REC®MMENI)ATION It is recommended that the Petaluma Community Development Commission (PCDC) adopt the attached PCDC resolution approving the project budget, authorizing the award of contract, and ratifying execution of contract for'the Auto Center Drive Extension to Petaluma Blvd. North Project to FEDCO Construction, Inc. BACKGR®>[1ND On October 4, 2010, the City Council voted unanimously to approve a City Council agenda item awarding a contract for construction of the Auto Center Drive Extension to North Petaluma Blvd. to FEDCO Contractors, Inc., the lowest responsible bidder on the project. Because the contract bid documents specified a contract with the PCDC, rather than the City, it is recommended that the PCDC confirm the award of contract. via the attached resolution to correct that discrepancy. I)ISCUSSI®N The Auto Center Extension Project is included in the FY 2011 Budget as a PCDC project. PCDC has made the necessary findings and authorized use of PCDC funds. The property rights for this project will be needed beyond the life of the construction project. Accordingly, the property rights needed for this project were approved by the City Council. As a PCDC project, however, the project must be approved by the PCDC rather than by the City Council. Through an oversight, these PCDC approvals were not sought on October 4, 2010. This PCDC resolution is a duplication of the City resolution passed on October 4, with the slight change that it ratifies, rather than authorizes, the execution of the construction contract which has already been signed in order to meet the extremely tight project schedule. Agenda Review: City Attorney Finance Director ~ City Manager FINANCIAL., IMPACTS This action is the same as the October 4th action previously passed; there are no changes to the financial impacts. Current Construction Change Order (CCO) policy requires the City Manager to advise the Council by memorandum when 80% of the construction contingency has been expended. It was stated by staff at the October 4 Council meeting that Council will be notified when 80% of the contingency amount approved in the FY 2011 Budget ($132,000) has been expended, rather than the larger contingency amount approved at that meeting. It should also be noted that project funding can only be spent on the specific project for which it was approved and that any CCO that changes the scope of work must be approved by Council. Also note that at project completion, excess funding will be returned to the originating funds or redirected by Council action. ATTACLLMENTS 1. Auto Center Drive Extension to Petaluma Blvd. North, Project 053101002, Bid Documents. 2 PCDC RESOLUTION APPROVING T>E-IE PROJECT BUDGET, AUTHORIZING AWARD OF CONTRACT, AND RATIFYING EXECUTION OF CONTRACT FOR THE AUTO CENTER DR. EXTENSION TO PETALUMA BLVD. NORTH PROJECT TO FEIDCO CONSTRUCTION, INC. WHEREAS, Petaluma Community Development Commission (PCDC) staff, through a retained consultant, prepared construction bid documents and advertised for construction of the Auto Center Drive Extension to Petaluma Blvd. North Project ("Project"); and WHEREAS, in accordance with California Public Contract Code Section 20688.2 and other applicable law, PCDC staff solicited bids for the Project; and WHEREAS, the Project. was bid on September 29, 2010, and eight bids were received and opened in accordance with applicable law; and WHEREAS, the lowest bid for the Project was from FEDCO Construction, Inc. for $557,391; and WHEREAS, staff has determined that the FEDCO Construction, Inc. bid satisfies the bidding requirements for the Project; and WHEREAS, staff has verified that FEDCO Construction, Inc. possesses a valid California Contractor's License, Class A, No. 479227 that qualifies FEDCO Construction, Inc. to perform the Project; and WHEREAS, the Project is categorically exempt from the California Environmental Quality Act ("CEQA") pursuant to the Notice of Exemption posted for the project on May 18, 2009 and Article 19, Section 15303, of Title 14 ofthe California Code of Regulations (CEQA Guidelines). NOW, THEREFORE, BE IT RESOLVED that the Petaluma Community Development Commission hereby: „? ~ ~. 1. Approves the Project Budget in the amount of $1,485,000. 2. In accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20688.2 and other applicable law, waives any and all non- conformance in the bid of FEDCO Construction, Inc. for the Auto Center Dr. Extension to Petaluma Blvd. North Project, and finds the bid of $557,391 to be the lowest responsive bid, and .further finds that FEDCO Construction, Inc. is the lowest responsible bidder. 3. Awards the contract for the Auto Center Dr. Extension to'Petaluma Blvd. North Project to FEDCO Construction, Inc.; in the amount of $557',391, the amount of the lowest responsive bid, upon FEDCO Construction, Inc. timely executing the project contract and submitting all required documents, including but notlmted to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents. 4. Directs staff to issue a notice of award to FEDCO Construction, Inc. 5. Authorizes and directs the Executive Director to ratify the project contract which was executed as of October. 7, 20.10, after receiving from. FEDCO Construction, Inc. the signed project contract and all. other required documents, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents. 1532129.1 4
