4 RESOLUTION AUTHORIZING THE FILING OF AN APPLICATION FOR FEDERAL
5 SURFACE TRANSPORTATION PROGRAM AND CONGESTION MITIGATION AND
6 AIR QUALITY IMPROVEMENT PROGRAM FUNDING FOR BUS PURCHASE
7 AND COMMITTING THE NECESSARY LOCAL MATCH FOR THE PRO.IECT
8 AND STATING THE ASSURANCE OF THE CITY OF PETALUMA TO
9 COMPLETE THE PROJECT

11 WHEREAS, the Transportation Equity Act for the 21st Century (TEA 21) (Public Law
12 105-178, June 9, 1998) and the TEA 21 Restoration Act (Public Law 105-206, July 22, 1.998)
13 continue the Surface Transportation Program (23 U.S.C. Section 133 and the Congestion
14 Mitigation and Air Quality Improvement Program (CMAQ) (23 U.S.C. Section 149); and
15
16 WHEREAS, pursuant to TEA 21, and the regulations. promulgated thereunder, eligible
17 project sponsors wishing to receive Surface Transportation Program or Congestion Mitigation
18 and Air Quality Improvement Program grants for a project shall submit an application first with
19 the appropriate metropolitan transportation planning organization (MPO), for review and
20 inclusion in the MPO's Transportation Improvement Program (TIP); and
21
22 WHEREAS, the Metropolitan Transportation Commission is the MPO for the San
23 Francisco Bay region; and
24
25 WHEREAS, the City of Petaluma is an eligible project sponsor for Surface
26 Transportation Program or Congestion Mitigation and Air Quality Improvement Program funds;
27 and
28
29 WHEREAS, the City of Petaluma wishes to submit a grant application to MTC for funds
30 from the Surface Transportation Program or Congestion Mitigation and Air Quality
31 Improvement Program in fiscal year 1999-2000 for the following project:

1 WHEREAS, IvITC requires, as part' 9f the application, a resolution stating the following:

3 1. The Commitment of necessary Iocal matching funds of at least 11.5%; and
4 2. That the sponsor understands that the Surface Transportation Program and Congestion
5 Mitigation and Air Quality Improvement Program funding is fixed at the programmed
6 amount, and therefore any cost increase cannot be expected to be funded with Surface
7 Transportation Program or Congestion Mitigation and Air Quality Improvement Program
8 funds; and
9 3. The assurance of the sponsor to `complete the project as described in the application, and
10 if approved, as programmed in MTC's TIP; and
11 4: That the sponsor understands that funds must be obligated by September 30, 2002, for
12 non-operating projects and September 30, 2003, for operating projects, or the project may
13 be removed from the. program. . -

15 NOW, THEREFORE, BE IT-RESOLVED by the:Petaluma City Council that the Mayor
16 or City Manager is authorized fo execute and file an application for funding under the Surface
17 Transportation Program or the Congestion Mitigation and Air Quality Improvement Program of
18 TEA 21 in the amount of $200,000 for bus purchase.

20 BE IT FURTHER RESOLVED .that the Petaluma City Council, by adopting this
21 resolution, does hereby state that:
22
23 1. The City of Petaluma will. provide $50,000 in local matching funds; and
24
25 2. The City of Petaluma understands that the Surface Transportation Program and
26 Congestion Mitigation and Air Quality Improvement Program funding for the project is
27 fixed at $200,000 STP/CMAQ amount) and that any cost increases must be funded by the
28 City of Petaluma from local matching funds, and that the City of Petaluma does not
29 expect any cost increases to be funded with Surface Transportation Program or
30 Congestion Mitigation and Air Quality Improvement Program funds; and

1 3, Bus purchase will be made as described in this resolution and, if approved, for the
2 amount shown in the Metropolitan Transportation Commission (MTC) Transportation
3 Improvement Program (TIP) with obligation occurring within the timeframe established
4 below: and

6 4, The program funds are expected to be obligated by September 30, 2002, for non-
? operating projects and by September 30, 2003 for operating projects.

9 BE IT FURTHER RESOLVED that a copy of this resolution will be transmitted to the
10 MTC in conjunction with the filing of the application; and
11
12 BE IT FURTHER RESOLVED that the MTC is requested to support the application for
13 the project described in the resolution and to program the project, if approved, in MTC's TIP.
