RECOMMENDATION It is recommended that the City Council adopt the attached Resolution Authorizing the Award of Contract for the East Washington Park Multi -Use Pathway Project to Team Ghilotti, Inc. BACKGROUND The environmental document for the Petaluma Community Sports Fields identified the need to construct a new pathway to connect the existing sidewalk on East Washington from west of the airport at Sky Ranch Drive to the pathway at the new Petaluma Community Sports Fields. The project includes an 8 to 10 -foot wide concrete pathway, Americans with Disability Act (ADA) compliant curb ramps, street lighting, split rail fencing, and pavement striping and markings. A retaining wall, road signs, sign posts, grading, landscaping, and grinding and replacing 2- inches of asphalt concrete are also included. The project location is shown on Attachment 2. The bid included a Bid Alternate to install split rail fencing along the existing pathway at Petaluma Community Sports Fields that was previously eliminated from the East Washington Park — Phase 1 project. The City was awarded Transportation Development Act (TDA) funding from the Metropolitan Transportation Commission (MTC). The TDA grant was accepted by the City Council on April 7, 2014. DISCUSSION Staff designed, compiled contract documents, and issued a Notice Inviting Bids on June 4, 2015. Forde Associates Richmond $385,633.00 $7,200.00 $392,833.00 Engineer's Estimate N/A $374,100.00 $12,000.00 $386,100.00 The apparent low bidder, Team Ghilotti, Inc., came in below the Engineer's estimate by approximately $48,000. Staff verified that Team Ghilotti, Inc. possesses a valid Class A California Contractor's License, number 895384, which qualifies Team Ghilotti, Inc. to perform the work. It is recommended that the City Council authorize the City Manager to execute a contract for the East Washington Park Multi -Use Pathway Project with the apparent low bidder, Team Ghilotti, Inc., and to include the bid alternate. Construction is tentatively set to begin in September 2015, and is expected to last approximately fifty working days. It is anticipated that construction management and inspection services will be conducted by City staff. The proposed action meets Council goal: "Plan for and implement priority capital projects as funding permits." ATTACHMENTS 1. Resolution 2. Location Map 2 Attachment 1 RESOLUTION AUTHORIZING AWARD OF CONTRACT FOR THE EAST WASHINGTON PARK MULTI -USE PATHWAY PROJECT TO TEAM GHILOTTI, INC. WHEREAS, City staff has prepared construction bid documents and advertised for construction of this Project; and WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162 and other applicable law, City staff solicited bids for the Project; and WHEREAS, the Project was bid on June 17, 2015, and three bids were received and opened in accordance with applicable law; and WHEREAS, the lowest bid for the Project was from Team Ghilotti, Inc., for $337,833.25; and WHEREAS, staff has determined that Team Ghilotti, Inc. submitted a responsive and responsible bid and satisfies the bidding requirements for the Project; and WHEREAS, staff has verified that Team Ghilotti, Inc. possesses a valid California Contractor's License, Class A, number 895384 that qualifies Team Ghilotti, Inc. to perform the Project; and WHEREAS, the Project has a Categorical Exemption pursuant to the California Environmental Quality Act ( "CEQA ") pursuant to Article 19, Section 15301, of Title 14 of the California Code of Regulations ( "CEQA Guidelines "). NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Petaluma hereby: 1. In accordance with the City of Petaluma Charter and Municipal Code, California Public. Contract Code Section 20162 and other applicable law, waives any and all non - conformance in the bid of Team Ghilotti, Inc. for the East Washington Park Multi -Use Pathway Project; Project Number C14501403, and finds the bid of $337,833.25 to be the lowest responsive bid, and further finds that Team Ghilotti, Inc. is the lowest responsible bidder, and 2. Awards the contract for the East Washington Park Multi -Use Pathway Project, Project Number C14501403, to Team Ghilotti, Inc. in the amount of $337,833.25, conditioned on Team Ghilotti, Inc. timely executing the project contract and submitting all required documents, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents, and 9 3. Directs staff to issue a notice of award to Team Ghilotti, Inc., and 4.
