REPORT OUT OF CLOSED SESSION (ACTIONS TAKEN) None. 1. NEW BUSINESS A. Presentation by Sonoma County Water Agency (SCWA) on Water Rates and Direction to Council Liaison for the Sonoma County Water Advisory Committee (WAC). Michael Gossman, Division Manager - Administrative Services, Sonoma County Water Agency.(SCWA), Santa Rosa, gave the presentation. Council Member Healy requested direction from the Council direction on behalf of the City of Petaluma City Council to return to the Sonoma County Water Advisory Committee and clarified that this item would not be considered an amendment to the structured agreement. Mayor Glass informed the Council the he was comfortable with this presentation. All seven Council members expressed their support for the item as presented. Mayor Glass opened Public Comment on Item I.A. Seeing no persons wishing Jo speak, Mayor Glass closed Public Comment on Item I.A. 2. WORKSHOP A. California Public Employees' Retirement System Benefits. (Mushallo) Finance Director Bill Mushallo introduced John Bartel, who presented background information on CalPERS, as well as defining benefits and pension plans Council Member King inquired about the Final Average Earning (FAE) and any other factors that are considered in establishing the FAE. Council Member Kearney further inquired about FAE components. Council Member King inquired about the annual average rate of return. Council Member Healy inquired about Market Asset value. Council Member Albertson inquired about the new market value assets and valuation on our future budgets. Mayor Glass asked that the report highlight that the City of Petaluma does not pay any portion of the member contribution and did not move to an enhanced formula when other agencies did so. Council Member Albertson confirmed the Mayor's comment reference City employees paying their share of their contribution. General Fund Reserve Policy. (Mushallo) City Manager Brown asked Council to consider funding associated with new revenue sources. Council Member Healy requested this be displayed along with the full budget. City Manager Brown further discussed the four categories and informed the Council that the vehicle replacement was the biggest concern; comparing the difference with the OPEB and PERS liability. Council Member Kearney expressed support for the vehicle replacement needs. Council Member Barrett cautioned the Council on future pressing needs that would come before the Council and urged the Council to stay with the current 15 % policy and build those reserves. Vice Mayor Miller requested the timeline to achieve the 15%. Mayor Glass asked that City Manager Brown clarify the allotment to the Stormwater Fund; requesting the City earmark some of these funds as needed, and look to restoring funding mechanisms and funds. City Manager Brown responded relating to the City's reserve policy to access and return funds to a source. Council Member Albertson agreed with Council Member Barrett, and requested the General Fund Reserve Account continue to grow, and that the General Fund prioritize vehicle replacement and other items. Council Member King requested the current amount of reserves and related financial risks if reserves were lowered. (Caluha 30 Barnes) 31 32 Caluha Barnes, Sonoma County Law Enforcement Task Force 33 34 Mayor Glass 35 36 Council Member King 37 38 Council Member Albertson 39 40 Ms. Barnes 41 42 Council Member Kearney 43 44 Council Member Healey 45 46 GENERAL PUBLIC COMMENT 47 48 Mayor Glass opened GENERAL PUBLIC COMMENT. 49 50 Magick, Justice Coalition for Andy Lopez, believes there is a need for an autonomous citizen law 51 enforcement oversight task force with subpoena and investigative powers. 52 Vol. 47, Page 334 April 6, 2015 1 2 Heelo Velasquez, Citizenship Class, Petaluma Adult School, thanked Council for their hospitality 3 and the opportunity to see the democratic process in action. 4 5 Janice Cader-Thompson, Petaluma, spoke of the need for developers and businesses to meet 6 and talk about water, and said it is unfair to expect residents to do all the water use reduction. 7 8 Tamara Miller, Petaluma, feels it important the public and the City Council hear the input of a 9 hydrogeologist on the current status of our wafer resources so that when water conservation 10 policies are put in place, they are based on our current situation. 11 12 Phylicia Sheean, Senior Assistance, LLC, Petaluma, asked Council's help in determining why her 13 business, which has relocated from San Rafael to Petaluma, has not been granted a business 14 license. 15 16 Susan Lamont, Justice Coalition for Andy Lopez and Peace & Justice Center of Sonoma County, 17 Santa Rosa, spoke regarding the culture of law enforcement. 18 19 Bryant Moynihan, Nexus Realty Group, Inc., Petaluma, said that historically, office use has been 20 a permitted use in industrial zoned parks but with updates to the zoning ordinance, there are 21 now many offices that are non -conforming, according to the Planning Department. When new 22 businesses come to occupy existing office space in buildings, they are being told they are not 23 permitted. He asked Council to amend the ordinance to indicate that office uses are a 24 permitted use in the industrial zoned parks in Table 4.4. 25 26 Zen Destiny, Petaluma, spoke of issues he had with members of the Petaluma Police Department 27 and other City staff. 28 29 Gregory, Slugocki, Director of Development, National Storage Tank, Inc., Santa Rosa, said that 30 recycled water should be used to mix concrete and to suppress dust on construction sites, and 31 offered his help in developing a program. 32 33 Arthur Deicke, EPS, Santa Rosa, believes that the emphasis should be on water conservation, 34 and not on a building moratorium. 35 36 Devika Goetschius, Petaluma, said she is encouraged that water issues will be discussed on April 37 27th and May 4th, and hopes that the Council will not move directly to a moratorium without a 38 deeper discussion. 39 40 Dan Calamuci, Researcher, Carpenters Local 751, Santa Rosa, asked that Council consider the 41 concerns of labor and the local construction industry as they move forward with water policies. 42 43 Katherine Bobrowski, Petaluma, spoke of problems at the mobile home park where she lives. 44 45 Jim Soules, Keller Court, LLC, Petaluma, would like to encourage a task force to consider 46 innovative solutions to the water shortage. He said he will be submitting a proposal to use on - 47 site, treated gray water for landscaping on the Keller Court Commons project. 48 49 Dmitri Rusov-Morningstar, Sustainable Residential Design, Santa Rosa, told Council he has clients 50 in Petaluma with projects that are currently in the permit process and he is worried that a 51 moratorium might means those projects would not be granted permits. Mayor Glass Dave Alden, Petaluma, said he is in favor of increased water conservation, and if a 45- or 90 -day moratorium is the best way to achieve that, he's fine with that, but if's time to build a sustainable community. Dawna Gallagher, Rohnert Park, Clean Water Sonoma -Marin, expressed opposition to fluoridation in the water, and requested Clean Water Sonoma -Marin be allotted time for a June City Council Meeting.
