We are unable to attend the Monday meeting on the 20th and want to continue to reiterate our opposition to the density in the proposed Sunnyslope 2 development. While we appreciate your efforts to adhere to some of the recommendations of the EIR for the Sunnyslope Assessment District, we are dismayed at the disregard for the density provision and secondarily, for the open fencing provision which should extend to ALL parcels. Perhaps you can explain how /When and why the density in the general plan supersedes the PUD .density when Mr Moore clearly led us to believe in March of 2009 that the PUD density would be protected in the new general plan?? As I, read the language below (I =P -5) it seems to stipulate " parcels and/or units ... that were not contemplated." The parcel was clearly "contemplated" and a unit/density at a maximum .ofl'3 was assigned after environmental review. The costs that were prorated included sewer /water lines, road/sidewalk improvements, lighting, etc. These will not change (except sidewalks /lighting directly on the property fronting Sunnyslope Road). WE, in the Sunnyslope Assessment District, have shouldered the of the cost f6vthe infrastructure /improvements and it will,be fairly apportioned only if a MAXIMUM number of 13 units are allowed. You will see that your letter was included as Attachment 9. I did want to take the opportunity to respond to a few of the points in your email. Density General Plan 2025 contains an express policy stating that the unit yield calculation pursuant to the Sunnyslope annexation (which includes Ordinance No. 1856 and Resolution 91 -151), is superseded by the density range for the property established in the General Plan. Policy I -P -5 The unit yield calculation historically used in the Sunnyslope Assessment District, per the 1985 annexation, is superseded by the applicable density ranges in the General Plan. Any parcels and /or units that are created in the future that were, not contemplated by the original assessment and unit yield calculation will be required to pay the full cost of any additional infrastructure (sewer, water, etc.) needed to support those new parcels /units. The General Plan density range is calculated on net acreage of approximately 7.62 acres, using the Very Low Density Residential range of 0.6 to 2.5 dwelling units per net acre. Therefore, density under General Plan 2025 would be between 4.6 and 19 total units. Minimizing infill development impact With Option B, each house will have an individual design review hearing before the Planning Commission, after neighborhood notice. This individualized treatment tends to be the most effective means of ensuring compatibility with existing homes. Construction Hours Condition of Approval 16 (see Attachment 3) limits the construction hours to Monday through Friday 8 to 5, consistent with the original Sunnyslope PUD. Open Wire Fencing Only open wire fencing is permitted in the upper 2.6 acres. Preservation of Native Oaks You will find a great deal of discussion on the preservation of protected trees in the Staff Report and Attachment 4. Basically, since 2009, the applicant has made considerable efforts to increase tree preservation. They evaluated each tree and any plan modifications practicable to see if any further could be saved. Under Option B only four protected trees are proposed for removal; none of these are large and two are not in good condition. After reviewing the Staff Report and Attachments, let me know if you have any questions. We communicated our concerns re: the proposed Sunnyslope 2 subdivision to Mr Moore and members of the Petaluma City Council in March 2009.
