SECONDED BY GOUNCILMAN ALBERT L: BATT.AGLIA AN ORDINANCE AMENDI'NG SUBSECTION C OF SECTIQN 17.20.070' OF THE PETAL,UMA MU_NICIPAL.GODE TO REQUIRE° INSTALLATION OF PRODUCTS OF CQMBUSTION DETf CTOR•S ("SMOKE DETEGTORS") IN ALL RESIDENTIAL REAL PROPERTY UPON~SALE OR OTHER TRANSFER THEREOF, AND IN ANY CASE, BY JULY 1, 1983. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETqLUMA AS FOLLOWS: ~ Section 1. Subsection G of Section 17.20.070 of the Petaluma Municipal Code is hereby amended to~read as follows: °C. Section 13..307(A) is amended and changed„~:to read as follows: (1) :Alarm~Sys;tems ~ Every apartmen;t house and hotel,,.constr.ucted or remodeled after the effective date of this code, shall' have installed throughou,~t, an approved auto- matic fire alarm system, desi,gned to warn the occupants of the building in the event of a fire. Such fire alarm system shall 6e so desi°gned that all occupants of the building will be war-ned simultaneoasly. (2) Produc.ts of~Combustion Retec-tors a. No person or persons shall buy or otherwi'.se receive legal or equitable tit]e in real' property or permit a change of tenancy in owned real property improved~with one or more dwellings or apartments.capable of human habitation unless the,re is instal1ed therein one or more products of combustion detectors (commonly called a°smoke detector°), listed by Underwriter's Laboratories or a similar tes~ting organiz'ati'on approved by the Fire Chief and listed by the State Fire Marshal, except that no such device shall be sensitive to heat only. PLK:mv 4-30-80 ~ Such devices shall be installed in the same locations requi,red~ by the Building Code for new structures, and may be powered by battery, house current or any means authorized for such devices. No owner of residential real property shall ma.int:a°in the same after July l., 1983, unless such produ;cts of combustion detectors are ins'talled as herein set out. b. Every Person who buys or wlio permi'ts a change of tenancy in owned residential real property as descri6ed herein sha'l1 certify, by declaration made under penalty of perjury., that this section has been complied with and the detector or detectors required by this section has or have been installed in and are operational in sai.d dwelling, to the stand~ards set out herein. The original said certificate shall be forwarded to the Petaluma Fire Prevention Bureau." Section 2. .Findings. The•City Council her.eby finds that due to budgetary constraints on expansi~on of pubTic services, it is necessa"ry to include measures for early fi're detection and warni~ng in resi~dential occupancies. Requiring such devi`°ces wil:l assist in reducing fire response times and evacuation time's to a level more manageab}e by existing fire suppression services, and are therefore found to 6e necessary because of local conditions. Section 3. The City C.lerk is hereby directed to post/publish this ord:inance f.or the period :and in the manner required by the City Charter.
