CITY OF PETALUMA
HISTORIC AND CULTURAL PRESERVATION COMMITTEE
MAKING A FINDING OF SUBSTANTIAL CONFORMANCE WITH THE
APPROVED HISTORIC SITE PLAN AND ARCHITECTURAL REVIEW OF THE BREWSTER'S GARDEN
PROJECT LOCATED AT 238/242 PETALUMA BOULEVARD NORTH AND 275 WATER ST NORTH

WHEREAS, on May 26, 2015 the Historic and Cultural Preservation Committee held a duly noticed
public hearing and adopted Resolution No. 2015-01 approving Historic Site Plan and Architectural
Review to allow construction of Brewster's Garden restaurant and associated site improvements
located at 238/242 Petaluma Boulevard North and 275 Water St North (APNs 006-284-008, 010, and 029
plus 006-163-026); and
WHEREAS, the Brewster's Garden Project is required to provide public art at a cost of not less
than one percent of the construction costs, or to pay an lieu fee equal to that one percent, as required
by the IZO Section 18.040 and Resolution 2015-01; and
WHEREAS, as part of their deliberation at the duly noticed hearing on May 26, 2015, the Historic
and Cultural Preservation Committee encouraged the applicant to incorporate public art into the
project; and
WHEREAS, on August 3, 2015 the applicant submitted a proposal for onsite public art as part of
the Brewster's Garden Project for consideration by the Petaluma Public Art Committee; and
WHEREAS, on August 27, 2015, the Petaluma Public Art Committee approved Resolution 2015-02
determining that the proposed public art satisfies the requirements of Section 18.120 of the
Implementing Zoning Ordinance; and
WHEREAS, the Public Art Committee approved public art portal is expected to represent, along
with the roof -top garden and the recessed mezzanine windows, the defining feature of the Boulevard
elevation (while the entry portal reviewed by HCPC was a simple accent element), the Planning
Manager referred the new defining feature to the Historic and Cultural Preservation Committee for
substantial conformance review; and
WHEREAS, on September 22, 2105 the Historic and Cultural Preservation Committee held a duly
noticed public hearing to consider whether the on-site public art as approved by the Public Art
Committee is substantially consistent with the previously approved Historic Site Plan and Architectural
Review for the Brewster's Garden Project; and
NOW, THEREFORE, BE IT RESOLVED, the Historical and Cultural Preservation Committee finds
inclusion of the onsite public art as approved by the Public Art Committee to be in substantial
conformance with the May 26, 2015 Historic Site Plan and Architectural Review approval of the
Brewster's Garden restaurant project and Resolution 2015-01 based on the following:

I . Although the inclusion of the public art along the Petaluma Boulevard frontage results in a
new defining feature at the primary elevation, the modification does not change the key
aspects of the HCPC's analysis or the findings for approval as outlined in Resolution No. 2015-
01. Specifically, the modified elevation inclusive of the onsite tree form public art will
continue to be low and visually open and will maintain the following key aspects of the
approved project design:
a. The approved natural theme of the elevation along Petaluma Boulevard North created
by the roof garden, which highlights the surrounding natural elements of the Petaluma
River with its abutting trees, Sonoma Mountain beyond, and Penry Park above, and
b. Visibility to and a showcasing of abutting historic buildings and nearby Dairymen's Feed
grain towers across the river.
2. The project, with incorporation of onsite public art as approved by the Public Art Committee,
is compatible with the applicable regulations and guidelines of the Downtown Historic
Commercial District and the Section 15 (Historic Preservation) of the Implementing Zoning
Ordinance and satisfies Condition of Approval 1 of HCPC Resolution No, 2015-01. The
surrounding historical buildings continue to be visible through and around the art piece.
Furthermore, the theme of the approved art provides continuity with the immediately
surrounding natural environment (Penry Park, restaurant garden, Petaluma River, and
Sonoma Mountain beyond). The public art is to be largely constructed of metal and wood,
materials typical of the neighborhood, and shall be formed artistically together in a manner
that perpetuates the eclectic character of Petaluma and the surrounding neighborhood.
The proposed public art is distinct and differentiated from the historic surroundings (as
directed by the Secretary of the Interior Standards), yet its scale is less than the surrounding
historic architecture and its design compliments the surroundings. The proposed art is
reversible (as directed by the Secretary of the Interior Standards), in that it would not
physically harm adjacent resources.
