HomeMy WebLinkAboutResolution 00-198 N.C.S. 11/20/2000 1 resolution No. 00-1981V.C.S. z of the City of Petaluma, California 3 4 ESTABLISHING AN ANNUM, BENEFIT ASSESSMENT FEE ON ALL 5 BUSINESSES, TRADES, PROFESSIONS, ANI) VENDORS WITHIN THE 6 PETALUMA DOWNTOWN BUSINESS IMPROVEMENT DISTRICT 7 PURSUANT TO PETALUMA MUNICIPAL CODE SECTION 6.04 AND 8 ADOPTED ORDINANCE NO. 2104 N.C.S. 9 10 WHEREAS, Chapter 6.04 of the Petaluma Municipal Code provides that the City Council shall 11 determine, by Resolution, the fair annual benefit assessment on all businesses, trades, 12 professional, and vendors within the Downtown Petaluma Business Improvement District; and 13 14 WHEREAS, notice of the Business Improvement District formation and the assessment of said 15 annual benefit assessment fees has been given and a public hearing. was noticed and held on 16 October 16~`, 2000; and 17 18 WHEREAS, Ordinance No. 2104 N.C.S. was adopted November 20a', 2000, to establish an 19 annual benefit assessment on all businesses, trades, profession, and vendors within the Business 20 Improvement District, the proceeds of which shall be used for the public purposes described 21 within said Ordinance and Chapter 6.04 of the Petaluma Municipal Code, to benefit the 22 businesses in the District, pursuant to the Parking and Business Improvement Area Laws of 23 1989, Part 6 (commencing with Section 36500) of Division 18 of the California Streets and 24 Highways Code (the "Act"); and 25 26 NOW, THEREFORE, BE IT RESOLVED that the annual benefit assessment fee for the 27 period commencing January 1, 2001 and until revised, is hereby established pursuant to 28 Petaluma Municipal Code Section 6.04; and 29 30 NOW, THEREFORE, BE IT FURTHER RESOLVED that for the purpose of this annual 31 benefit assessment fee, the following business type definitions shall apply: 32 Reso. 00-198 NCS Page 1 1 Retail and Restaurant: Businesses that buy and resell goods, examples are clothing stores, shoe 2 stores, office supplies and businesses that sell prepared foods and drinks. 3 4 Antique Collectives: Includes such businesses and business locations that represent multiple 5 dealers of antique merchandise within one location. 6 7 Service Businesses: Businesses that sell services.
