It is recommended that the City Council adopt the attached Resolution Accepting Emergency
Rescue Equipment Purchased by Sonoma County Emergency Services from the FY2009
Homeland Security Grant Program (HSGP) Valued at $20,0.00, and Authorizing the City
Manager to Sign the Current Grant Compliance.Agreement as well. as Any Additional Annual
HSGP Grant Agreements Administered by Sonoma County Emergency Services for Grants
Awarded to the City of Petaluma.

Each year, the Sonoma County Fire Chiefs Association .submits grant requests on behalf of
Sonoma County Fire Departments for Homeland Security Grant funds administered by the
Sonoma County Emergency Services Department. This year, the City of Petaluma Fire
Department was selected for a grant award valued at $20,000 for the purchase of rescue tools.

The Petaluma Fire Department is a participating member of the .Sonoma County Fire Chiefs
Association. Through this Association, the Department has access to Homeland Security Grant
funds that become available on an annual basis administered by the. Sonoma County Emergency
Services Department. The fire department's goal is to request tools and equipment that would
ordinarily be purchased from City of Petaluma funds for routine replacement, or as an addition to
the operational capability of the Department.

The Homeland Security Grant funds are accessed by Sonoma County Emergency Services on
behalf of.all Sonoma County f re and law enforcement agencies, public health emergency .
medical services, and the LETPP (Law Enforcement Terrorism Prevention Program) on an
annual basis. Because this occurs annually, this Resolution includes a provision that authorizes
the City Manager to sign the required Grant Compliance Agreements without the necessity of
bringing each Grant received back to the Council. for approval each year.
The following equipment will be purchase by the Sonoma County Emergency Services
Department for the City of Petaluma Fire Department:
1. Rescue Shores
2. Rescue Rope
3. Carabineers
4. Webbing
5. Pulleys
6. Demolition Hammer
7. Circular Saw
Receipt of this equipment will enable the Fire Department to continue to deliver essential rescue
services to citizens and visitors in the City of Petaluma. The City of Petaluma Fire Department is
required to provide mutual aid assistance with said equipment in the event of an incident within
Sonoma County.
FINANCIAL. II~ACT:
The Department is.receiving new .equipment that will replace older worn out equipment. The
existing maintenance costs for this equipment will remain the same.

Memorandum of Agreement
FY 09 Homeland Security Grant
This Transfer of Property Agreement, entered into this _ day of 2010, between the
'County of Sonoma/Sonoma Operational Area (OA) transfers the items listed on this document to the
Petaluma Fire Department (Receiving Agency) as follows:
Receiving Agencyc
Item(s) Being Transferred: Rescue Equipment, Demo Hammer,. 20" Chain Saw
Canditions of Ownership
Agencies receiving grant equipment. agree to provide mutual aid assistance with said equipment in the event
of an incident within the Sonoma OA.
Equipment/vehicles shall be maintained, operated and managed by the Receiving Agency at its own
expense.
Agencies receiving grant funded equipment agree to regularly inspect and maintain said equipment in good
working order and maintain records accordingly at its expense.
Agencies receiving grant funded equipment agree to ensure adequate training for personnel who will be
using said equipment.
Should the grant funded equipment become damaged beyond repair, the owner/agency shall notify the
County of Sonoma, Fire and Emergency Services .Department.
.Agencies may rotate stock to ensure supplies remain within service lives as long as feasible.
Agencies may use grant funded equipment provided during emergencies, but must maintain cache levels at.
80% or higher., Agencies„that use said equipment fior such emergencies must restock the cache to .the 8.0%
. .; level at;their°own,„expense.
Should' the grant fiunded equipment be used in a fetlerally declared .disaster, agencies should seek
reimbursement through the appropriate process.
Grant funded equipment- will be labeled in accordance with grant requirements. This label will remain on the
equipment during its entire service life.
Receiving Agency will maintain an accurate inventory list of all grant funded equipment.
Grant funded equipment will not be .replaced at the end of its useful life.
If the grant funded equipment purchased .costs, over $5;000, the item will. be entered ',into the Sonoma OA
fixed asset tracking system. The receiving agency agrees to allow reasonable access to the equipment for
regular inventory tracking.

For audit .purposes, the receiving ;agency must provide access to the grant funded equipment and trained
operators to explain the operational use of the equipment.
'For. Vehicle Transfers:
The agency shall manage and administer all vehiclewarranty re ated issues..
The agency is responsible to label the vehicle with "Sonoma County Operational Area" on the sides. If
agency chooses to use their logo, it may additionally read "Maintained and operated by: Receiving Agency".
The agency shall provide insurance coverage for the vehicle at all times, naming County of ,Sonoma/Sonoma
Oneratic~nal -Area as an additional insared.
C®nditions of Transfer
'° Th_e grant equipment may not be transferred or sold to any .other agency or party without the written
permission from the County of~Sonorna; Fire: and Emergency Services Department.
Should the agency/owner of the grant equipment become unable to fulfill the requirements listed above, said
agency/owner must contact the County of Sonoma, Fire and Emergency .Services Department. The County
of Sonoma retains the right to transfer said equipment to another'organization capable of meeting the
conditions of ownership.
County's Responsibilities
Upon receipt of the specified equipment; the County shall pay the budgeted amount from the FYXX
Homeland Security Grant Program, in"accordance with established policies-and procedures.
If the grant- funded equipment purchased costs over $5,000 The Sonoma OA shall retain the equipment as a
fixed asset`for accounting purposes.
Liability and Indemnities

Receiving agency,and~ Gounty ;each agree to accept all responsibility for loss or damage to any person. or
;entity, and to defend, indemnify, hold harmless and release each other (including their respective
supeniisors; officers, agents,, and employees) from and against any and all actions, claims, damages,
disabilities, or expenses that may be asserted by any person or entity, including themselves, resulting from
Receiving Agency's or County's own respective negligence or willful .misconduct arising ..out of or in
,,connection with the performance. of this MOU. This indemnification obligation is .not limited in any way by
':any limitation on the amount or type of damages or compensation payable to or for the parties hereto or their
agent under workers' compensation acts; disability benefit acts, or other employee benefit acts.
