SCE — Director, Public Works & Utilities Larry immer, P.E. — Deputy Director, Public Works & Utilities SUBJECT: Resolution Accepting Completion of the East Washington Street at Edith Street Lighted Crosswalk Project RECOMMENDATION It is recommended that the City Council adopt the attached resolution accepting Completion of the Construction Contract for the East Washington Street at Edith Street Lighted Crosswalk Project. BACKGROUND There have been ten pedestrian related accidents in the Edith Street crossing of East Washington Street within the past twelve years with the most recent on January 1, 2012. The intersection requires pedestrians to cross five travel lanes with vehicular speeds exceeding 35 miles per hour. The crosswalk is striped, but has no signals or other safety enhancements. The nearest signalized crossing is two blocks away in either direction, on E. Washington Street at Lakeville Street or Payran Street. Based on visual observations and recent counts, Edith Street had the highest amount of pedestrian and bicyclist crossing activity between the two signalized intersections on East Washington Street. Staff also evaluated two other non -signalized intersections on East Washington at Wilson Street and Vallejo Street, but selected Edith as the highest priority. The Pedestrian and Bicycle Committee recommended the grant application for this project. The Safe Routes to School Grant (SRTS) was accepted by the City Council on September 10, 2012. The project included installation of a lighted crosswalk, consisting of City furnished in -road pedestrian warning system, ADA compliant curb ramps, traffic stripes, crosswalk markings, and pavement markings. Road signs, sign posts, and grinding and replacing 2" of asphalt concrete were also included. Bids were opened on July 30, 2014. On September 15, 2014, the City Council awarded the construction contract to Team Ghilotti, Inc. of Petaluma, CA, in the amount of $131,230.00. Construction was set to begin in October 2014, but it was decided that it was best to begin construction in January 2015, in order to avoid performing construction work on East Washington St. during the holiday season. The proposed action meets Council Goal: "Plan for and implement priority capital projects as funding permits". DISCUSSION The final construction contract cost for this project is $132,053.78, which includes three change orders totaling $3,859.83. The first change order was processed in order to delay the start of construction until after the holiday season at no cost to either the City or the Contractor. The second change order was to compensate the contractor for additional labor, equipment, and material costs for additional grinding and paving at the pedestrian zone gutter pan -to -AC to conform the transition to proper slope to meet ADA requirements, as well as additional striping due to an error in the plans. The total cost of this change order was $1,341.55. The third change order was processed in order to compensate the contractor for the additional time spent on a modification to one of the handicap ramps that the City requested, in order to make the ramp safer than what was initially designed. It also added 10 square feet of sidewalk. The total cost of this change order was $2,518.28. For the Lanelight/Material Purchase, an additional $1,991.80 was spent for procurement of 4 galvanized poles that were not included in the original contract. FINANCIAL IMPACTS Council previously approved a total budget of $221,400, comprised of $154,800 of the Cycle 10 State SRTS Grant, $25,600 from a developer contribution from the E. Washington Place settlement agreement with•Regency, and $41,000 from the Traffic Mitigation Fund. With the construction contract, final quantities, contingency, construction management and inspection, the total cost for the project was $219,286, as shown in the following project breakdown. 2 TOTAL $ 221,400 $ 219,461 At project closeout, all remaining funds will be returned to the Traffic Mitigation Fund to be used on future projects. Following the acceptance of the project, the City Clerk will file a Notice of Completion with the Sonoma County Recorder and the Finance Department will release the contract retention account to the contractor within 60 days. Attachment 1 RESOLUTION ACCEPTING COMPLETION OF THE CONSTRUCTION CONTRACT FOR THE EAST WASHINGTON STREET AT EDITH STREET LIGHTED CROSSWALK PROJECT PROJECT NO. 016101308 WHEREAS, in accordance with Section 68 of Article X of the City of Petaluma Charter, Section 20162 of the California Public Contract Code and other applicable law, the City of Petaluma solicited bids for the East Washington Street at Edith Street Lighted Crosswalk Project ("Project"), and WHEREAS, bids for the Project were opened on July 30, 2014, in accordance with California Public Contract Code Section 4104.5 and other applicable law; and WHEREAS, the apparent low bid for the Project was Team Ghilotti, Inc., in the amount of $131,230; and WHEREAS, by Resolution No. 2014-146, adopted on September 15, 2014, the City Council found the bid of $131,230.00 for the Project to be the lowest responsive bid, awarded the Project to Team Ghilotti, Inc., in the amount of $131,230.00, conditioned on Team Ghilotti, Inc. timely executing the Project contract and submitting all required documents and authorized and directed the City Manager to sign the Project contract on behalf of the City, upon such timely submission and to execute on behalf of the City any amendments to the Project contract that are necessary to effectively complete the project and/or to realize the Project and/or cost benefits for the City; and WHEREAS, the following contract change orders (CCO) affecting the Project amount have been approved: Change Order Number Description Amount CCO#2 Additional Striping and Pavement Grinding $1,341.55 CCO#3 Ramp Modifications $2,518.28 Total Change Orders $3,859.83 WHEREAS, the final contract amount, as amended, including all change orders, overruns and underruns is $133,351.63; and WHEREAS, the estimated total cost of the Project is $219,461, and was within the approved Project budget; and WHEREAS, City staff have inspected the Project and determined that it has been completed in accordance with the contract requirements, and the Contractor's continuing warranty and other obligations pursuant to the contract; and 0 WHEREAS, based on the foregoing, staff recommends acceptance of the Project on behalf of the City. NOW, THEREFORE, BE IT RESOLVED by the City Council as follows: The contract entitled East Washington Street at Edith Street Lighted Crosswalk Project, Project No. C16101308, with the final contract amount of $219,461, is accepted as complete, subject to the Contractor's continuing warranty and other obligations pursuant to the contract. 2. The City Clerk is hereby authorized and directed to file a Notice of Completion concerning the Project with the Sonoma County Clerk's Office within 10 days of the date of this Resolution. 3.
