RATIFYING RESOLUTION N0.2001-24 N.C.S. AND THE CITY COUNCIL'S
JANUARY 22, 2001 APPROVAL OF THE ELEVENTH AMENDED
AGREEMENT FOR WATER SUPPLY BY AND BETWEEN
SONOIVIA. COUNTY WATER AGENCY, CITY OF COTATI,
CITY OF PETALUMA, CITY OF RQHNERT PARK,
CITY OF SANTA ROSA, .FORESTVILLE WATER DISTRICT,
NQRTH.IVIARIN WATER DISTRICT,
VALLEY OF THE'MOON WATER DISTRICT,
CITY OF SONOMA AND DIRECTING`-THE CITY CLERK TO FILE A
NOTICE OF DETERMINATION
WHEREAS, the City Council at public meetings on January 10, 2000, April 2~4, 2000, July 24,
2000, July 31, 2000, August 21, 2000, August 29, 2Q00; `Novemb'er 20, 2000 and January 22, 2001
discussed the Eleventh Amended Agreerrment for Water Supply (Amendment 11); and
WHEREAS, Amendment 11 will implementTthe Water Supply and Transmission System Project
proposed by the Sonoma County Water Agency (Agency); and
WHEREAS, Amendment 11 obligates the Agency to take the following actions that are all to
the benefit of the City of Petaluma:
"1) Construct or acquire additions to.the existing transmissio~~ system sufficient to meet
increased delivery en,titlernents established by the agreement to eiza.ble it to reliably
deliver to each of the water contractors such- entitlements and to make 'the deliveries
authorized to be n~iade to Maria Municipal by the dgreernent;
2) Construct additional Russian River water production facilities (up to a total capacity of
16$.9 ingd) so that the total water production capacity available at all times is not less
thdn the avey-agedaily delivery to the regularcustomers and Maria Municipal (excluding
surplus water and water in excess of entitlements) during the month of highest historical
use plus 20 nagd;
3) Construct emergency wells with capacities which are from time to tune determined by the
Water Aduisory Conirnittee;
4) Construct additional facilities (up to a total capacity of 174.3 million gallons) to the
extent necessary to maintain a quantity of water in storage equal to 1.5 times the average
daily delivery to the regular customers except North Maria during the month of highest
historical, use; a~~ad
S) Replace existing facilities a-zd construct additional facilities, related buildings and
appurtenances- cis necessary to insure the reliable and efficient operation of the
transmiss~ioii system and to insure that the quality of the water delivered complies witl2 all
applicable state arad federal water quality requirements "; and
WHEREAS, the Agency, in order to implement the Water Supply and
Transmission System Project, has requested that the Agency's water supply contractors
approve execution of Amendment 11, and in response to said request the City Council of
Petaluma, acting as a Responsible Agency pursuant to CEQA and the State CEQA
Guidelines, has considered the environmental effects of said project, as disclosed in the
Final EIR prepared by the Agency for the Water Supply and Transmission System
Project, in connection with the City's consideration of Amendment 11, as well as all
findings made by the Agency related to said Project; and
WHEREAS, on January 22, 2001, the City Council conducted a public hearing
and approved Amendment 11; and
WHEREAS, on Apri12, 2001, the City Council adopted Resolution No. 2001-Qg0 N C S
Adopting Findings and Determinations In Accordance With the California Environmental
Quality Act Relating to the Eleventh Amended Agreement for Water Supply
(Amendment 11).
NOW THEREFORE BE IT RESOLVED, that the City Council, after
considering the environmental analysis, and the public testimony, and all comments and
evidence, written and oral, makes the following findi-n~gs:
1. Amendment 11 has been analyzed under CEQA in the Environmental
Impact Report certified by the Agency in November 1.998 and in further environmental
analysis with accompanying findings adopted by the Agency in August 2000; and
2. The City Council undertakes~a new and independent action ratifying
Resolution 2001-24 and each of the findings and determinations set forth therein, and that
this ratification is based on the environmental approvals set forth in Resolution 2001-080.
3. The City Clerk is hereby authorized and directed to file, with the Sonoma
County Clerk, a Notice of Determination regarding. the approval of and authorization to
execute Amendment 11, in accordance with CEQA .and the State CEQA Guidelines.
