Specifically, according to Section 3309.1.1 of Petaluma Municipal Code Section 17.20.050, the following reporting procedures are required: "Reports to Councal: a. On an annual basis, before June 15th of each calendar year, the Fire Department will prepare and provide to the City Council an Education and Enforcement plan. The plan will include the following: 1. Education and enforcement program to be implemented in a given year. 2. Other relevant information deemed necessary by the Fire Marshal to provide an overview of the City's experience in fireworks enforcement relevant to that year's education and enforcement program. b. By no later than the last day of September, annually, the Fire Marshal will provide to the City Council a Fireworks After-Action Report. The Report will include the following: 1. An evaluation of the success or failure of the education and enforcement plan. 2. Relevant incident statistics for the period June 17~' through July 16`n " A written comprehensive Education and Enforcement Plan in advance of the 2010 Fireworks Season was distributed to all affected parties in May, 2010. The following After-Action Report (provided herewith) is intended to provide a comprehensive assessment/evaluation of the success or failure of the Education and Enforcement Plan. We will be providing all the relevant incident statistics for the period June 17t" through July 16t" per the paragraph above. For 1:he purposes of this presentation, the following definition of "fireworks" is still relevant in evalizating our success this year: Safe and Sane: Fireworks approved by the Office of the State Fire Marshal for sales and use within the State of California and as legally authorized by municipalities. These fireworks generally remain in a motionless position on the ground and emit showers of sparks. ~ Illegal Fireworks: These are fireworks not classified as Safe and Sane and are banned by State law. Typically, these devices make very loud explosions and/or fly through the air or across the round. It is a misdemeanor or felony to possess or discharge these fireworks anywhere in the state. This year's Enforcement and Education plan was similar to previous years and was geared towards targeting illegal fireworks use and utilized education, engineering, and enforcement options referred to as the "3E's". Our theme this year was: ** Don't Get ~urned - Steer C'lear of I91ega1 ~'ireworks! *" The highlights of our "3E" approach are as follows: Education o Distribution of fireworks safety informational flyers and posters; 0 Utilization of a movie short entitled "Don't Get Burned" which aired at the local theater during the months of June and July (expected to reach approximately 112,000 people); m The "Don't Get Burned" movie short also played on the public access channel and the "Movies in the Park" series at Lucchesi Park; ~ Distribution of a letter by mail to residents in the High Fire Hazard Severity Zone ("HFHSZ") that NO fireworks are allowed (approximately 2050 Owner/Occupants were notified by this letter mailed via USPS on June 21, 2010); and 0 Utilization of the Hwy 101 Auto Mall Electronic billboard to flash a safety message ("Zero Tolerance for Illegal Use") from June 15`"-July 4`~'. ~n~ineerin~ m There were four (4) firework sales days: July l st through the 4`"; • Time of use was limited to one day: 10:00 a.m. to 11:00 p.m, on July 4~" only; m Made it unlawful for minors to use Safe and Sane fireworks and limited discharge on others' properties; and ~ Displayed the "Zero Tolerance" message about using illegal fireworks at all twenty (20) 2010 fireworks booths. Enf'orcement ~ Utilized the administrative citation process with $1,000 fines for illegal fireworks use and graduated penalties of $250-$1,000 for the misuse of legal Safe and Sane fireworks; and o Fielded one (1) two-person combined Police and Fire enforcement team on Friday, July 2°a from 7:00 pm to 12:00 am; two (2) two-person enforcement teams on Saturday, July 3rd from 7:00 pm to 12:00 am; and three (3) two-person Police and Fire enforcement teams on Sunday, July 4th from 6:00 pm to 12:00 am. 2 ~'inancial Impacts ~ The cost of our "3E" approach was funded by this; year's two (2), f reworks _„ manufacturers/distributors (TNT and Phantom Fireworks) and eaeh of the booth operators; With twenty (20) booths this year payirig an enforcement fee of $692 each, fireworks operators provided approximately $13,$40 iri funds, which covered the full cost for educational materials, enforcement teams, and inspection and regulation efforts. Performance Measurements m Begin implementation of the education campaign in late May and June; ~ Send flyers and notices to neighborhoods identified in the previous year as having problems with illegal fireworks usage; o Conduct community policing of known target neigliborlioods during the daylight hours on July 2°a, 3~a, and 4`h and utilize "After Dark'' enfarcement teams to respond to calls for service specifically related to fixeworks use; m Track number of calls for service (from dispatch and complaints through the FMO); ~ Track the number of administrative citations issued:for "Safe and Sane"; ~ Track the number of administrative citations issued for illegal fireworks use; and o By no later than the last day of September, annually, the Fire Marshal will provide the City Council with a Fireworks After-Action.Report. The Report will irack relevant incident statistics for the period June 17~" through July 16`" and comment on the program's successes and/or failure of the education and enforcement plan. S~CTION II JULY 4, 2010 FIREWORKS AF'TER-ACTION`R~P~JRT We are providing herein our Department's assessment andJor comments of the relative success or failure of each of the following categories: Education This is the second year our Department conducted a massive educationa'1 campaign which emphasized strict enforcement of the $1,000 fine; included utilization of the Hwy 101 Auto Mall sign and the Cinema movie short "Don't Get Burned", and school fireworks safety brochures. We believe these efforts made a significant impact on children and young adults. We continue to believe that limited days of sales and allowing only one (1) day of actual use also had a significant impact on reducing f re activity before and after July 4`h. As mentioned in the previous section, the "Don't Get Burned" cinerna ad was estimated to have reached approximately 112,000 people. Fireworks distributor TNT reported that they delivered fireworks safety broehures to all. Petaluma schools. OUTCOM~: Overall good success with the general population and children. 3 ~ We continue to have individuals from within Petaluma, as well as non-residents, who use illegal fireworks on both public and privafe property. While there were no citations issued on July 2°d or 3rd, there were five (5) citations issued on the 4ih itself. No warnings were issued for illegal fireworks use. This was significantly less than in previous years (i.e., last year a total of fourteen (14} citations were issued with eight (8) of the fourteen (14) citations issued to individuals from "out of County"). While we did observe a decrease in the number of citations to non-residents, there was plenty of illegal-type fireworks activity within the City of Petaluma. It seems that individuals who use illegal- type fireworks may be staying within their private backyards thereby making access and enforcement more difficult. Also, the fact that July 4t" fell on a Sunday may have contributed to less illegal fireworks activity. OiJ'I'COM~: Improved. En~ineerin~ • The Department had significantly reduced call volume and fewer fires prior to July 3`d and 4~". We believe restricted sales days continues to be the difference and responding to fewer fireworks-related calls allowed our Department's limited resources to deal with its "routine" emergency calls more effectively when it would otherwise have been "stretched thin". (See the following Fire Activity Report and Historical Data tables below for further information.) Oi1~'COIVIE: Successful. Firework Booths This year we had nineteen (19) permitted "non-profit" sales booths and one (1) grandfathered "for profit" booth for a total of twenty (20)' selling booths. Petaluma's Firework Ordinance allows up to twenty-two (22) booths and in previous years we've had between eighteen (18) and twenty-one (21) booths. All booths received inspections and were issued operating permits. No violations of State or local regulations were observed or reported. OUTCOIVIE: Compliance achieved. Pre-July 4~h 1Vleetin~s/Special Concerns/'I'actical Obiectives As in previous years, several meetings were held prior to July 4th which involved.Police, Fire, and Parks Departments, and Fairgrounds personnel to identify areas of responsibility, identify problem neighborhoods, clarify overall objectives, and develop: a comprehensive tactical plan. In addition, the Fire Marshal corresponded with the State ~ Fire Marshal and developed an agreement/policy which again allowed local agencies (Petaluma Police and Fire) to issue citations on State-controlled property. Police and Fire did not issue warnings for illegal fireworks use. Five (5) citations were issued. OUTCOIVIE: Excellent coordination between agencies (Parks, Fire, Police, State). 4 Hi~h Fire Severity Hazard Zone ~ A mass mailing was sent to approximately 2050 Owner/Occupants located within the HFSHZ in mid-June. The list was comprised of owners who may or may not reside at an address located within the HFHSZ, as well as to their tenants/renters should the owners reside at a different location. This list included about twenty-six (26) City of Petaluma parcels as well. While we received a few calls for service, we did not have any incidents of note nor were any citations issued in the HFHSZ. O~J'I'COIVIE: Successful; low to no fireworks activity reported in this area. Idemtified Problem Areas From Previous ~'ears 0'~'he ~airgrounds Parking Lot: One goal this year was to control fireworks usage in the Fairgrounds parking lot. Police provided both motorcycle and patrol staff in this area. Enforcement teams were also assigned to this area as their "initial assignment" and remained present as long as needed. The Parks Department posted signs indicating that NO FIREWORKS were allowed, along with the $1,000 penalty amount. The effort to control the Fairgrounds parking lot was successful again due to a strong initial police showing and signage from Parks (with the $1,000 fine signs as an additional deterrence). We were able to control and eliminate 99°l0 of fireworks activity early on and this allowed our combined police and fire teams to be released to patrol other designated neighborhoods. No citations were issued on Fairgrounds property. OUTCOME: Very Successful; low fireworks activity in this area. ~'I'argeting Problem Neighborhoods: In the past, certain neighborhoods have been identified as having high illegal fireworks activity and enforcement agencies located enforcement teams within these areas. This year, the problem with illegal fireworks spread to additional neighborhoods and our teams suspected that many aerial-type fireworks were launched from backyards. OIJ~'COIVIE: Generally improved, with overall activity noted to be less than in previous years. Enforcement Effoa-t: Police/Fire Enforcement Teams Statistics In 2008, enforcement teams consisted of Fire Inspectors only and no (-0-) citations were issued. In 2009, we returned to the policy of fielding police/fire enforcement teams for July 3rd and July 4th and fourteen (14) citations were issued. Events and calls for service/complaints leading up to July 4`h were significantly-down due to restricted sales days and the only one day of use (July 4`h). The following statistics were compiled for the 2010 July 4~h reporting period: Prior to July lst: Very few events; all were minor. There were seven (7) police calls. Ju~y Znd: One (1) enforcement team (working from 7:00 p.m. to 12:00 a.m.). No citations were issued. There were eight (8) calls for service/complaints recorded. Three (3) warnings were issued for safe and sane fireworks use (which is only allowed on July 4tn) O~1TCOlVI~: Low fireworks activity; no (-0-) citations issued; three (3) warnings. 5 ~ Julv 3rd: Three (3) enforcement teams (working from 7:00 p.m. to 12:00 a.m.). No - citations were issued and most areas were fairly quiet; some iliegal activity noted. 'There were twenty (20) calls for service/complaints recorded. One (1) citation was issued for safe and sane fireworks use and eight (8) warnings issued. OL1'TCOME: Medium fireworks activity; one (1) $100 citation; eight (8) warnings.** July 4tn: Three (3) enforcement teams (working from 6:00 p.m. to 12:00 a.m.). A total of five (5) citations were issued. There were four (4) $1,000 citations issued for illegal fireworks (total amount cited equals $4,000) and one (1) safe and sane citation for $100. 'I'here were fifty-six (56) calls for service/complaints. Similar to past years, there was significant illegal fireworks use observed throughout Petaluma by both enforcement teams and private citizens. The total police/fire overtime cost was $8,895.17 (paid for by fireworks enforcement fees). O~1'I'COIVIE: 1Vledium to high illegal fireworks activity; four (4) $1,000 citations, one (1) $100 citation and five (5) warnings issued.** o July Sth" July 15th: No enforcement teams were working. '~here were nine (9) calls for service/complaints. No citations were issued and there was one (1) warning issued. OUTCOME: Okay. ** Warnings were only issued for Safe & Sane fireworks use. By comparison, there were approximately nine (9) fires last year attributed mostly to illegal fireworks. These fires were not attributed to fireworks but were included for comparative purposes. 1 Tl~is data does not include median fires on Highway 101, or median fires on Sonoma Mountain Parkway where cigarettes are suspected. Last year, enforcement teams issued most of their citations to non-residents. This year, four (4) of the five (5) citations issued went to Petaluma residents and only one (1) to a"non-resident". There did not seem to be the same problem with private parking lots being "occupied" by fireworks users. There were a few problems where people from outside the area were seen using Safe and Sane fireworks in the commercial areas. These people were re-directed to legal/allowed City areas. This year, July 4th occiarred on a Sunday and this may have contributed to fewer fires,~ fewer parties,. and what seeined to be more orderly conduct. Nori-Profit Overview This year, there were nineteen (19) non-profit firewarks booths and one (1) "for profit" booth. Petaluma's Fireworks Ordinance specifies that the money earned from non-profit booth sales shall "provide direct and regular community services and benefits to the residents of Petaluma". See Chapter 2: Definitions - Affiliated Organization and Non-Profit (provides framework for how organizations are to be defined) and Section 3309.1-Section 12 - Qualified Applicant Reporting Requirements (requests gross sales information). To this end, the Department sent out letters to the sixteen (16) non-profit booth operators on August 2, 2010 requesting information on their gross and net sales for this season and requesting them to verify the elements of their program to the current fireworks ordinance (be advised, three 7 (3) of the non-profit groups ran two (2) booths each). The deadline for submittal of this information was August 25, 2010. As of this time, only the following nine (9) groups have responded: McDowell Drug Task Force, Petaluma School of_Ballet, 579`h Engineering Battalion, Athletic Edge, Petaluma Valley Baptist Church, North Bay Christian Academy, Petaluma Friends of Dance, Cheer & Band, Petaluma Panthers, and Casa Grande Boosters Club. Responses ranged from the very detailed to minimal at best, and all are attached hereto under Appendix A. The seven (7) remaining non-profit groups that have failed to respond to our ~ request for information in time to be made part of this Report to the City Council will be re- contacted. Those who fail to respond will not be issued permits in 201 l. For informational purposes, gross 2010 fireworks sales for TNT and Phantom were reported to be $366,663.92 ($288,334 for 'I'N'I' and $78,329.92 for Pharetom F~reworks, as directly reported to our Department by 'I'NT & Phantom Fireworks). Net fireworks sales for ~'NT and Phantom were reported to be $183,331.96 ($144,167 for TNT and $39,164.96 for Phanto~n). Surmmary Report on the Success or Failure of the Education and Enforceanent Plan This is the second year of an extensive education program. We believe we were successful in reaching children and Petaluma residents. Both TNT and Phantom contributed $600 each to allow our movie short "Don't Get Burned" to play at the local cinema. Our program also receives funding in the amount of $692 per booth as an enforcement fee which pays for enforcement team overtime costs. This fee has not been increased since the new resolution was adopted and currently does not fully fund all of the time, work and effort necessary to develop educational programs, prepare the Council's Before (pre-Education) and After-Action Reports, or to respond to service calls. Therefore, the education and enforcement fee may need to be increased to pay for services, other than enforcement costs, which were incurred on July 1 S' thru 4th by both police and fire. Some of the highlights of this year's efforts are as follows: We had an aggressive enforcement effort with teams working each night from July 2na through July 4th and we continue to believe that the reduction in sales and use days resulted in a reduction of fire activity before and after July 4t". Fire activity was lower than in previous years. ~ One of our successes this year was controlling fireworks activity in the Fairgrounds parking lot. Pre-planning, signage and a strong enforcement effort in this area contributed to this success. m Illegal fireworks activity in Petaluma continues to pose a significant fire risk to the community. Some Petaluma residents and non-residents continue to use dangerous and illegal fireworks within the City limits.
