HomeMy WebLinkAboutAgenda Bill 3.E 12/06/2010Age*�Item # 3.E DATE: December 6, 2010 TO: Honorable Mayor and Members of the City Council through City Manager FROM: Vincent Marengo, Director of Public Work SUBJECT: Resolution Accepting Completion of the Construction Contract for the Crinella Drive Reconstruction Project RECOMMENDATION It is recommended that the City Council adopt the attached resolution accepting completion of the construction contract for the Crinella Drive Reconstruction.Project. BACKGROUND Proposition 1 B provided $19.925 billion in bond.funds for a variety of transportation priorities, including.$2 billion for cities and counties to fund the maintenance and improvement of local transportation facilities. As determined by the State Controller's Office, the City of Petaluma's appropriation totaled $1,764,064 in Prop 1B funding. Funding was broken out into two different allocation years: 2007 -08 ($916,741.85) and 2008 -09 ($847,322.03). In order to receive either allocation, the City had to submit a planned use to the State Department of Finance for approval prior to disbursement of the funds. On April 7, 2008, City Council approved the $916,741.85, 200.7 -08 Proposition 1 B allocation for the reconstruction of Crinella Drive, from McGregor. Avenue. to Bungalow Lane. The initial estimates for the project were derived from a visual inspection of the roadway, as well as from the original record drawings dating back to the early 70's. The expected road work was to remove and replace the existing asphalt, but not the existing base or sub -base, which was assumed to be 'adequate. As part. of a thorough design, staff required the consultant to conduct a full geotechnical investigation, including borings at six locations within project limits The geotechnical study concluded that the pavement design used 'to estimate the construction costihad not been adequate, and recommended more extensive (deeper) reconstruction of the roadway. On December 15, 2008,'City'Council approved the use of the 2008 -09 Prop 1B allocation for the Crinella Drive Reconstruction Project, in order to cover the increased costs due to the need for an expanded scope of work (full reconstruction of the roadway). A consultant prepared plans and specifications for this project. Bids were opened on July 13, 2009, and on August 3, 2009, the City Council awarded the construction contract to North Bay Agenda Review: -->�:,., City Attome Q Finance Dire City Manag A Construction; Inc ( "Contractor "). The Contractor has satisfactorily completed the construction contract for :$878,919:67. The estimated total cost of the,project, including construction contract, construction management and inspection, design administration, and overhead is $1,178,202.26. Per contract requirements, retention will be-rel'eased within sixty days after Council acceptance of this project. DISCUSSION Staff recommends accepting completion of the construction contract, since the Contractor has fulfilled all contract requirements. Approval of this resolution will assure release of retention. FINANCIAL IMPACTS The State Department of Finance approved the City's planned use of Prop. 113 funds for this project and has deposited a total of $1,764,064 directly into a City. - designated account. The Prop 1 B funds do not require a local match. After closeout of this project; the remainder of the allocated $1,140,000 Prop 1 B funds can be used by the City, provided ;it passes a future resolution for a new planned use of the funds and receives approval from the State. The remaining Prop 1 B funding must be expended by June 2012. X It should be noted that a portion of Contract Change Order #5 included necessary work to replace an aged and damaged storm drain inlet at a cost of $6;348. This cost will be reimbursed by the Water Resources and Conservation Department to the originating Gas Tax fund. No Proposition 1 B money will be used to pay for this work. ATTACHMENTS 1. C00501108 WHEREAS, in accordance with Section 68 of Article X of the City of Petaluma Charter, Section 20162 of the California Public Contract Code and other applicable law, the City of Petaluma solicited bids for the Crinella Drive Reconstruction Project ( "Project "), and WHEREAS, bids for the Project were opened on July 13, 2009 in accordance with California Public Contract Code Section 4104.5 and other applicable law; and WHEREAS, the apparent low bid for the Project was the bid of North Bay Construction, Inc. in the amount of $764,294.72; and WHEREAS, by Resolution No. 2009 -127, adopted on August 3, 2009, the City Council of the City of Petaluma found the bid of $764,294.72 for the Project to be the lowest responsive bid and awarded the Project to North Bay Construction, Inc. in the amount of $764,294.72, conditioned on North Bay Construction, Inc. timely executing the Project contract and submitting all required documents, and authorized and directed the City Manager to sign the Project contract on behalf of the City, upon such timely submission, and to execute on behalf of the City any change orders and other amendments to the Project contractthat are necessary to effectively complete the project and/or to realize the Project and/or cost benefits for the City so long as such change orders or amendments do not result in an increase in excess of $114,644; and WHEREAS, the following contract change orders (CCO) affecting the Project amount have been approved: Chanize Order No. Description _ -.._. _.
