellings to p:ersons 62. year.s of age and .older is not
l;egally permiss-ibl:e'under the S.t:ate GoVernment Code.
The plannin:g and zoning 1°aws, specificall,y §65:008 of_ the
Gov't Code, specif;icall.y pr~ecludes °citie's a~nd counties in tlie
enactment or. administr'ation of ordinances relat:ing to pl~ar.ning
and zoning from prohibiting or d~iscriminating again:s,t an~y resi-
dential developmen~t b~ecau~se of s°everal categories including

Sub~section (f,) of that section. makes it specif.ical'ly applicable
to char.tered cit'ies. ~
Accordirigly, the :Ci~y of Petaluma can.not condi,t_ion any
zoning approval upon a re.striction as `to age. It is po:ssib;le
for the C'ity to app;ly a restriction as to low and modera°te in-
c+ome ?~ious 'ing, . again as authorized. by' law, bu;t tha°t is really
the only classification which is all.owed:; .o-the~r-wis~e _either being
void because. of .spe'cific statutory. p;r~ovisions o;r under the Equal
Protection clause o.f the U',S. Constitu,tion,, Trhe oth:er specific
categories under~th_e State Governmen;t Cod',e, wherein;a c'ity or
county may not pr.ovid,e any manner. ~of ~ prohibit:ion or ~d;iscrimina-
tion ar.e the :follow:ing: method of f.inancing,, race, sex;, color,
