HomeMy WebLinkAboutResolution 2001-083C N.C.S. 04/16/2001Resolution No. 2001-083C N.C.S. of the City of Petaluma, California FINDING THAT THE PROVISION OF LOW AND MODERATE INCOME HOUSING BOTH INSIDE AND OUTSIDE OF THE AMENDED CENTRAL BUSINESS DISTRICT REDEVELOPMENT PROJECT AREA IS OF BENEFIT TO THE CENTRAL BUSINESS DISTRICT REDEVELOPMENT'PROJECT AS AMENDED WHEREAS, the City Council of the City of Petaluma is in the process of adopting a Second Amendment to the Redevelopment Plan for the Central Business District Redevelopment Project Area to add territory to the Project Area (the "Project Area"); and WHEREAS, Section 33334.2 of the California Community Redevelopment Law (Health and Safety Code Section 33000 et seq.) requires that not less than twenty percent (20%) of all taxes so allocated be used by the Petaluma Community Development Commission (the "PCDC") for the purpose of increasing and improving the community's supply of low and moderate income housing (the community being defined in the Community Redevelopment Law as the City of Petaluma); and WHEREAS, Section 33334.2(g) of the California Community Redevelopment Law provides that the PCDC may use such funds outside the Project Area if a finding is made by resolution of the PCDC and the City Council of the City of Petaluma that such use will be of benefit to the Project; and WHEREAS, The State Legislature has found that the provision of affordable housing. by redevelopment agencies is of particular benefit and assistance to the community. NOW, THEREFORE, the City Council of the City of Petaluma does hereby resolve as follows: Section 1. The use of taxes allocated from the Amended Project Area for the purpose of increasing and improving the community's supply of low and moderate income housing outside the Project Area and within the City of Petaluma will be of benefit to the entire Project Area pursuant to the State Legislature's finding that the provision of affordable housing is of particular benefit and assistance to the community. Under the power and authority conferred upon this Council by the Charter of said City REFERENCE:.
