4 ORI9ERING THE VACATION ANI9 APPROVING THE SALE OF A PORTION OF
5 PAYRAN STREETRIGHT-OF-WAY AT OLID ELM VILLAGE, 359 WEST PAYRAN

9 WHEREAS, pursuant to Sections 8320 et seq. of the California Streets and Highways Code, the City
to Clerk of the City of Petaluma caused to be published and posted a Notice of Hearing on a request by
11 the owner of Old Elm Village, that the City Council vacate a portion of Payran Street right-of--way
12 along the frontage of 359 West Payran Street, hereinafter described; and

14 WHEREAS, said Council has, on September 5, 2000, held a public hearing for the purpose of
15 hearing the evidence of any person interested in or objecting to said proposed abandonment and
16 vacation; and

18 WHEREAS, said Council, having duly received and considered evidence concerning the
19 jurisdictional facts in this proceeding and finds from all the evidence submitted that the easement for
20 street purposes hereinafter described is unnecessary for present or prospective public street purposes,
21 and the said Council of the City of Petaluma having now acquired jurisdiction to order the proposed
22 abandonment and vacation;

24 WHEREAS, the Council of the City of Petaluma, pursuant to and in accordance with the authority
2s contained in Division 9, Part 3, Chapter 3 of the California Streets and Highways Code, that the
26 following real property for street purposes in said City be, and the same is hereby ordered vacated,
27 abandoned and forever closed to public use reserving therefrom easements for public utilities, public
28 water mains, public sanitary sewers, public storm drains and Sonoma County Water Agency water
1 transmission lines, and conditioned on receipt of the sum of $49,375, from Burbank Housing
2 Development Corporation as a purchase price for the underlying real property:

6 WHEREAS, that upon receipt of said purchase price, the City Clerk is directed to cause a certified
7 copy of this Resolution, attested by said Clerk under the seal of said City, to be recorded in the Office
8 of the Recorder of Sonoma County, California.

11 Manager is authorized and directed to execute such documents, in a form approved by the City
12 Attorney, as are necessary for the conveyance of the fee title in the property underlying the subject
13 right-of--way.
