SUBJECT: Resolution. Approving the Project Budget and. Authorizing Award of Contract
the E11's Creek Water Recycling Facility ADA Access Improvements Project to
Coastside. Concrete.
RECOMMENDATION
It is recommended that-the City Council adopt the attached resolution approving the project
budget and authorizing award of contract for the Ellis Creek Water'Recycling Facility ADA
(Americanwith Disabilities Act) Access Improvements Project to Coastside Concrete.
BACKGROUND
The,Ellis Creek Water.; Recycling Facility ADA Access Improvements Project involves installing
additional decomposed granite pathway and .ADA curb ramps to provide continuous ADA access
from the entrance gate at Cypress Drive to the = facility .administration building. Currently, access
- to the administration building*d'oes not meet ADA requirements. Water Resources &
Conservation Department staff prepared the bid documents, . and a Notice InvitingBids was,
issued on October 20, 2010. Nine bids were received on November 17, 2010, as follows:

City of Cloverdale, City of Novato and City of Sonoma in 2009 and'201.0.
IDISCUSSION
The Water.Recycling Facility project met all ADA requirements at the time of design and
through construction. Since the award of the construction project in 2005 the California safety
regulations regarding ADA have been modified. As a result of the modifications, updates to the
walkways are necessary to comply with current regulations.
Staff recommends authorizing the City Manager to enter into a contract with the low bidder,
Coastside Concrete, to provide ADA access improvements at the Ellis Creek Water Recycling
Facility.

The following is a breakdown of the, project budget:
Construction Contract (low bid) $60,703.00
Design $10,000.00
Construction Management & Inspection $12,000.00
Contingency $12,000.00
CIP Overhead $2,300.00
TOTAL: $97,003.00
The estimated total cost, including planning,.design, construction, administration, inspection,
testing and project contingency, is $97;003. ,The project is .funded by Ellis Creek Water
Recycling Facility Capital funds (6600- 66999 - 54140 - 000500402) in the amount of $97,003.

RESOLUTION APPROVING THE PROJECT BUDGET AND
AUTHORIZING THE AWARD TR
OF CONTRACT FOR THE ELLIS CREEK
WATER RECYCLING >F'ACILITY ADA ACCESS IMPROVEMEN`T'S PROJECT TO
COASTSIDE CONCRETE.
WHEREAS, City staff ias bid documents and advertised for
construction of this Project; and
WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code,
California Public Contract Code Section 20162 and other applicable law, City staff solicited bids
for the Project; and
WHEREAS, the Project was bid_ on November 17, 2010 and nine (9) bids were received
and opened in accordance with applicable law; and
WHEREAS, the lowest bid for the 'Project was from Coastside Concrete for $60,703;
and'
WHEREAS, staff has determined that Coastside Concrete's bid satisfies the bidding
requirements for the Project;, and
WHEREAS, staffhas verified that Coastside Concrete possesses a valid California
Contractor's License, Class A, number 908693 that qualifies Coastside Concrete to perform the
Project; sand
WHEREAS, the Project is exempt pursuant to California. Environmental. Quality Act
( "CEQA ") pursuant to "Title 14, the California Code of Regulations ( "CEQA Guidelines "),
Section 15301,, as the minor alteration of existing public facilities with negligible or no
expansion in use.

NOW T.HEREF.ORE, B .IT RESOLVED that the City.Cour cit,ofthe. City hereby:
1. Approves the Project Budget `in the amount of $97,003.
2. In accordance with the City of Petaluma Charter and Municipal Code, California Public
Contract Code Section 20 and other applicable.law, waives any and all non-
conformance in the bid of,Coastside Concrete for the Ellis Creek Water Recycling
Facility ADA Access.Irnprovements Project, finds'the bid of $60,703 to be the lowest,
responsive bid' and further finds that Coastside Concrete is the lowest responsible bidder.
3. Awards the contract for the Ellis Creek Water Recycling Facility ADA Access
Improvements Project to Coastside Concrete, in the amount of $60,703, the amount of the
lowest responsive bid, conditioned on Coastside Concrete timely executing the project
contract and submitting all required documents, .including but not limited to, executed
bonds, certificates of insurance; and endorsements, in accordance with the project bid
documents.
4. Directs staff to issue :a notice of award to Coastside Concrete.
5. Authorizes and directs the City Manager to execute the project contract on behalf of the
City of Petaluma upon timely submission by Coastside Concrete of the signed project
contract and all other required documents, including.but not limited to, executed bonds,
certificates of insurance, and endorsements, in accordance with the project bid
documents.
