Earlier this year, the City initiated abatement proceedings against the property at 320 Howard Street and incurred $26,945.56 in costs to complete the abatement. Those costs are summarized in Attachment 1 of this packet and include all City staff time and the work of the contractors hired by the City. Pursuant to Section 1.14.130(B) of the Municipal Code, Mr. Lester Young, the owner of the property at 320 Howard, was provided with a full accounting of the City's costs to abate the various violations of City codes at the property at 320 Howard. Mr. Young subsequently filed a written protest of the charges. Section 1.14.130(C) states that "At the time and place fixed for receiving and considering the cost report, the City Council shall hear a summary of the cost report and any objections by the responsible party or property owner against whom such costs are being charged or against whose property an abatement lien or special assessment may be imposed. After considering the cost report and any objections thereto, the City Council may make such modifications to the cost report as it deems appropriate, after which the report may be confirmed by order of the City Council." BACKGROUND: The property at 320 Howard Street had been in violation of numerous City codes for many years. In response to neighbor complaints and with the Council's adoption of the new code enforcement regulations earlier this year, the City was able to abate the violations at 320 Howard Street following the procedures outlined in the new ordinance. 3. ALTERNATIVES: The City Council has the option to modify the cost report as presented as it deems necessary. 4. FINANCIAL IMPACTS: The City has already expended the funds to abate 320 Howard. These costs were not budgeted in FY 06 -07. 5. CONCLUSION: N/A 6. OUTCOMES OR PERFORMANCE MEASUREMENTS THAT WILL IDENTIFY SUCCESS OR COMPLETION: Should the Council adopt the attached resolution, the City will have the authority to recover the costs for the abatement of 320 Howard through a lien on the subject property. 7. RECOMMENDATION: Adopt the attached Resolution. 3
