HomeMy WebLinkAboutAgenda Bill 2.B 11/15/2010DATE: November 1.5, 2010 TO: Honorable Mayor and Members of the City Council through City Manager FROM: Pamala Stephens, Human Resources, Manager SUBJECT: Resolution Requesting the CalPERS Board of Administration Approve an Employment Extension for Temporary Employment of Interim Department Director Pamela Tuft for FY 2010 2011, Pursuant to Government Code Section 21221(h). RECOMMENDATION It is recommended that the City Council adopt the attached Resolution Requesting Employment Extension for Interim Department Director Pamela Tuft Pursuant to Government Code Section 21221(h). BACKGROUND CAPERS limits the number of hours a retired member may work to 960 in a fiscal year. Government Code Section 21221(h) permits an employer to request the CalPERS Board of Administration to approve an extension of an appointment beyond the 960 -hour limit. However, if approved, the retired member cannot be employed in the position more than twelve months. DISCUSSION The City Manager appointed Pamela Tuft, who is retired in CalPERS, to the position of Interim Department Director effective April 14, 2010 and reappointed her effective the new fiscal year, July 1, 2010. The City is aware of Government Code Section 21221(h) which permits the City to request an employment extension from the CaIPERS Board of Administration. It is estimated that Ms. Tuft will: reach her 960 -hour maximum allowed by CalPERS for temporary employment during the.fiscal year on or about November 19, 2010. Ms. Tuft possesses the necessary and specialized skills to serve in the position of Interim Department Director overseeing the Water Resources and Conservation Department. The City Manager is currently considering options for departmental organization, including filling the interim with a permanent position. Filling the position will;necessitate a recruitment which will not be initiated until later this, or early next year. In the meantime Ms. Tuft's experience leadership is needed until an appointment is made. Therefore, it is requested that the City Council adopt this resolution and request the CalPERS Board of Administration:allow Ms. Tuft to exceed the 960 -hour maximum and approve an Agenda Review: City Attorney "`' Finance Director City Manager `/ extension in accordance with Government Code Section 21221(h) for the temporary employment in the position of Interim Department Director for FY 2010 -2011. FINANCIAL IMPACT There is no financial impact as a result of this action. ATTACHMENTS Resolution Resolution No. 2010 -XX N.C.S. of the City of Petaluma, California REQUESTING EMPLOYMENT EXTENSION FOR INTERIM DEPARTMENT DIRECTOR PAMELA TUFT, PURSUANT TO GOVERNMENT CODE SECTION 21221 (h) WHEREAS; Pamela Tuft retired from the City of Petaluma in the position of Director of General Plan, effective July 5, 2008; and WHEREAS, City Manager John C. Brown appointed Pamela Tuft pursuant to Government Code section 21224 to the position of Interim Department Director overseeing the Water Resources and Conservation Department, a position deemed to be of limited duration and requiring specialized skills, effective April 14, 2010 and reappointed her to the position effective July 1, 2010; and WHEREAS, City Manager John C. Brown understood and was aware that Pamela Tuft was subject to a 960 -hour maximum as a retired member in the California Public Employees' Retirement System at the time of her appointment and would reach her 960 -hour maximum on or about November 19, 2010; and WHEREAS, Pamela Tuft is expected to reach her 960 -hour maximum allowed by the California Public Employees' Retirement System for temporary employment during the fiscal year on or about November 19,.20 10; and WHEREAS, Pamela Tuft possesses the necessary and specialized skills as a Interim Department Director overseeing the Water Resources and Conservation Department and has experience in municipal department and project management at the City of Petaluma; and WHEREAS, the City of Petaluma plans to conduct recruitment for the position of Director of Water Resources and Conservation in the spring of 2011 and needs the expertise of Pamela Tuft until a replacement can be appointed, and WHEREAS, Ms. Tuft is subject to a 960 -hour maximum as a retired member in the California Public Employees' Retirement System; and WHEREAS, Ms Tuft is expected to reach her maximum of 960 hours for fiscal year 2010- 2011 on or, about November 19, 2010, and additional work beyond those hours will be required to fulfill the duties of Interim Department Director overseeing the Water Resources and Conservation Department until a successful recruitment can be completed and a permanent Director of Water Resources and Conservation retained; and WHEREAS, Government Code section 21221(h) permits continued employment in excess -of 960 hours 'in a fiscal year, if the City requests and the California Public Employees' Retirement System grants approval therefore; and WHEREAS, this resolution will be presented to the California Public Employees' Retirement System before the expiration of Ms. Tuft's 960 -hour maximum for the present fiscal year. 3 NOW, 'THEREFOR, BE IT RESOLVED by the City Council of the City of Petaluma that: 1. The California. Public Employees' Retirement System Board of Administrators is hereby requested to approve an extension of the temporary employment of Pamela Tuft effective July 1, 20.10 through June 30, 2011, for a total period not exceeding twelve months from her appointment, in.accordance with Government Code Section. 2122 1 (h); and 2. The City Manager shall-immediately transmit this resolution and request to the California Public Employees' Retirement System Board of Administration. y
