Summary Statement:
The Police Department is requesting street closures for the purpose of establishing special event
• perimeters for the annual Antique Faire. The Petaluma Antique!Dealers Association and the Petaluma
Antique Guild have both submitted applications for this.event Both applicants propose to sponsor the
event and would be responsible for, authorizing, street vendors for the event. The Petaluma Antique
Dealers Association has also requested that Western Avenue, between Petaluma Blvd. North and
Kentucky Street, be closed for the faire. The Police Department requests that Western remain open to
traffic. As a for-profit event, Council may wish not to waive City.fees`

1. EXECUTIVE SUMMARY:
The Petaluma Antique;'Dealers Association and the Petaluma Antique Guild have both submitted
applications to•sponsor the.annual Antique Faire on Sunday,,April,29, 2001. The Police Department is
recommending acceptance of the application submitted by the Petaluma Antique Dealers Association.

This is based upon the facfthat=the Petaluma Anti ue Dealers Association a
the Police Department on February•20, 2001,.and Petaluma>Antique Guild application was received on
February 23, 2001. Additionally, the Petaluma Antique. Dealers Association has ,signed into an
agreement with the Petaluma:Downtown-Association Oise the same food vendors at the Antique Faire-
that will be used at the Buttenand Egg Days Parade. ,

• Although it is not required as a condition of the permit, the:Petaluma.Antique Guild has submitted by-
laws and a list of antique dealers (74- seeking membership in the Petaluma Antique Guild. The
Petaluma Antique Dealers Association has not submitted by-lawsor a membership list.
The Police Department is• requesting street closures for the purpose of establishing special event
perimeters for this event. Street;closures will be as follows: for Sunday, April 29th Antique Faire:
Water Street Kentucky and 4th Streets from Washington Street to B Street;A Street.Parking Lot on 4th
between Western and B Streets: The;Petaluma Antique Dealers.Association has submitted a request in
their application for Western Avenue to be closed from Petaluma'Blvd: North to.Kentucky Street. The
Chief.of Police recommends Western Avenue remain open to vehicular traffic and barricades be'placed .
on Kentucky Street at Western,Avenue to assist with crowd control. This recommendation is due to
concerns from locals businesses•regardinglost.revenue when Western Avenue is closed.
Neither applicant wilbsubinit insurance documents until the resolution has been adopted.
Total cost to the City Citrof Petaluma is,estimated,to be $81 9:56: It is recommended the Council adopt the
resolution approving the street closures, but consider not waiving fees due to the nature of the event.

2. BACKGROUND:
The Annual Antique Faire on Sunday'is from.8`.00 a.m. until 7:00 p.m. This one-day event brings
thousands of people into-the downtown area In previous years, the Police Department has helped
•, facilitate this event by providing street"closures, traffic direction, and crowd control. Unauthorized
vendors have caused safety problems and have interfered with the event in past years.
3. ALTERNATIVES:
A) To accept Petaluma Antique Guild's application and deny Petaluma Antique Dealers
Association's application.
B) To allow Western Avenue,between,Petaluma Blvd. and Kentucky, in addition to all of the other. •
street;closures,be Closed to vehicular traffic.
C) To-not allow either event to take place: •
D) Not waive.fees<as requested.
4. FINANCIAL IMPACTS:.
The Antique Faire is estimated to cost the City$849.56. These costs are outlined in Attachment 1. The
"cost is not budgeted. Monies will come from accounts 001-400-2113-4120 and 001-400-3302-4120,
unless'City fees'Paid for by applicant

5. CONCLUSION:
In order for the:Antique-Faire to take place as planned, it is necessary that street"closures,take place as
listed. To insure a safe and orderly operation of this event, it is necessary that the Petaluma Antique
Dealers Associationtauthorize vendors in the special permit perimeters;;If the resolution is''approved,.the
Police Department will assume responsibility for street closures, traffic and crowd control: If the
resolution is not approved, the event will not take place as planned.
6. OUTCOMES.ORPERFORMANCE MEASUREMENTS.THAT WILL IDENTIFYSUCCESStR COMPLETION:
If approved, the Antique Faire will take place with minimum interruption to vehicular traffic and

businesses in the Downtown area.
7. RECOMMENDATION:
Approval of designated street closures as needed between 3:00 aim. and'7i00 p.m. on Sunday April 29,.

SUBJECT: Antique Faire

As you may be aware, we received a strenuous complaint about the;•recent;approval of the
Antique Fair occurring in September. Couches,Etc.,:at the corner of'Kentuckyand Western, is .
completely isolated from its customers during the Sundayevent. After,discussing the issue with •
Mile Thomas, owner of Couches,Etc.,-and with the organizer of the:event, it was determined
that the event would be allowed as approved. This was mainly due to the fact that numerous.
vendors for the Faire had already been confirmed and deposits paid.
I also spoke with Samantha at the Petaluma-Downtown Association regarding the events. It was
her opinion that many of the Merchants supported the event and benefited from the large number
of people the event brings downtown, especially eating places and motels (although food vendors
are a part of the event)..
Mike Thomas indicates that he could go along with closing;downtown one day a year for the
Antique Faire but objected to having the streets closed twice a year, especially since the event is
not in support of a non-profit or community group and is, in fact, a for-profit business unrelated
to any charity or historic "community event" such as the Butter•and Eggs Day Parade.
I also received a call from Petaluma Market concernedabout loss of parking and their need to
hire security to keep the parking lot clear on the day of the event. They also objected to the fact
that this event is approved twice a year with no real benefit:to'them.
The organizer of the-event indicated he would seek approval for another Faire in the spring so as
to iron out any problems way in advance of the event: He was a little upset that he had provided
the police his application in,May.and that•ittook until August to get the street closure to the
Council.
I think it would be appropriate for the Council to review the issue of street closures,for this type
of for-profit event. PDA should"confirm that they have the support•of their membership to
• continue all day street closures for this type of event. Additionally, this is the only event I know
of that takes place twice a year requiring street closure. By the way, this event use to be
associated with the River Festival in the summer and with the Butter and,Eggs`weekend in the
Antique Faire

Spring. It has grown'from a one-block closure of Kentucky from Washington to Western Ave to
a closure involving two blocks of Kentucky,A Street Parking Lot, and Water Street in addition
to Western,from Petaluma Boulevard to Keller Street.
Another issue here,is,that other street closures, such as for filming, usually do not include an all
day closure (not even the Butter and Eggs Day'Parade) and usually provide for some type of
compensation to any business•that is directly impacted financially by the activity. That is not the
case here:
To my knowledge,e, this is the first time the sponsors of the event have paid anything to offset the
costs associated with the street closures and'clean up. These, in the past, have been borne by the
City. Many of these vendors are from outside the City and I;am not sure sales tax is collected to
the City from the sales generated during this-event
The above issues are in addition to the issue of to affected business owners in the '
area that may not be aware of dates of these closures.
I would,hope that the.City and the Petaluma Downtown Association considers these issues when
future requests come before us.

WHEREAS, the Petaluma Antique Dealers Association will conduct the annual
Antique Faire on April 29, 2001 and has coordinated the details of the event with the
Petaluma Police Department; and
WHEREAS, the Petaluma Antique Dealers Association will be the authorized
sponsor of the special events including the authorization of street vendors within the
special event perimeter.
NOW, THEREFORE, BE IT RESOLVED that the Police Department is
authorized to close certain't.downtown_streets between the hours of 3:00 a.m. to 7:00 p.m.
on Sunday April 29;'2001, for the purpose of conducting an Antique Faire within the area
identified on the attached map:attached as Exhibit "B".

POLICE TRAFFIC CONTROL FEES; The ;Chief of:Police may assign overtime police
,officers to provide traffic control for your special event. You will be required to pre-pay the
estimated costs for the traffic control officers' time Police fees will be approximately$25 an
hour for each officer assigned, .but may be more/less depending on the rank of officer

(Authorized by Chapter 13.32 of the Petaluma:Ordinance Code)
INSTRUCTIONS: Comply with all conditions marked with an "X"
A. General Conditions
The permittee shall, ensure that the person leading a parade or other event along a
route, or the person in charge of any other event shall carry the special event permit
including a special event permit conditions.on'his person for the duration of the event.
The permittee shall ensurethat the-area used for the event is cleaned and restored to the
same condition as existed prior to the,event, immediately;following the completion of
the.event.
The permittee shall obtain a Petaluma&business license for the planned activity from the
Petaluma Finance Department.
wB. Barricades/Traffic Cones and Other Traffic Control Devices:
If barricades/trams cones'Or other'traffic control devices are. required for the event,
they can be rented from commercial sources, or,rented (subjecvto availability) from the
Public Works Department Corporation Yard located, at 840 Hopper Street.. Public
Works staff will need to know your special event permit application number listed on
the top of this sheet.

E. foot Races -
For foot races along city streets, the permittee shall ,provide written notification to
runners that they must stay to the right of traffic cones along the race route. Runners
are to be notified:to watch out for parked cars pulling away from curbs and driveways.
Traffic cones shall:be removed'immediately°after.the passage of the last runner past the
location'of'the cone.
F. Health. Sanitation and Safety
A first-aid station shall be provided at the event.

A minimum of one (portable)' toilet shall be provided at the event for every 100
estimated persons expected,to be"in.attendance>at the-event if the event shall last more
than three hours_ Facilities for washing hands and drinking•water shall also be
provided at the event
Parade floats and other decorated vehicles are subject;to inspection and approval for •
safety by.Petaluma, Fire and Police Department officials. The pertnittee shall comply
with all safety.instructions by those officials. .
The event site and all structures at the event are subject to inspection and approval by

Outdoor Antique Faire to raise funds for The'Butter and Egg Days,event. B&E is only responsible for the

they can be rented from commercial sources, or rented (subject to-availability) from the
Public Works Department Corporation Yard located at 840 Hopper Street. Public

F. Health Sanitation and-Safety

You must do the following before your Special Event Permit will be issued:
1. bazaar= You must obtain liability insurance for the special event. Liability
insurance for the event can be purchased.at reasonable;rates from the Parks and
Recreation Deparunent Office, 320 North McDowell Blvd., Petaluma. If your
organi7anon already possesses liability insurance, you can provide proof of
your insurance coverage along with an "endorsement" covering the City of
Petaluma, to the Risk Management, Office, City Hall. Proof of insurance
coverage must be filed with the Risk Management Office no later than five (5)
calendar days before your special event is scheduled unless time has been
• waived by the ponce requirements of Section 13.32.130 and the insurance
resolution which is attached to this Notice.

2. To advance the interest of the public in regard to antrques;and collectibles through advertising

ASSOCIATION BY-LAWS FOR AGP •
AGP shall operate under the rules thatthave?been adopted by_the members of the;association. The
AGP BY-LAWS have been developed by the membership and may be revised by the membership
with 60 days written-notice of a'‘meeting to change the and can be amended only by a 2/3:'s
vote of the membership.
The purpose of these rules is to give the members (current and future).the nglit to:vote on-decisions
related to the programs and activities of the association.
1. NAME: The name oldie association shall beAntique'Guild of Petaluma (also know as AGP)
2. MEMBERSHIP:
a. Membership is open to dealers with a resale license. A dealer is;defined•'as:a person
who holds of an active California resale license, whose emphasis of the store is antiques and
collectibles.
3. Non-members of AGP may not attend any meeting of AGP;.'This is not<a public or rather a
private organization.
4. Membership'may also be canceled by a(quorarn vote based on conduct,or other-attributes •
deemed negative to AGP by the membership.
5. A quorum is defined as,one-third of the voting membership in attendance at a meeting. No
absentee or"proxy"votes are allowed. Members must be present to vote.
6: Officers of AGP are to be elected by.written secret ballot;to,a one year term of office and,shall •
include: •
1. Chairperson
2. Secretary
3. Treasurer
7. :In,the event an officer is unable to complete his or her term, the Chairperson;shall appoint-a
replacement to fill the term of office until the next election.
8. FINANCES:
a. Association.expenses paid by check are to be signed by the Chairperson or the.
Treasurer. For amounts over$500:00 both;signatbre`s`are required. There Will`be an annual audit
of the books conductedby arf,independerit bookkeeper:

a. Meetings shall be held on an as.needed•basis,atsites arranged by the Chairperson with a
minimum of 5 days written notice to the members.
b. In the event of an emergency,notification will be by telephone.
10. PUBLICATIONS:
a. A directory of stores in the.Petaluma area is to be published annually or as deemed
necessary.
11. USE OF GENERAL FUNDS:
a. Any monies raised by the association are for the use of association--only.
b. AGP members and associate members are entitled the current discount rate on booth
rental at the semi-annual PetalumabOutdoorAntique Fairs.:

We are the newly formed Antique Dealers Association with approximately:72 members and 12
stores. We consist of and represent the largest base of dealers in Petaluma.. Our membership
makeup includes retail antique businesses that have been apart•of the street fair since it was,
founded. They are available and anxious to.share any support; and expertise to assist in presenting a •
successful event including Mr. Pat Easley who was coordinatorand founder of the street faire.

We would look to Mr. Easley to+manage the upcoming street fair since he has a solid history with
this event. We are well aware of the controversies of the past.It is our-intention to move beyond that
a to a healthy and strong organization that,is open ands supportive to;all•antique dealers. Our
membership is open to all retail antique dealeers. Meetings will be dully noticed and:open,to all
members. The organization will be holding'a,properly noticed'election of officers.
In order for this to become ayeality=itwas necessary to form a.-new organization. A committee
meeting was held and it was decided that a new and fresh start-was needed and that if the antique
dealers:as an association and theistreet'fair continued as it has this past year that it'surely would see
its demise.

The Petah:Mid Antique.Dealers Association wasrformed approximately fifteen=years ago and it`was
decided to hold.two street faliSta.yeatand that all income generated from"thesetetients wastto be
placed into tl eorganization''s bank account"to be used exclusively to advertiseand;market the
antique dealers and the street fair in the Historic Downtown and also.to pay the coordinator•for
managing of the street'fair...Many street fairs;were held with great success;and much advertising'was
done: '
The organization, according,to the Petaluma Visitors Program, worked closely withdhem to'tie.in
with;the:manytravel journals and Mar- ketirig:progranis that theyhad'te offer.
Approximately two years.ago, apparently a court o rder named Mr.George,Mattingly and'Ms. Patricia
Higgins as Presidents.or Heads;of the association. They were also given'controlof the bank
,account,
withmpproximately$24000.00'ofP.A.D.A.'S monies.
Subsequent street fairs;have generatedhapproximately$80,000 in revenues In spite of numerous
inquiries-from"anttque'dealers, there.has'been no accounting for any ofithese'funds.It appears,that>at 41"•
tliis,tiine„there isapproximately only $5,0001eft this account.
Inaddition.to there being no accounting for these,funds,.no election of officers has`been`held; and',
dealers have beenrefused;membership.'Consequently it appears that the",membership?"consists of

address these concerns. On September 29,2000 Mr.:Mattingly was hand delivered of a petition
signed by approximately 80aantiquedealers requestinga meeting be,called.and a deadline given of
November•3•to address these'issues. At This time, there has:been no response to'that request.
• We subsequently learned:that Mr..Mattingly,approached the=Petalunia'Downtown Association
• 'offering to sell'our organization to them for purported amount of$9,000. The'P.D.A. at that time
had no knowledge,thatanew association was being;formed nor that Mr: Mattingly right--to
"sell” it.
• Having grave:concerhs about,possible legal and criminal matters, and,inneed of their advice,;I;;and
other representatives;of antique shops, met_with:ChiefPat Parks and Lt. Dave Dohn, Petaluma Police
Dept..After receiving the above mentioned?information and,our request:for the permit; they told us
that we could,andshouldapplyfor the,permit. We were given:a.list:of what needed'to be done. In

that decisi nwasmade he wano.s nd out any aPP h tions-for dealer sp ces oeceive
payments'from•apphcants for the streetfair booths. This.orderhas.been ignored;and Mr: Mattingly
has been apparentlyaccepting;applieattons.and monies.
On February"2001,'I met with$Linda Buffo, 1st.Dave Dohn, Samantha Doherty of PDA, a PDA
board-member and Pat Easley: LindiBuffo expressedmuch frustration in trying toi work WithMr.
Mattingly as he was not returning;calls or'giving dneeded,information:for:the promotion of the event.
• ., The Petaluma Visitors Program has also expressed much frustration. There also have been

complaints from some;downtown merchants who have been less supportiveaofthesrecent street fairs
that have notbeen addressed. Ititakes a lot of time and-money to repair'bad3:publicity=and ill feelings
from a poorly managed event and to rebuild goodwill with the vendors, other merchants and the
public.
As,you can see, we, and other community entities have tried to work with this situation and I'm sure
you will agree,that the only avenue we have is to form a new organization.
It is important to note that,we do}not wish`to be mired down in the apparent financial!mishandlings
of the past. It is imperative that•weimove forward as of this time and deal with the more crucial
issues that is to return the association'to it's,original mission an&to;restore;the street fair as a very
desirable destination. To accomplish thisiand?to meet our marketing goals, we need to rebuild our
bank account.
Our association is committed to supporting the,antique dealers,to hold open meetings, to be held
accountable for all funds"that;are to be held in the organization's bank account. Membership is to be
open to all antique dealers who wish to join and the bylaws of the organization will be adhered to.
Income from the street-fair will be used;as'originallyordained,at time of founding of the
organization, that is for advertising and marketing of the antique,shops and the street fair.
As the organization representing tie°broadest.base of antique dealers, we recognize the importance
of having a reliable source"for PVP'andcother agencies to contact for information and to tie in with
their many marketing-programs.
ger Our street fairs in the.past'have generated a great'amount;of revenue for the city in the form of taxes.
They have promoted and enhanced the Historic Downtown,:bringing thousands of customers to town
to additionally partake of food and lodging etc. The antique industry has been the key element in
revitalizing the economy of thellistoric`Downtown and the,association in the past has always
recognized the importance of working in,cooperation with the city,and the various community
agencies.
We ask for your support in our request for the permit. We look forward to working with the City of
Petaluma, The Petaluma Visitors Program, The Petaluma Area'Chamber,of Commerce, PDA, the
Butter& Eggs Day Committee and the Downtown merchants to return-to a successful event and a
strong healthy organization.

SUBJECT: Antique-Faire
The purpose of this- correspondence is to inform Yeti of our',position and what we consider to be facts
regarding the Antique Faire. The Antique Faire was originally to be held once a year and held on
Kentucky Street only, which was fine with us. Over the Years,it has become twice 4a year and has slowly
moved up Western Avenue, blocking toff customers from being able to drive up to our store, to either
check our store out or pick up furniture that.they have Turchased. It also inhibits our delivery trucks from
doing the same. On'a normal weekend, we will spend over $5000 iliadvertising in Mann and Sonoma
County medias, to bring people directly to our store, not just create.traffic. We have had numerous
complaints from consumers trying to get-to our store during this event.
Our business generates tax dollars to the Cit.Y.. From what we understand, this event does not. Our.
• company pays a large property tax and assessment find for the downtown garage, etc. The Antique Faire
obviously does not Historically our saki during this event have dipped from 50-6O%, with our customer
count being way down, and the useof our restroom facilities being way up.

Couches, etc.'s business does not negatively influence other businesses around, nor do we ask anybody
else to be impacted negatively for some}event. The AntiqUe Faire negatively impacts our business.

We have heard that this brings revenue to hotels and the restaurant busmesses. We absolutely•believe that
hotels, none of which are downtown, would not be impacted one bit, as the driving distance would not
change if the event was on Kentucky Streetionty, or(even at the fairgrounds on Washington That would
also be the same with the rest.auraitth.
Our business has always supported historical and non-profit events Our track record speaks for itself, the
Butter and Eggs Day Parade, Veterans Day parade, 'Little'League Parade and others, which-have come
and gone over the years. We darn feel that the Antique Faire:falls into:either category.
Please consider the information above as we have always tried to operate Couches, etc: with a high
standard and be an asset to the conununity. Thank you for your consideration.

Faire event it is important for Youlto'know the status,of the upcoming Antique`Faire as it relates to the
Butter and Egg Days event. .
The Batter and Bg Days Committee has;:a signed contract with the Petaluma Antique Dealers
Association to provide the,following services for the Sunday Apri129;2002 Outdoor Antique Faire event
• Promotion support
• Oversight and facilitation of waste ma regenientservices
• Provision of food-vendors

Status:Much of this wo k• tisbeen done and is-in progess'as Ave speak:The event is only'6;weeks away.
History:These services have been provided since 1,989..The benefit of this;contract helps to offset costs
of producing the Butter andEgg;.Days:event This'paraetshep,was formed'12 years ago as a good faith
• 'effort to benefit both events by;presenting a weekend presentation:for-the community. It has helped over
the seas to build the presence of both events.

I approached Gene Beatty with:he request to ciose.that block 2 or 3 year ago:-
I had three reasons Tor the request.
1) The strolling pedestrian atmosphere created by. the set up of`booths` corntinuing from Kentucky
through to Fourth Sveetrcrested a^traffic!safety concern on the part of pe&,lflans at Western and.
Kentocky
2) Resident businesses-worm puttng antiques.on.`the sidewalk:and by providing space in the street the
sidewalks could be kept clear:
3) The size of the crowd demanded more food services and the:hest place to-locate,than was Western
Ave. between Kentucky;and The-Blvd. We auemp'ted to locatefaod.vendors in the Main Si Jot*and
tltey:failed to,serve the crrind well because they were too far out of the mainstream of pedestria a
traffic.
