HomeMy WebLinkAboutResolution 00-021 N.C.S. 01/18/2000 ` ReS®lUtiOn N®. 00-21 N C.S. of the City of Petaluma, California 1 RESOLUTION AUTHORIZING THE PARKS AND RECREATION DEPARTMENT TO 2 APPLY FOR A COASTAL CONSERVANCY GRANT TO IMPLEMENT PHASE III OF 3 THE PETALUMA MARSH ENHANCEMENT PLAN, AND CONFIRMING THAT 4 SURROUNDING CIRCUMSTANCE AND CONDITIONS HAVE NOT CHANGED 5 SINCE THE CEQA NEGATIVE DECLARATION FROM 1992 6 7 8 WHEREAS, the City of Petaluma with the financial assistance. of the Coastal Conservancy, 9 developed the Petaluma Marsh Enhancement Plan for the Petaluma marsh in 1992; and 10 11 WHEREAS, Phase I and II of the Petaluma Marsh Enhancement Plan have been implemented 12 focusing on public access pathways and enhancement of lower Adobe Creek, including riparian 13 and tidal marsh restoration at Shollenberger Park; and 14 15 WHEREAS, the success of Phases I and II of the enhancement plan has proven to be extremely 16 popular with the Petaluma community, with access trails used by recreational joggers and 17 walkers, bird watchers, nature photographers and educational programs; and I8 19 WHEREAS, without the further financial assistance of the Coastal Conservancy grant program 20 further implementation of the Petaluma Marsh Enhancement Plan would be delayed for many 21 years; and 22 23 WHEREAS, through the assistance of the Coastal Conservancy grant program and City 24 matching funds where required, the City of Petaluma can implement Phase III of the Petaluma 25 Marsh Enhancement Plan for the Petaluma marsh, allowing the City to further expand and 26 preserve valuable marsh enhancement areas for the education and enjoyment of local citizens, 27 and the improvement of marsh enhancement areas; and 28 29 Reg. Page 1 of 2 1 NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Petaluma to 2 hereby authorize the Parks and Recreation Department to apply for a coastal conservancy grant 3 with the intent of implementing Phase III of the Petaluma Marsh Enhancement Plan for the 4 Petaluma marsh; and 5 6 IT IS FURTHER RESOLVED, that the City Council finds that the remainder of the Petaluma 7 Marsh Enhancement Plan for the Petaluma marsh, and surrounding circumstances and conditions 8 have not changed since the adoption of the CEQA negative declaration of 1992. 9 10 IT IS FURTHER RESOLVED, that the City Council of the City of Petaluma makes the 11 finding that there is no evidence that the Petaluma Marsh Enhancement Plan for the Petaluma 12 marsh located between the Petaluma Marina and Shollenberger Park will have a potentially 13 adverse effect, either individually or cumulatively on wildlife resources as defined in California 14 Fish and Game Code Section 711.2; and 15 16 IT IS FURTHER RESOLVED, that the City, on the basis of substantial evidence, rebutted the 17 presumption of adverse effect contained in 14 Calif. code of regs., section 753.5(d) regarding the 18 potential for adverse effects on wildlife resources as defined under California Fish and Game 19 Code Section 711.2 20 21 IT IS FURTHER RESOLVED, that the City Council authorizes the City Manager to negotiate 22 and execute relevant instruments, including agreements with the Coastal Conservancy. 23 24 j c/nb/resphiii/c: j im Under the power and authority conferred upon this Council by the Charter of said City.
