SUBJECT: Resolution Approving the Project Budget and Authorizing Award of Contract for
the Auto Center Dr. Extension to Petaluma Blvd. North Project to FEDCO
Construction, Inc.
RECOMIVIENDATION
It isirecommended that the City Council adopt the attached resolution approving the project
budget and authorizing award of contract for the Auto Center Dr. Extension to Petaluma Blvd.
North Project to FEDCO Construction, Inc.
BACKGROUND
To improve vehicular access and. circulation to the Auto Mall, Public Works staff has been
working with the owner of the Victory Chevrolet dealership to extend Auto Center Dr. to its
connection with Petaluma Blvd. North. The CIP project budget was based on a preliminary
project scope, and the current project budget is based on a revised assessment of the project
needs. The preliminary project design was initiated subsequent to acquisition of the
necessary roadway improvement easement. Design and construction management will be
funded by PCDC funds, and construction will be a combination ofPCDC and Prop.1B funds.

A Notice Inviting Bids was issued on September 15, 2010, and eight bids were received on
September 29, 2010, as follows:

FEDCO Construction, Inc. is the apparent low bidder, with a total bid of $557,391.00. This
contractor has satisfactorily performed similar. projects-for other municipal agencies. Staff
verified that FEDCO Construction; Inc. possesses a valid Class A contractor's license No.
479227, which qualifies them.to perform the work.
The engineer's estimate for construction was $910;000.
DISCUSSION
Staff recommends City Council authorize the City Manager to enter into contract with the low
bidder, FEDCO Construction, Iric.''to construct the Auto Center Dr`. Extension to Petaluma Blvd.
North Project. Construction is tentatively scheduled to begin.in October 2010, and is expected to
last approximately sixty calendar days, weather. permitting, with lanes open to traffic in
approximately 50 calendar.days.
FINANCIAL IIVIPACTS
On July 12, 2010, City Council authorized a project budget of $1;485,000, which consists of the
Prop 1B allocation of $139,000 and $1,346,000 in PCDC'funds. The project bid is within the
approved budget.

As is illustrated, the construction bid came.. in well under the engineers. estimate. Because the
project construction window will overlap into inclement weather months, potential rain delays
and other variables could arise. The lower than expected bid allows the budget to be adjusted
with+' an increased contingency that will remain in the project budget until the job is complete and
accepted by the City Council. Funds remaining of the conclusion of the project will be
reallocated back to their respective sources on a pro-rata basis.

RESOLUTION APPROVING TI-IE PROJECT BUDGET AND AUTHORIZING
THE AWARD OF CONTRACT FOR THE AUTO CENTER DR. EXTENSION TO
PETALUIVIA BLVA. N'ORT'H PROJECT TO FEDCO CONSTRUCTION, INC.
WHEREAS, a Consultant has prepared construction bid documents and City staff has
advertised for construction of this Project; and
WHEREAS, in accordance with California Public Contract Code Section 20162 and.
other applicable law, City staff solicited bids for the Project; and'
WHEREAS, the project was bid on September 29, 2010; and eight bids were received
and ;opened in accordance with applicable law; and
WHEREAS, the lowest bide for the Project was from FEDCO Construction, Inc. for
$557,391; and
WI~EREAS, staff has determined that FEDCO Construction, Tnc. bid satisfies the
bidding requirements for the Project; and
WHEREAS, staff has verified that FEDCO Constructi°on; .Inc. possesses a valid
California Contractor's License, Class A, No. 479227 that ,qualifies FEDCO Construction, Inc. to
perform. the Project; and
WHEREAS, the. Project has a Categorical Exemption pursuant to the California
Environmental Quality Act ("CEQA") pursuant to Article 19, Section 15303, of Title 14 of the
California Code of Regulations ("CEQA Guidelines").
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City hereby:
1. Approves the Project Budget in the amount of $1,485,000.

2.. In accordance with the City of Petaluma Charter and~Muni'cipal Code, California Public
Contract Code Section 201°62 and other applicable' aw, waives any and all non-
conformance in the bid of FEDCO Construction, Inc. for the Auto Center Dr. Extension
to. Petaluma Blvd. North Project, and finds the bid of $557,391.:00 to be the lowest
responsive bid, and further finds that FEDCO Construction, Inc. is the lowest responsible
bidder.
3. Awards the contract for the Auto Center Dr. Extension to Petaluma Blvd. North Project
i to FEDCO Construction, Inc.., in the amount of $557,391.00, the amount of the lowest
responsive bid, and FEDCO Construction, Inc. timely executing the project contract and
submitting all required documents, including but.not limited to, executed bonds,
certificates of insurance., and endorsements, in accordance with the project bid
documents.
4. Directs staff to issue a notice of award to FEDCO Construction, Inc.
5. Authorizes and directs the City Manager to execute the project contract on behalf of the
City of Petaluma upon timely submission by FEDCO Construction, Inc. of the signed
project contract and all other required documents, including but not limited to, executed
bonds, certificates of insurance, and endorsements, in accordance with the project bid
documents.
