of the City of Petaluma, California
ADOPTING FINDINGS ALLOWING THE SPRING 2000 CONSTRUCTION OF
OLD ELM VILLAGE AND THE PAYMENT OF DETENTION POND IMPACT FEES
WHEREAS the City Council has adopted Resolutions 99-97 (PUD Approval) and 99-97 A
(Negative Declaration) which contain conditions of approval and mitigation measures which regulate
the commencement of construction of Old Elm Village; and
WHEREAS the developer of Old Elm Village, Burbank Housing Development Corporation, has
presented findings regarding Condition #29 of the PUD approval, which document that progress on
the channel improvement project is at a level of completion which would allow the issuance of
building permits and commencement of construction of Old Elm Village in Spring 2000, and
WHEREAS the developer has agreed to comply with Mitigation Measure #6 of the Negative
Declaration by contributing into a Detention Pond lmpact Fund in the amount not to exceed forty-
three thousand two hundred dollars ($43,200) or three times the Storm Drain Lmpact Fees ($14,400)
required of the development; and
WHEREAS it is also recognized by the City Council of Petaluma that this development has unique
importance in that it provides 87 units of affordable housing to low and moderate income Petalumans
and addresses many of the goals and priorities of the City's Housing Element, the Community
Development Block Grant Consolidated Plan and the Redevelopment Implementation Plan; and
WHEREAS it is the intent of the City Council that this resolution is adopted specifically to address
the City's housing goals and the City's ".fair share" of regional housing needs as determined by the
Association of Bay Area Governments (ABAG) and is not intended to be seen as a model for future
decisions regarding responsibility for detention pond implementation,
THEREFORE BE IT RESOLVED that the City Council hereby approves the developer's request
for a Spring 2000 constnlction start and payment into a Detention Pond Llnpact Fund.
THEREFORE BE IT FURTHER RESOLVED that staff will develop city loan documents which
memorialize the City Council's policy direction regarding developer responsibility in the provision of
off-site detention.
