HomeMy WebLinkAboutStaff Report 5.A 07/06/2015z8�a DATE: July 6, 2015 Agenda Item #5.A TO: Honorable Mayor and Members of the City Co 1 through City Manager FROM: Dianne Dinsmore, Human Resources Director SUBJECT: Resolution Ratifying The Tentative Agreement Executed By The Duly Authorized Representatives Of The City Of Petaluma And American Federation of State, County and Municipal Employees Local 675 Unit 1 Confidential, Unit 2 Maintenance, and Unit 3 Clerical Technical RECOMMENDATION It is recommended that the City Council adopt the Resolution Ratifying The Tentative Agreement Executed By The Duly Authorized Representatives Of The City Of Petaluma And American Federation of State, County and Municipal Employees (AFSCME) Local 675 Unit 1 Confidential, Unit 2 Maintenance, and Unit 3 Clerical /Technical. BACKGROUND Section 1.3 of the AFSCME Memoranda of Understanding (MOUs) for Units 1, 2, and 3 effective January 1, 2012 — December 31, 2015 provides for a wage reopener for purposes of a potential salary adjustment. This action ratifies the Tentative Agreement reached by the parties. DISCUSSION The City and AFSCME met over a period of nearly twelve months in contract re- opener negotiations for the sole purpose of discussing whether a salary adjustment (increase or decrease) may take place effective for fiscal years 2014 -15 and 2015 -16. The only item subject to the contract re- opener is potential salary adjustments in each of the fiscal years. The parties have reached a Tentative Agreement. If ratified by the City Council, all AFSCME - represented positions will receive a 3% base wage increase effective the pay period beginning July 6, 2015. This single 3% base wage increase resolves both the FY 2014/2015 and FY 2015/16 wage re- openers and is not retroactive. The salary tables effective July 6, 2015 may be found in Attachment 3. FINANCIAL IMPACTS The unadjusted cost for the 3% increase is approximately $102,400 to the General Fund, and approximately $293,000 in other funds. Total cost of the increase is approximately $395,400 in all funds. The increase is off -set as described below, resulting in a net increase to the General Fund of $12,335 and $34,740 to other Funds as a result of the agreement, for a total net increase of approximately $47,400 in all funds. In the subject MOU's covering all AFSCME represented positions, the amount of the City's contribution for health premiums for current employees and their covered family members are capped at the contribution levels in effect as of January 1, 2015. In the long -term financial forecast, the City currently assumes a 9% increase in City cost each year. Therefore, the medical benefit cap on costs as of January 1, 2015, results in a forecasted budget savings of $90,000 in the General Fund and $258,000 in other funds, which substantially offsets the $395,400 cost for wage increases. Accounting for the savings in the long -term financial forecast, the net increase is approximately $47,400, in all funds. ATTACHMENTS 1. Attachment 1— Resolution 2. Exhibit A — Tentative Agreement 3. Exhibit B — Salary Tables 2 ATTACHMENT 1 RESOLUTION RATIFYING THE TENTATIVE AGREEMENT EXECUTED BY THE DULY AUTHORIZED REPRESENTATIVES OF THE CITY OF PETALUMA AND AMERICAN FEDERATION OF STATE, COUNTY AND MUNICIPAL EMPLOYEES LOCAL 675 UNIT 1 CONFIDENTIAL, UNIT 2 MAINTENANCE, AND UNIT 3 CLERICAL TECHNICAL WHEREAS, the City of Petaluma, through its duly authorized representatives, and the American Federation of State, County and Municipal Employees (AFSCME) Local 675, through its duly authorized representatives, have concluded their mutual obligation to meet and confer in good faith with respect to the wage re- opener provided by Section 1.3 of the AFSCME Memoranda of Understanding (MOUs) for Units 1, 2, and 3, effective January 1, 2012 — December 31, 2015, in accordance with the Meyers - Milias -Brown Act and the City's Employer - Employee Relations, Rules and Regulations (Resolution No. 55412 N.C.S.); and WHEREAS, the duly authorized representatives of the City and the AFSCME have executed this Tentative Agreement pursuant to Section 15, Resolution No. 5512 N.C.S. and recommend its approval by the City Council; and WHEREAS, the City Manager, pursuant to Section 28 of the Charter of the City of Petaluma, and as the City's Municipal Employees' Relations Officer (Resolution No. 5375 N.C.S.), is required and empowered to make a recommendation to the City Council on matters related to employees' compensation; and WHEREAS, the City Manager has reviewed and concurs with said Tentative Agreement for Unit 1, 2 and 3 and does recommend that the City Council ratify said Memoranda of Understanding. NOW, THEREFORE, BE IT RESOLVED that the Tentative Agreement, being in the best interests of the City of Petaluma, is ratified and the terms and conditions of said Tentative Agreement, attached to and incorporated as Exhibit A, shall be effective July 6, 2015. 3 EXHIBIT A TENTATIVE AGREEMENT Tentative Agreement between American Federation of State, County and Municipal Employees (AFSCME) Local 675 and the City of Petaluma Having met and conferred in good faith on the Wage Re- Openers provided in Section 1.3 of the AFSCME Memoranda of Understanding (MOUs) for Units 1, 2, and 3 effective January 1, 2012 — December 31, 2015, and in accordance with the Meyers - Milias -Brown Act and the City's Employer- Employee Relations, Rules and Regulations (Resolution No. 55412 N.C.S.), the parties agree as follows: 3% base wage increase effective the pay period beginning July 6, 2015. This single 3% base wage increase resolves both the FY 2014/2015 and FY 2015/16 wage re- openers in Section 1.3 of the MOUs dated January 1, 2012 through December 31, 2015 for units 1, 2, and 3. There is no separate wage increase for each of the 2014/2015 and 2015/2016 fiscal years, there is only one wage increase, and the wage increase is effective July 6, 2015 and is not retroactive. The wage increase effective July 6, 2015 is conditioned on the AFSCME- approved agreement on the wage re- openers being included on the July 6, 2015 City Council meeting agenda for City Council action. For the MOU to be included on the July 6, 2015 City Council Meeting agenda, AFSCME must provide Human Resources Director Dianne Dinsmore final vote results on the wage reopener proposal no later than 5:00 p.m. June 29, 2015. This Tentative Agreement does not include any other sections of the MOU or any other wages, terms or conditions of employment.
